1.By means of filing instant writ petition under Article 227 ofConstitution of India, petitioner has challenged the final orderdated 17.09.2024 passed by the Rajasthan Real EstateRegulatory Authority, Jaipur, whereagainst indisputably, thepetitioner has remedy of statutory appeal under Section 44 ofReal Estate (Regulation and Development) Act, 2016 (RERA)before the Appellate Tribunal.
2.In that view, counsel for the petitioner seeks permission towithdraw the writ petition with liberty to avail the statutoryremedy of appeal.
3.Accordingly, the writ petition is dismissed as withdrawn withliberty prayed for.
4.Stay application and any other pending appealing, if any,also stand disposed of.
