DATE : 22[nd] October 2012 1.The grievance of the petitioners in this writ petition is against the communication issued by the Additional Director of Income Tax declining to furnish the documents seized during the course of search that took place on 20[th] November 2010. 2.This Court by an order dated 19[th] June 2012 directed the petitioners to make an application under Section 138 of the Income Tax Act in the prescribed form seeking the documents in question, so that the Appropriate Authority considers the same and passes appropriate order in 3.It is the case of the petitioners that on 28[th] June 2012 requisite application has been filed before the Commissioner of Income Tax, Central – I, Mumbai. Counsel for the Revenue states that the said application of the petitioners dated 28[th] June 0212 would be considered and appropriate order would be passed within a period of three months from today.
