VENKATARAMJAH, JJ.] In:ome Tax Act, 1961, Sections 2(13), 2(36), 9(1), 163(1} and 195(2). scope of-Words and phrases-"Business" and "having business connection"-explained-Presumption of obligation of the agent to deduct the tax payable under the Income Tax Act at source on paym!nt m1de to a n?n-resident. The appellants are partners of a firm of Solicitors at Calcutta and they had been engaged by a German Corporation to act on its behalf in three suits pending before the High Court at Calcutta. A firm of Solicitors in London, namely M/s. Ashurst, Morris, Crisp & Co., which was also acting on behalf of the German Corporation instructed the appellants to retain Mr. Blanco White Q.C., a resident of the United Kingdom, who was a barrister having considerable practice in the branch of patent law, to argue the case in the aforesaid three suits. The appellants did not deliver any briefs to him and also did not pay or undertake any obligation to pay any fees for his services. The briefs had been earlier delivered by the London Solicitors. Mr. Blanco White left India on February 17, 1970 after arguing the cases for 13 days commencing from January 27, 1970 to February 16, 1970, without making any arrangement regarding the payment of the Income Tax on the fees earned by him. The Income Tax Officer informed the appellants that he proposed to proceed against them under section 163(1) of the Act treating them as the agents of Mr. Blanco White on the ground that the income arising out of professional charges had arisen on account of the business connection that existed between the appellants and Mr. Blanco White. Thereafter the appellants challenged the said order of the Income Tax Officer by filing a petition under Article 226 of the Constitution before the High Court of Calcutta. The learned Single Judge dismissed the petition on the ground that it was a premature one taking the view that the question whether the case came within the purview of section 163(1) of the Act had to be determined after ascertainment of facts by the Income tax Officer. The appeal preferred by the appellants was dismissed by a Division Bench holding (a) there was business connection (directly or indirectly through correspondence) between the appellants' firm and their non-resident British Counsel Mr. Blanco White and that an agency could very well be said to have been established between them ; (b) there was busine's connection between them and (c) income di:! either accrue or arise to Mr. Blanco White in India. However, the Division Bench granted certificate to the appellants under Article 133 of the Constitution and hence the appeal. A B c D E F G H A B c D E F G H Dismissing the appeal, the Court HELD : I. From the facts and other material on 1ecord there was con-nection between the appellants and Mr. Blanco White. The said connection cannot also be termed as a casual one h1ving regard to the period over which it had existed. It was real and intimate an<l Mr. Blanco White earned the fees for arguing the case in India only through the said connection. From the year 1965 there was correspondence between the appellants and the London Solicitors who in their turn had engaged Mr. Blanco White in connectbn with the suits in question. Mr. Blanco White appeared before the High Court along with Indian counsel engaged by the appellants, though with the leave of the Co"Jrt granted presumably under section 32 of the Advocates Act, 1951. [[1981] 3 S.C.R. 387] (1981) Commissioner of Income-tax, P11niab v. R.D. Aggarwal and Co. and Anr., 56 I.T.R. 20, applied. 2. It is incorrect to suggest that it was the intention of the Parliament to exclude non-residents engaged in learned professions from the operation of section 9(1). The words in section 9(1) land section 163 are comprehensive enough to include all heads of income mentioned in section 14 of the Act. [399 F DJ, 3. The expression "business" does not necessarily mean trade ~or manufac-ture only it is being used as including within its scope professions, vo;ations, and callings from a fairly long time. From section 2(b) of the Indian Partnership Act, 1932, it is clear that the "business is one of wide import and it means an activity carried on continuously and systematically by a person by the application of his labour or skill with a view to earning an income. In the context in which the expression "business connection" is used in section 9(1) of the Income Tax Act, 1961 there is no warrant for giving a restricted meaning to it excluding "professional connection" from its scope. In the instant case, (a) it cannot be said that since Mr. Blanco White could not appear as connsel as of right either under the Advocates Act or under the Calcutta High Co·.trt Origiml Side Rules, he could not be treated as having any business connection with the appellants ; (b) since Mr. Blanco White appeared along with the Indian counsel engaged by the appellants and the appellants continued to represent the German Corporation when Mr. Blanco White argued the case b~fore the High Coc1rt, it cannot be said that Mr. White was a stranger to the appellants; (c) the appellants may not have engaged him to argue the case but, they allowed him at the request of the London Solicitors to argue the case and willingly co-operated with him in doing so ; (dJ the app~llants may not have undertaken to pay Mr. White's fees but he could not have argued and earned the fees without associating himself with the appellants. The fact that Mr. Blanco White being a barrister could not file a suit to recover the fees would not make any difference ; and (e) that it is seen from the correspondence that Mr. Blanco White has earned the fees amounting to Pounds 2200 with refreshers at the !ate of Pounds 220 per d>y, for the work done in rr..:;;.. [[1981] 3 S.C.R. 387] (1981) ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ ਟੈਕਸ, ਬੰਬੇ ਬਨਾਮ ਕੁਰੀਮਭੋਏ ਇਬਰਾਹਿਮ ਅਤੇ ਸੰਸ ਲਿਮਟਿਡ, [1933] 1 ਆਈ.ਟੀ.ਆਰ. 395; ਕ੍ਰਿਸਟਰ ਬਾਰਕਰ ਐਡ ਸੰਸ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਲੈਂਡ ਰਾਜਸਵ, [1996] 2 ਕੇਬੀ 222 ਪੇਜ 228 'ਤੇ ਅਤੇ ਕਮਿਸ਼ਨ ਆਫ ਹਾਰਟਫੋਰਡ ਰਾਜਸਵ ਬਨਾਮ ਮੋਪੇਲ, [1994] 73 ਬੋਰਕਮੈਨ ਐਲ 2/179, ਲਿੰਕਨ [1903] ਕੇਬੀਆਈ 993, ਮਨਜ਼ੂਰੀ ਨਾਲ ਪੇਸ਼ ਕੀਤਾ ਗਿਆ। 4. ਇਸ ਮਾਮਲੇ ਵਿੱਚ, ਇਹ ਕਿਹਾ ਨਹੀਂ ਜਾ ਸਕਦਾ ਕਿ ਸ਼੍ਰੀ ਬਿਆਂਕੋ ਵ੍ਹਾਈਟ ਅਡਵੋਕੇਟ ਐਕਟ ਜਾਂ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦੇ ਮੂਲ ਪਾਸੇ ਦੇ ਨਿਯਮਾਂ ਤਹਿਤ ਵਕੀਲ ਵਜੋਂ ਪੇਸ਼ ਨਹੀਂ ਹੋ ਸਕਦੇ, ਇਸ ਲਈ ਉਹ ਅਪੀਲਕਰਤਾਵਾਂ ਨਾਲ ਕੋਈ ਕਾਰੋਬਾਰ ਸੰਬੰਧ ਨਹੀਂ ਰੱਖਦੇ। ਸ਼੍ਰੀ ਬਿਆਂਕੋ ਵ੍ਹਾਈਟ ਨੇ ਭਾਰਤੀ ਵਕੀਲਾਂ ਦੇ ਨਾਲ ਉੱਚ ਅਦਾਲਤ ਵਿੱਚ ਪੇਸ਼ ਹੋ ਕੇ ਗੋਰਮ ਕਾਰਪੋਰੇਸ਼ਨ ਦੀ ਨੁਮਾਇੰਦਗੀ ਕੀਤੀ, ਇਹ ਕਿਹਾ ਨਹੀਂ ਜਾ ਸਕਦਾ ਕਿ ਲੰਡਨ ਦੇ ਵਕੀਲਾਂ ਨੇ ਮਾਮਲੇ ਦੀ ਪੇਸ਼ੀ ਕੀਤੀ ਅਤੇ ਉਨ੍ਹਾਂ ਨੇ ਅਪੀਲਕਰਤਾਵਾਂ ਨਾਲ ਸਹਿਯੋਗ ਕੀਤਾ। ਅਦਾਲਤ ਦੁਆਰਾ ਵਿਸ਼ਲੇਸ਼ਣ ਕੀਤੇ ਜਾਣ 'ਤੇ ਸਿਰਫ਼ ਸ਼੍ਰੀ ਪਾਲਮਰ ਦੀ ਫੀਸ ਦੀ ਇਜਾਜ਼ਤ ਦਿੱਤੀ ਗਈ ਸੀ, ਪਰ ਸ਼੍ਰੀ ਬਿਆਂਕੋ ਵ੍ਹਾਈਟ ਨੇ ਇਕਪਾਸੜ ਤੌਰ 'ਤੇ ਜੁੜਨ ਦੀ ਇਜਾਜ਼ਤ ਦਿੱਤੀ ਸੀ। ਇਹ ਗੱਲ ਕਿ ਸ਼੍ਰੀ ਬਿਆਂਕੋ ਵ੍ਹਾਈਟ ਇੱਕ ਬੈਰਿਸਟਰ ਸਨ ਅਤੇ ਉਹ ਕੋਈ ਵਕੀਲ ਨਹੀਂ ਸੀ, ਉਹ ਫੀਸ ਤੋਂ ਬਿਨਾਂ ਪੇਸ਼ ਨਹੀਂ ਹੋ ਸਕਦੇ ਸਨ।ਫੀਸਾਂ ਦੀ ਵਸੂਲੀ ਲਈ ਮੁਕੱਦਮੇ ਨਾਲ ਕੋਈ ਫ਼ਰਕ ਨਹੀਂ ਪਵੇਗਾ; ਅਤੇ (e) ਇਹ ਪੱਤਰ ਵਿਹਾਰ ਤੋਂ ਦੇਖਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਸ੍ਰੀ ਬਲੈਂਕੋ ਵ੍ਹਾਈਟ ਨੇ ਵਿੱਚ ਕੀਤੇ ਗਏ ਕੰਮ ਲਈ, ਪ੍ਰਤੀ ਦਿਨ 220 ਪੌਂਡ ਦੇ ਰਿਫਰੈਸ਼ਰ ਦੇ ਨਾਲ 2200 ਪੌਂਡ ਦੀ ਫੀਸ ਕਮਾ ਲਈ ਹੈ। ਇਸ ਲਈ, ਅਪੀਲਕਰਤਾ ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੀ ਧਾਰਾ 153(1) ਦੇ ਤਹਿਤ ਸ੍ਰੀ ਬਲੈਂਕੋ ਵ੍ਹਾਈਟ ਦੇ ਟੈਕਸ ਏਜੰਟਾਂ ਪ੍ਰਤੀ ਜਵਾਬਦੇਹ ਹਨ। ਸਿਵਲ ਅਪੀਲ ਅਧਿਕਾਰ ਖੇਤਰ : ਸਿਵਲ ਅਪੀਲ ਨੰਬਰ 1038 ਦੀ 1973. ਪ੍ਰਮਾਣ ਪੱਤਰ ਦੁਆਰਾ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦੇ ਫੈਸਲੇ ਅਤੇ ਹੁਕਮ ਤੋਂ ਅਪੀਲ ਕੀਤੀ ਗਈ, ਜੋ ਕਿ 19ਵੀਂ ਫਰਵਰੀ 1973 ਨੂੰ ਮੂਲ ਹੁਕਮ ਨੰਬਰ 200 ਦੀ 1971 ਵਿੱਚ ਅਪੀਲ ਵਿੱਚ ਦਿੱਤਾ ਗਿਆ ਸੀ. ਐਸ. ਚੌਧਰੀ, ਪੀ.ਪੀ. ਗਿਨਵਾਲਾ, ਟੀ.ਏ. ਰਾਮਚੰਦਰਨ ਅਤੇ ਡੀ.ਐਨ. ਗੁਪਤਾ ਮੁਲਜ਼ਮਾਂ ਲਈ. ਵਾਈ.ਐਸ. ਦੇਸਾਈ, ਚੰਪੀ ਰਲੀ ਅਤੇ ਮਿਸ ਏ. ਸੁਭਾਸ਼ਿਨੀ ਪ੍ਰਤੀਵਾਦੀ ਨੰਬਰ 1 ਅਤੇ 2 ਲਈ. ਅਦਾਲਤ ਦਾ ਫੈਸਲਾ ਵੈਂਕਟਰਮਨੀਆ, ਜੇ. ਇਸ ਅਪੀਲ ਦੇ ਸਰਟੀਫਿਕੇਟ ਅਨੁਸਾਰ ਸੰਵਿਧਾਨ ਦੇ ਅਨੁਸਾਰ 133 ਹੈ, ਜੋ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦੇ ਸਾਹਮਣੇ ਮੁਲਜ਼ਮਾਂ ਦੁਆਰਾ ਦਾਇਰ ਕੀਤੀ ਗਈ ਇੱਕ ਰਿਟ ਪਟੀਸ਼ਨ ਤੋਂ ਬਾਹਰ ਹੈ। ਮੁਲਜ਼ਮ ਵਕੀਲਾਂ ਦੀ ਇੱਕ ਫਰਮ ਦੇ ਸਾਥੀ ਹਨ, ਜਿਸ ਨੂੰ ਐਸ/ਸ਼੍ਰੀ ਦੀ ਫਰਮ ਵਜੋਂ ਜਾਣਿਆ ਜਾਂਦਾ ਹੈ। ਡਾ. ਸ਼ਿਗੇਮੀ ਐਡ ਕੰਪਨੀ ਦਾ ਕਾਰਜਾਲਯ ਕਲਕੱਤਾ ਵਿੱਚ ਹੈ। ਮੁਲਜ਼ਮਾਂ ਨੇ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦੇ ਮੂਲ ਪਾਸੇ ਦੋ ਮੁਕੱਦਮਿਆਂ ਵਿੱਚ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਦੇ ਵਕੀਲ ਵਜੋਂ ਕੰਮ ਕੀਤਾ, ਜਿਸ ਵਿੱਚ ਬੰਗਾਲ ਕੈਮੀਕਲ ਅਤੇ ਫਾਰਮਾਸਿਊਟੀਕਲ ਵਰਕਸ ਲਿਮਟਿਡ ਵੱਲੋਂ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਅਤੇ ਹੋਰ ਮੁਕੱਦਮਾ ਨੰਬਰ 1124 ਦੀ 1962 ਵਿੱਚ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਵੱਲੋਂ ਬੰਗਾਲ ਕੈਮੀਕਲ ਅਤੇ ਫਾਰਮਾਸਿਊਟੀਕਲ ਵਰਕਸ ਲਿਮਟਿਡ ਵਿਰੁੱਧ ਦਾਇਰ ਕੀਤਾ ਗਿਆ ਸੀ। ਮੁਲਜ਼ਮਾਂ ਨੂੰ ਲੰਡਨ ਵਿੱਚ ਵਕੀਲਾਂ ਦੀ ਇੱਕ ਫਰਮ ਦੁਆਰਾ ਨਿਰਦੇਸ਼ ਦਿੱਤਾ ਗਿਆ ਸੀ। ਕਿਉਂਕਿ ਉਹ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਲਈ ਮਾਮਲਾ ਲੜ ਰਹੇ ਸਨ, 31 ਮਈ 1965 ਨੂੰ ਇੱਕ ਫੈਸਲੇ ਦੁਆਰਾ ਉਨ੍ਹਾਂ ਨੂੰ ਉਸ ਮਾਮਲੇ ਨੂੰ ਬਰਕਰਾਰ ਰੱਖਣ ਲਈ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਕਿਉਸੀ, ਯੂਨਾਈਟਿਡ ਕਿੰਗਡਮ ਦੇ ਨਿਵਾਸੀ, ਜੋ ਪੇਟੈਂਟ ਕਾਨੂੰਨ ਦੀ ਸ਼ਾਖਾ ਵਿੱਚ ਕਾਫ਼ੀ ਅਭਿਆਸ ਕਰਨ ਵਾਲੇ ਇੱਕ ਵਕੀਲ ਸਨ। ਭਾਰਤ ਵਿੱਚ ਉਸਦੀ ਆਮਦ ਤੇ, ਮੁਲਜ਼ਮਾਂ ਨੇ ਉਸਨੂੰ ਉਨ੍ਹਾਂ ਦੇ ਮੁਕੱਦਮੇ ਦਾ ਮਾਮਲਾ ਲੜਨ ਲਈ ਵਕੀਲ ਵਜੋਂ ਨਿਯੁਕਤ ਕੀਤਾ, ਹਾਲਾਂਕਿ ਉਹ ਉਸ ਨੂੰ ਕੋਈ ਬ੍ਰੀਫ ਨਹੀਂ ਦਿੰਦੇ ਸਨ ਅਤੇ ਨਾ ਹੀ ਉਸ ਦੀਆਂ ਸੇਵਾਵਾਂ ਲਈ ਕੋਈ ਫੀਸ ਅਦਾ ਕਰਦੇ ਸਨ ਜਾਂ ਅਦਾ ਕਰਨ ਦਾ ਕੋਈ ਵਾਅਦਾ ਕਰਦੇ ਸਨ। ਇਹ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਉਨ੍ਹਾਂ ਨੇ ਪਹਿਲਾਂ ਲੰਡਨ ਦੇ ਵਕੀਲਾਂ ਨੂੰ ਬ੍ਰੀਫ ਦਿੱਤੇ ਸਨ, ਪਰ ਉਨ੍ਹਾਂ ਨੂੰ ਇਹ ਨਹੀਂ ਪਤਾ ਸੀ ਕਿ ਉਸ ਨੂੰ ਕਿੰਨਾ ਪੈਸਾ ਦੇਣਾ ਹੈ। ਇੱਕ ਮੁਕੱਦਮੇ ਦੀ ਸੁਣਵਾਈ 13 ਦਿਨਾਂ ਤੱਕ ਚਲੀ, ਜੋ ਕਿ 27 ਜਨਵਰੀ 1970 ਤੋਂ ਸ਼ੁਰੂ ਹੋ ਕੇ 16 ਫਰਵਰੀ 1970 ਨੂੰ ਸਮਾਪਤ ਹੋਈ। ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਨੇ 17 ਫਰਵਰੀ 1973 ਨੂੰ ਸੁਣਵਾਈ ਤੋਂ ਬਾਅਦ ਭਾਰਤ ਛੱਡ ਦਿੱਤਾ, ਜਿਸ ਵਿੱਚ ਉਸਨੇ ਆਪਣੀਆਂ ਸੇਵਾਵਾਂ ਲਈ ਆਮਦਨ ਟੈਕਸ ਦਾ ਭੁਗਤਾਨ ਕਰਨ ਦੀ ਕੋਈ ਵਿਵਸਥਾ ਨਹੀਂ ਕੀਤੀ। ਇਸ ਤੋਂ ਬਾਅਦ, 19 ਫਰਵਰੀ 1970 ਨੂੰ, ਮੁਲਜ਼ਮਾਂ ਨੇ ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀ, 'ਏ' ਵਾਰਡ, ਵਿਦੇਸ਼ੀ ਸੈਕਸ਼ਨ ਤੋਂ ਇੱਕ ਨੋਟਿਸ ਪ੍ਰਾਪਤ ਕੀਤਾ, ਜਿਸ ਵਿੱਚ ਉਨ੍ਹਾਂ ਨੂੰ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਦੁਆਰਾ ਭਾਰਤ ਵਿੱਚ ਕਮਾਈ ਗਈ ਫੀਸ ਬਾਰੇ ਜਾਣਕਾਰੀ ਦੇਣ ਲਈ ਕਿਹਾ ਗਿਆ ਸੀ, ਜੋ ਉਨ੍ਹਾਂ ਦੁਆਰਾ ਨਿਯੁਕਤ ਵਕੀਲ ਸੀ, ਅਤੇ ਉਨ੍ਹਾਂ ਦਾ ਧਿਆਨ ਇਸ ਗੱਲ ਵੱਲ ਦਿਵਾਇਆ ਗਿਆ ਸੀ। ਆਮਦਨ ਟੈਕਸ ਐਕਟ 1961 (ਜਿਸ ਨੂੰ ਇਸ ਤੋਂ ਬਾਅਦ 'ਐਕਟ' ਕਿਹਾ ਜਾਵੇਗਾ) ਦੀ ਧਾਰਾ 195(2) ਦੇ ਤਹਿਤ ਇੱਕ ਗੈਰ-ਨਿਵਾਸੀ ਨੂੰ ਕੀਤੇ ਗਏ ਭੁਗਤਾਨਾਂ 'ਤੇ ਸਰੋਤ 'ਤੇ ਟੈਕਸ ਦਾ ਭੁਗਤਾਨ ਕਰਨ ਦੀ ਲੋੜ ਸੀ। ਮੁਲਜ਼ਮਾਂ ਨੇ 24 ਫਰਵਰੀ 1970 ਨੂੰ ਉਸ ਪੱਤਰ ਦਾ ਜਵਾਬ ਦਿੱਤਾ, ਜਿਸ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਸੀ ਕਿ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਨੂੰ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਦੇ ਲੰਡਨ ਦੇ ਵਕੀਲਾਂ ਦੁਆਰਾ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਜਰਮਨ Case: BARENDRA PRASAD RAY & ORS. versus THE INCOME-TAX OFFICER 'A' WARD FOREIGN SECTION AND ORS. [[1981] 3 S.C.R. 387] (1981) ਕਾਰਪੋਰੇਸ਼ਨ ਦੀ ਤਰਫੋਂ ਪੇਸ਼ ਹੋਣ ਲਈ ਨਿਯੁਕਤ ਕੀਤਾ ਗਿਆ ਸੀ ਅਤੇ ਉਨ੍ਹਾਂ ਨੇ ਨਾ ਤਾਂ ਉਸ ਨੂੰ ਬ੍ਰੀਫ ਦਿੱਤਾ ਸੀ ਅਤੇ ਨਾ ਹੀ ਉਸ ਨੂੰ ਕੋਈ ਫੀਸ ਦੇਣ ਦਾ ਕੋਈ ਵਾਅਦਾ ਕੀਤਾ ਸੀ। ਇਸ ਲਈ, ਉਨ੍ਹਾਂ ਨੇ ਧਾਰਾ 199(2) ਦੇ ਤਹਿਤ ਆਪਣੀ ਜ਼ਿੰਮੇਵਾਰੀ ਤੋਂ ਇਨਕਾਰ ਕਰ ਦਿੱਤਾ। ਗੌਲਫ ਇਹ ਵੀ ਕਿਹਾ ਜਾ ਸਕਦਾ ਹੈ ਕਿ ਮੁਲਜ਼ਮਾਂ ਨੇ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦੇ ਰਿਕਾਰਡ 'ਤੇ ਇੱਕ ਹੋਰ ਮੁਕੱਦਮਾ, ਮੁਕੱਦਮਾ ਨੰਬਰ 422 ਦੀ 1963, ਜਿਸ ਵਿੱਚ ਅਲਬਰਟ ਡੇਵਿਡ ਲਿਮਟਿਡ ਵਿਰੁੱਧ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਦੁਆਰਾ ਦਾਇਰ ਕੀਤਾ ਗਿਆ ਸੀ, ਜਿਸ ਵਿੱਚ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਨੂੰ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਦੁਆਰਾ ਨਿਯੁਕਤ ਕੀਤਾ ਗਿਆ ਸੀ। ਇਸ ਦੇ ਜਵਾਬ ਵਿੱਚ, ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀ ਨੇ 27 ਫਰਵਰੀ 1970 ਨੂੰ ਇੱਕ ਪੱਤਰ ਰਾਹੀਂ ਮੁਲਜ਼ਮਾਂ ਨੂੰ ਸੂਚਿਤ ਕੀਤਾ ਕਿ ਉਹ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਖਿਲਾਫ਼ ਉਸ ਅਧਾਰ 'ਤੇ ਕਾਰਵਾਈ ਕਰਨ ਦੀ ਪ੍ਰਸਤਾਵ ਦੇ ਰਹੇ ਸਨ ਕਿ ਸੰਪੱਤੀ ਨਾਲ ਸਬੰਧਤ ਧਾਰਾ 163(1) ਦੇ ਤਹਿਤ ਆਮਦਨ ਮੁਲਜ਼ਮਾਂ ਅਤੇ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਵਿਚਕਾਰ ਕਾਰੋਬਾਰਕ ਸਬੰਧਾਂ ਕਾਰਨ ਪੈਦਾ ਹੋਈ ਸੀ। ਇਸ ਦੇ ਜਵਾਬ ਵਿੱਚ, ਮੁਲਜ਼ਮਾਂ ਨੇ 10/11 ਮਾਰਚ 1970 ਨੂੰ ਇੱਕ ਲੰਬਾ ਜਵਾਬ ਭੇਜਿਆ, ਜਿਸ ਵਿੱਚ ਉਨ੍ਹਾਂ ਨੇ ਧਾਰਾ 163(1) ਦੇ ਤਹਿਤ ਕਾਰਵਾਈ ਕਰਨ ਲਈ ਆਪਣੀ ਜ਼ਿੰਮੇਵਾਰੀ ਤੋਂ ਇਨਕਾਰ ਕਰ ਦਿੱਤਾ। ਜਵਾਬ ਦੇ ਦੌਰਾਨ, ਮੁਲਜ਼ਮਾਂ ਨੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਉਨ੍ਹਾਂ ਨੇ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦੇ ਰਿਕਾਰਡ 'ਤੇ ਤਿੰਨ ਮੁਕੱਦਮਿਆਂ ਵਿੱਚ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਨੂੰ ਨਾ ਤਾਂ ਨਿਯੁਕਤ ਕੀਤਾ ਸੀ ਅਤੇ ਨਾ ਹੀ ਉਸ ਨੂੰ ਕੋਈ ਫੀਸ ਦਿੱਤੀ ਸੀ ਅਤੇ ਇਸ ਲਈ, ਉਨ੍ਹਾਂ ਅਤੇ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਵਿਚਕਾਰ ਕੋਈ ਵਪਾਰਕ ਸਬੰਧ ਨਹੀਂ ਸੀ। ਮੁਲਜ਼ਮਾਂ ਨੇ ਅੱਗੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਜਿਵੇਂ ਕਿ ਮਿਸਟਰ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਇੱਕ ਇੱਕ ਵਕੀਲ ਜੋ ਕਿਸੇ ਵਪਾਰ ਨੂੰ ਚਲਾ ਨਹੀਂ ਰਿਹਾ ਸੀ ਬਲਕਿ ਕੇਵਲ ਕਲਕੱਤਾ ਵਿੱਚ ਪੇਸ਼ੇਵਰ ਸੇਵਾ ਪ੍ਰਦਾਨ ਕਰ ਰਿਹਾ ਸੀ, ਜੇ ਕੋਈ ਸਬੰਧ ਸੀ, ਤਾਂ ਇਹ ਵਪਾਰਕ ਸਬੰਧ ਨਹੀਂ ਹੋ ਸਕਦਾ। ਉਨ੍ਹਾਂ ਨੇ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਦੀ ਉਨ੍ਹਾਂ ਨੂੰ ਨੁਮਾਇੰਦਾ ਮੁਲਾਂਕਣਕਰਤਾ ਵਜੋਂ ਕੋਈ ਵੀ ਮੁਲਾਂਕਣ ਕਰਨ ਦੇ ਅਧਿਕਾਰ ਖੇਤਰ 'ਤੇ ਵੀ ਸਵਾਲ ਉਠਾਏ। ਬਲਾਕਵਾਈਜ਼ ਲਿਖਣਾ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ 25 ਮਾਰਚ, 1979 ਨੂੰ ਆਪਣੇ ਪੱਤਰ ਦੁਆਰਾ ਅਪੀਲਾਂਟਾਂ ਦੀ ਦਲੀਲ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ ਅਤੇ ਉਨ੍ਹਾਂ ਨੂੰ 18 ਅਪ੍ਰੈਲ, 1970 ਨੂੰ ਉਨ੍ਹਾਂ ਦੇ ਸਾਹਮਣੇ ਪੇਸ਼ ਹੋਣ ਲਈ ਕਿਹਾ ਤਾਂ ਜੋ ਉਹ ਕੋਈ ਹੋਰ ਪੇਸ਼ ਕਰ ਸਕਣ। ਇਸ ਤੋਂ ਬਾਅਦ ਅਪੀਲਾਂਟਾਂ ਨੇ ਕਲਕੱਤਾ ਦੀ ਉੱਚ ਅਦਾਲਤ ਦੇ ਸਾਹਮਣੇ ਸੰਵਿਧਾਨ ਦੇ ਅਨੁਚੇਦ 226 ਤਹਿਤ ਇੱਕ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਅਤੇ 25 ਮਈ, 1979 ਨੂੰ ਇੱਕ ਨਿਯਮ ਪ੍ਰਾਪਤ ਕੀਤਾ ਜਿਸ ਵਿੱਚ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, ਪੱਛਮੀ ਬੰਗਾਲ ਦੇ ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ ਅਤੇ ਭਾਰਤ ਸਰਕਾਰ ਨੂੰ ਇਸ ਗੱਲ ਦਾ ਕਾਰਨ ਦੱਸਣ ਲਈ ਕਿਹਾ ਗਿਆ ਸੀ ਕਿ ਐਕਟ ਦੇ ਤਹਿਤ ਕਾਰਵਾਈ ਸ਼ੁਰੂ ਕਰਨ ਦੀ ਪ੍ਰਸਤਾਵਿਤ ਕਾਰਵਾਈ ਨੂੰ ਰੱਦ ਨਹੀਂ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਅਤੇ ਐਕਟ ਦੀ ਧਾਰਾ 163(1) ਤਹਿਤ ਅਪੀਲਾਂਟਾਂ ਦੇ ਵਿਰੁੱਧ ਕਾਰਵਾਈ ਕਰਨ ਤੋਂ ਰੋਕਣ ਲਈ ਇੱਕ ਹੁਕਮਨਾਮਾ ਜਾਰੀ ਨਹੀਂ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ। ਪਟੀਸ਼ਨ ਦਾ ਜਵਾਬ ਉਤਰਦਾਤਾਵਾਂ ਦੁਆਰਾ ਦਿੱਤਾ ਗਿਆ ਸੀ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਦੁਆਰਾ ਦਾਇਰ ਕੀਤੇ ਗਏ ਜਵਾਬ ਦੇ ਹਲਫਨਾਮੇ ਵਿੱਚ, ਇਹ ਦਾਅਵਾ ਕੀਤਾ ਗਿਆ ਸੀ ਕਿ ਵਿਭਾਗ ਨੂੰ ਇਹ ਜਾਣਕਾਰੀ ਮਿਲੀ ਸੀ ਕਿ ਸ੍ਰੀ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਨੇ ਉਪਰੋਕਤ ਮੁਕੱਦਮਿਆਂ ਵਿੱਚ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਪੇਸ਼ ਹੋਣ ਲਈ ਫੀਸ ਦੇ ਤੌਰ 'ਤੇ ਰੁਪਏ। 17,000/- ਪ੍ਰਤੀ ਦਿਨ ਚਾਰਜ ਕੀਤੇ ਸਨ; ਕਿ ਸ੍ਰੀ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਭਾਰਤ ਵਿੱਚ ਨਿਵਾਸ ਨਹੀਂ ਸੀ; ਕਿ ਜਿੱਥੋਂ ਤੱਕ ਉਸਦੇ ਭਾਰਤ ਵਿੱਚ ਰਹਿਣ ਦਾ ਸਮਾਂ ਨੱਬੇ ਦਿਨਾਂ ਤੋਂ ਵੱਧ ਨਹੀਂ ਸੀ, ਇਸ ਲਈ ਭਾਰਤ ਛੱਡਣ ਲਈ ਟੈਕਸ ਛੋਟ ਪ੍ਰਮਾਣ ਪੱਤਰ ਪ੍ਰਾਪਤ ਕਰਨਾ ਜ਼ਰੂਰੀ ਨਹੀਂ ਸੀ; ਕਿ ਅਪੀਲਾਂਟਾਂ ਨੇ ਜਰਮਨ ਨਿਗਮ ਦੇ ਉਨ੍ਹਾਂ ਤਿੰਨ ਮੁਕੱਦਮਿਆਂ ਵਿੱਚ ਨਿਰਦੇਸ਼ਕ ਵਕੀਲ ਵਜੋਂ ਕੰਮ ਕੀਤਾ ਸੀ ਜਿਸ ਵਿੱਚ ਸ੍ਰੀ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਨੇ ਵਕੀਲ ਵਜੋਂ ਦਲੀਲ ਪੇਸ਼ ਕੀਤੀ ਸੀ; ਕਿ ਉਹ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ (ਮੂਲ ਪਾਸੇ) ਦੇ ਨਿਯਮਾਂ ਅਨੁਸਾਰ ਉਸ ਅਦਾਲਤ ਦੇ ਸਾਹਮਣੇ ਪੇਸ਼ ਨਹੀਂ ਹੋ ਸਕਦਾ ਸੀ ਜੇ ਉਹ ਉਸ ਅਦਾਲਤ ਦੇ ਇੱਕ ਵਕੀਲ ਦੁਆਰਾ ਨਿਰਦੇਸ਼ਤ ਨਾ ਕੀਤਾ ਗਿਆ ਹੋਵੇ, ਜੋ ਕਿ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਅਪੀਲਾਂਟ ਸਨ; ਅਤੇ ਇਸ ਤੋਂ ਬਾਅਦ, ਐਕਟ ਦੀ ਧਾਰਾ 163(1) ਦੇ ਦਾਇਰੇ ਵਿੱਚ ਆਉਣ ਵਾਲਾ ਇੱਕ ਵਪਾਰਕ ਸਬੰਧ ਮੌਜੂਦ ਸੀ। ਜਵਾਬਦਾਹਾਂ ਨੇ ਇਹ ਵੀ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਪਟੀਸ਼ਨ ਸਮਾਂ ਤੋਂ ਪਹਿਲਾਂ ਸੀ ਕਿਉਂਕਿ ਮਾਮਲੇ ਨੂੰ ਐਕਟ ਦੁਆਰਾ ਨਿਰਧਾਰਤ ਪ੍ਰਕਿਰਿਆ ਅਨੁਸਾਰ ਹੀ ਫੈਸਲਾ ਕੀਤਾ ਜਾਣਾ Case: BARENDRA PRASAD RAY & ORS. versus THE INCOME-TAX OFFICER 'A' WARD FOREIGN SECTION AND ORS. [[1981] 3 S.C.R. 387] (1981) ਬਾਕੀ ਸੀ। ਪਟੀਸ਼ਨ ਸੁਣਨ ਵਾਲੇ ਇਕਲੌਤੇ ਜੱਜ ਦਾ ਮੰਨਣਾ ਸੀ ਕਿ ਕੀ ਮਾਮਲਾ ਧਾਰਾ 163(1) ਦੇ ਦਾਇਰੇ ਵਿੱਚ ਆਉਂਦਾ ਹੈ ਜਾਂ ਨਹੀਂ, ਇਸ ਗੱਲ ਨੂੰ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਦੁਆਰਾ ਤੱਥਾਂ ਦੀ ਪੁਸ਼ਟੀ ਤੋਂ ਬਾਅਦ ਨਿਰਧਾਰਿਤ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਇਸ ਤੋਂ ਬਾਅਦ, ਪਟੀਸ਼ਨ ਇਸ ਅਧਾਰ 'ਤੇ ਰੱਦ ਹੋਣ ਲਈ ਜ਼ਿੰਮੇਵਾਰ ਸੀ ਕਿ ਇਹ ਸਮਾਂ ਤੋਂ ਪਹਿਲਾਂ ਸੀ। ਇਸ ਅਨੁਸਾਰ, ਉਸਨੇ ਇਸਨੂੰ ਕੇਸ ਦੇ ਮੱਦੇਨਜ਼ਰ ਕੋਈ ਰਾਏ ਪ੍ਰਗਟ ਕੀਤੇ ਬਿਨਾਂ ਰੱਦ ਕਰ ਦਿੱਤਾ। ਇਕਲੌਤੇ ਜੱਜ ਦੇ ਫੈਸਲੇ ਦੇ ਖਿਲਾਫ ਅਪੀਲਾਂਟਾਂ ਨੇ ਕਲਕੱਤਾ ਹਾਈ ਕੋਰਟ ਦੀ ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਦੇ ਸਾਹਮਣੇ ਇੱਕ ਅਪੀਲ ਪਾਈ। ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਨੇ ਅਪੀਲ ਰੱਦ ਕਰ ਦਿੱਤੀ, ਇਹ ਫੈਸਲਾ ਸੁਣਾਉਂਦੇ ਹੋਏ ਕਿ ਉਪਰੋਕਤ, ਕਿ ਅਦਾਲਤ ਦੇ ਸਾਹਮਣੇ ਦੱਸੇ ਗਏ ਤੱਥਾਂ ਤੋਂ ਇਹ ਸਪੱਸ਼ਟ ਹੁੰਦਾ ਹੈ ਕਿ 31 ਮਈ, 1965 ਤੋਂ ਲੈ ਕੇ 16 ਫਰਵਰੀ, 1970 ਤੱਕ ਸਿੱਧੇ ਅਤੇ ਅਸਿੱਧੇ ਤੌਰ 'ਤੇ ਪੱਤਰ ਵਿਹਾਰ ਰਾਹੀਂ ਅਪੀਲਾਂਟਾਂ (ਗੈਰ-ਨਿਵਾਸੀ ਬ੍ਰਿਟਿਸ਼ ਵਕੀਲ, ਸ਼੍ਰੀ ਬਲਾਂਕੋ ਵਾਈਟ ਦੀ ਫਰਮ) ਵਿਚਕਾਰ ਕਾਰੋਬਾਰਕ ਸਬੰਧ ਸੀ, ਇਸ ਲਈ ਇਹ ਨਹੀਂ ਕਿਹਾ ਜਾ ਸਕਦਾ ਕਿ ਕੋਈ ਵੀ ਸੰਤੁਲਨ ਦਾ ਤੱਤ ਨਹੀਂ ਸੀ ਅਤੇ ਇਹ ਲੈਣ-ਦੇਣ ਇੱਕ ਸੋਲੀਟਰੀ ਅਤੇ ਇਕੱਲੀ ਗੱਲ ਸੀ ਅਤੇ ਆਸ-ਪਾਸ ਦੇ ਹਾਲਾਤਾਂ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਰੱਖਦਿਆਂ ਅਤੇ ਖਾਸ ਕਰਕੇ ਵਕੀਲਾਂ ਅਤੇ ਇੱਕ ਵਕੀਲ ਵਿਚਕਾਰ ਸਬੰਧਾਂ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਰੱਖਦਿਆਂ, ਅਪੀਲਾਂਟਾਂ ਦੀ ਫਰਮ ਅਤੇ ਗੈਰ-ਨਿਵਾਸੀ ਬ੍ਰਿਟਿਸ਼ ਵਕੀਲ, ਸ਼੍ਰੀ ਬਲਾਂਕੋ ਵਾਈਟ ਵਿਚਕਾਰ ਇੱਕ ਏਜੰਸੀ ਬਣਾਈ ਜਾ ਸਕਦੀ ਹੈ। ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਨੇ ਇਸ ਗੱਲ 'ਤੇ ਵੀ ਜ਼ੋਰ ਦਿੱਤਾ ਕਿ ਉਨ੍ਹਾਂ ਵਿਚਕਾਰ ਕਾਰੋਬਾਰਕ ਸਬੰਧ ਸੀ ਅਤੇ ਇਹ ਸਵੀਕਾਰ ਕਰਨਾ ਸੰਭਵ ਨਹੀਂ ਸੀ ਕਿ ਕੋਈ ਵੀ ਆਮਦਨ ਸ਼੍ਰੀ ਬਲਾਂਕੋ ਵਾਈਟ ਨੂੰ ਭਾਰਤ ਵਿੱਚ ਪੈਦਾ ਨਹੀਂ ਹੋਈ ਸੀ। ਇਸ ਤਰ੍ਹਾਂ ਅਪੀਲ ਖਾਰਜ ਕਰ ਦਿੱਤੀ ਗਈ ਸੀ। ਸੰਵਿਧਾਨ ਦੇ ਆਰਟੀਕਲ 133 ਤਹਿਤ ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਦੁਆਰਾ ਦਿੱਤੀ ਗਈ ਪ੍ਰਮਾਣ ਪੱਤਰ 'ਤੇ, ਅਪੀਲਾਂਟ ਹਾਈ ਕੋਰਟ ਦੇ ਡਿਵੀਜ਼ਨ ਬੈਂਚ ਦੇ ਫੈਸਲੇ ਦੇ ਵਿਰੁੱਧ ਇਸ ਅਦਾਲਤ ਵਿੱਚ ਅਪੀਲ ਕਰਦੇ ਹਨ। ਇਥੇ ਇਹ ਕਿਹਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿ ਸੰਵਿਧਾਨ ਦੇ ਆਰਟੀਕਲ 133 ਤਹਿਤ ਪ੍ਰਮਾਣ ਪੱਤਰ ਲਈ ਪਟੀਸ਼ਨ ਦੇ ਨਾਲ, ਅਪੀਲਾਂਟਾਂ ਨੇ ਵਿਭਾਗ ਦੇ ਸਾਹਮਣੇ ਹੋਰ ਕਾਰਵਾਈਆਂ ਨੂੰ ਮੁਅੱਤਲ ਕਰਨ ਲਈ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਇੱਕ ਅਰਜ਼ੀ ਪਾਈ। ਉਸ ਅਰਜ਼ੀ 'ਤੇ, ਹਾਈ ਕੋਰਟ ਨੇ 12 ਮਾਰਚ, 1973 ਨੂੰ ਇੱਕ ਹੁਕਮ ਪਾਸ ਕੀਤਾ, ਜਿਸ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਸੀ ਕਿ ਪਹਿਲਾਂ ਹੀ ਦਿੱਤੇ ਗਏ ਰੋਕ ਦੇ ਹੁਕਮ ਨੂੰ ਹੇਠ ਲਿਖੇ ਸੋਧ ਦੇ ਅਧੀਨ ਰੱਖਿਆ ਜਾਵੇਗਾ: (1) ਜਵਾਬਦੇਹਾਂ ਨੂੰ ਪੈਟੀਸ਼ਨਰਾਂ ਨੂੰ ਸੁਣਵਾਈ ਦੇਣ ਦੇ ਬਾਅਦ ਇਹ ਅਧਿਕਾਰ ਹੋਵੇਗਾ ਕਿ ਕੀ ਪੈਟੀਸ਼ਨਰਾਂ ਦੀ ਫਰਮ ਨੂੰ ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੀ ਧਾਰਾ 163 ਤਹਿਤ ਸ਼੍ਰੀ ਬਲਾਂਕੋ ਵਾਈਟ ਦੇ ਏਜੰਟ ਵਜੋਂ ਸਮਝਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ; (2) ਜੇ ਉਹ ਇਸ ਤਰ੍ਹਾਂ ਫੈਸਲਾ ਕਰਦੇ ਹਨ, ਤਾਂ ਜਵਾਬਦੇਹਾਂ ਨੂੰ ਐਕਟ ਦੀ ਧਾਰਾ 148 ਤਹਿਤ ਨੋਟਿਸ ਜਾਰੀ ਕਰਨ ਦੀ ਆਗਿਆ ਹੋਵੇਗੀ, ਪਰ ਉਸ ਤੋਂ ਬਾਅਦ ਕੋਈ ਵੀ ਹੋਰ ਕਦਮ ਨਹੀਂ ਚੁੱਕਣਗੇ, ਜਦ ਤੱਕ ਕਿ ਅਰਜ਼ੀ ਦਾ ਨਿਪਟਾਰਾ ਨਹੀਂ ਹੋ ਜਾਂਦਾ; (3) ਪੈਟੀਸ਼ਨਰਾਂ ਨੂੰ ਵੀ ਧਾਰਾ 163 ਤਹਿਤ ਕੀਤੇ ਗਏ ਕਿਸੇ ਵੀ ਹੁਕਮ 'ਤੇ ਬਿਨਾਂ ਕਿਸੇ ਪੂਰਵਗ੍ਰਹਿ ਦੇ ਅਪੀਲ ਕਰਨ ਦੀ ਆਗਿਆ ਹੋਵੇਗੀ। ਸੁਪਰੀਮ ਕੋਰਟ ਵਿੱਚ ਪ੍ਰਸਤਾਵਿਤ ਅਪੀਲ ਵਿੱਚ ਉਨ੍ਹਾਂ ਦੇ ਦਾਅਵਿਆਂ ਨੂੰ ਪ੍ਰਭਾਵਿਤ ਕੀਤੇ ਬਿਨਾਂ; ਸਾਨੂੰ ਸੂਚਿਤ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਉਕਤ ਹੁਕਮ ਦੁਆਰਾ ਦਿੱਤੀ ਗਈ ਆਜ਼ਾਦੀ ਦੇ ਅਨੁਸਾਰ, ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ 23 ਮਾਰਚ, 1977 ਨੂੰ ਐਕਟ ਦੀ ਧਾਰਾ 163(1) ਤਹਿਤ ਸ਼੍ਰੀ ਬਲਾਂਕੋ ਵਾਈਟ ਦੇ ਏਜੰਟ ਵਜੋਂ ਅਪੀਲਾਂਟਾਂ ਦੀ ਫਰਮ ਨੂੰ ਸੰਭਾਲਣ ਵਾਲਾ ਇੱਕ ਹੁਕਮ ਦਿੱਤਾ ਅਤੇ ਉਸੇ ਦਿਨ ਨੋਟਿਸ ਵੀ ਜਾਰੀ ਕੀਤੀ। ਐਕਟ ਦੀ ਧਾਰਾ 148 ਤਹਿਤ ਅਪੀਲਾਂਟਾਂ ਨੂੰ ਸ੍ਰੀ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਦੀ ਆਮਦਨ ਦਾ ਰਿਟਰਨ ਦਾਖਲ ਕਰਨ ਲਈ। ਇਹ ਵੀ ਦੱਸਿਆ ਗਿਆ ਹੈ ਕਿ ਅਪੀਲਾਂਟਾਂ ਨੇ ਉਸ ਹੁਕਮ ਦੇ ਵਿਰੁੱਧ ਅਪੀਲੇਟ ਅਸਿਸਟੈਂਟ ਕਮਿਸ਼ਨਰ ਦੇ ਸਾਹਮਣੇ ਅਪੀਲ ਪਾਈ ਬਿਨਾਂ ਇਸ ਅਦਾਲਤ ਵਿੱਚ ਅਪੀਲਾਂਟਾਂ ਦੇ ਦਲੀਲਾਂ ਨੂੰ ਨੁਕਸਾਨ ਪਹੁੰਚਾਏ ਬਿਨਾਂ। ਅੰਤ ਵਿੱਚ 30 ਨਵੰਬਰ, 1973 ਨੂੰ ਇਸ ਅਦਾਲਤ ਨੇ ਇੱਕ ਹੁਕਮ ਪਾਸ ਕੀਤਾ ਕਿ ਅਪੀਲਾਂਟ ਅਪੀਲੇਟ ਅਸਿਸਟੈਂਟ ਕਮਿਸ਼ਨਰ ਕੋਲ ਰੋਕ ਦੇ ਹੁਕਮ ਲਈ ਅਰਜ਼ੀ ਦੇ ਸਕਦੇ ਹਨ ਇਸ ਸਵਾਲ ਬਾਰੇ ਕਿ ਕੀ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਇਸ ਨਾਲ ਜਾਂਦੇ ਹਨ ਜਾਂ ਨਹੀਂ, ਭਾਵੇਂ ਮੁਲਾਂਕਣ ਇਕਾਈ ਅਪੀਲ ਦੇ ਨਿਪਟਾਰੇ ਤੱਕ ਕੋਈ ਅੰਤਿਮ ਮੰਗ ਨਹੀਂ ਕਰਦੀ। ਇਸ ਗੱਲ ਦਾ ਵੀ ਉਲਲੇਖ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਐਕਟ ਦੀ ਧਾਰਾ 148 ਤਹਿਤ ਨੋਟਿਸ ਦੇ ਬਾਅਦ, ਅਪੀਲਾਂਟਾਂ ਨੇ 'ਨਿਲ' ਰਿਟਰਨ ਦਾਖਲ ਕੀਤਾ। ਇਸ ਤੋਂ ਬਾਅਦ ਸਾਨੂੰ ਸੂਚਿਤ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ 17 ਸਤੰਬਰ, 1977 ਨੂੰ ਅਪੀਲਾਂਟਾਂ ਨੂੰ ਸੂਚਿਤ ਕੀਤਾ ਕਿ ਉਸਨੇ ਮੁਲਾਂਕਣ ਸਾਲ 1970-71 ਲਈ ਸ੍ਰੀ ਬਲਾਂਕੋ ਵ੍ਹਾਈਟ ਦਾ ਮੁਲਾਂਕਣ ਪੂਰਾ ਕਰ ਲਿਆ ਹੈ, ਅਪੀਲਾਂਟਾਂ ਦੀ ਫਰਮ ਨੂੰ ਏਜੰਟ ਵਜੋਂ ਸਮਝਦੇ ਹੋਏ ਅਤੇ ਕਿ ਮੁਲਾਂਕਣ ਹੁਕਮ, ਮੰਗ ਨੋਟਿਸ ਅਤੇ ਚਾਲਾਨ ਦੀਆਂ ਕਾਪੀਆਂ ਇਸ ਅਪੀਲ ਦੇ ਨਿਪਟਾਰੇ ਤੋਂ ਬਾਅਦ ਉਹਨਾਂ ਨੂੰ ਭੇਜੀਆਂ ਜਾਣਗੀਆਂ। ਇਸ ਪੜਾਅ 'ਤੇ ਕੇਸ ਦੇ ਕੁਝ ਸੰਬੰਧਿਤ ਤੱਥਾਂ ਦਾ ਹਵਾਲਾ ਦੇਣਾ ਜ਼ਰੂਰੀ ਹੈ। ਅਪੀਲਕਰਤਾ ਉੱਪਰ ਦੱਸੇ ਗਏ ਮਾਮਲਿਆਂ ਵਿੱਚ ਭਾਰਤ ਵਿੱਚ ਜਰਮਨ ਕਾਰਪੋਰੇਸ਼ਨ ਅਤੇ ਲੰਡਨ ਦੇ ਸਾਲਿਸਟਰਾਂ ਵਜੋਂ ਕੰਮ ਕਰ ਰਹੇ ਸਨ। ਸਾਲੀਸਿਟਰ ਲੰਡਨ ਵਿੱਚ ਇਸਦੇ ਸਾਲਿਸਟਰਾਂ ਵਜੋਂ ਕੰਮ ਕਰ ਰਹੇ ਸਨ। ਮੁਕੱਦਮਾ ਨੰਬਰ 511 ਅਤੇ 124 1962 ਵਿੱਚ ਅਤੇ ਮੁਕੱਦਮਾ ਨੰਬਰ 422 1963 ਵਿੱਚ ਸ਼ੁਰੂ ਕੀਤਾ ਗਿਆ ਸੀ। 31 ਮਈ, 1965 ਨੂੰ, ਲੰਡਨ ਸਾਲਿਸਟਰਾਂ ਨੇ ਅਪੀਲਕਰਤਾਵਾਂ ਨੂੰ ਇੱਕ ਕੇਬਲ ਭੇਜਿਆ ਜੋ ਇਸ ਤਰ੍ਹਾਂ ਪੜ੍ਹਿਆ ਗਿਆ:- "ਡਿਗਨੀਓਰ ਕਲਕੱਤਾ Case: BARENDRA PRASAD RAY & ORS. versus THE INCOME-TAX OFFICER 'A' WARD FOREIGN SECTION AND ORS. [[1981] 3 S.C.R. 387] (1981) A B c D E F G H A B c D E G H pay or undertake any obligation to pay any fees for his services. The briefs had been earlier delivered by the London Solicitors. It is stated that they did not know as to how much amount was payable to him by the London Solicitors by way of fees. The hearing of one of the said two suits lasted for thirteen days commencing from January 27, 1970 and was concluded on February 16, 1970. Mr Blanco White left India on February 17, 197J after the hearing was over without making any arrangement regarding the payment of income tax on the fees earned by him by arguing the case of the German Corporation. Thereafter on February 19, 1970, the appellants received a notice from the Income-tax officer, 'A' Ward, Foreign Section asking them to furnish information about the fees earned in India by Mr. Blanco White as wunsel engaged by them to argue the case of their clients i.e. th~ German Corporation and also drawing their attention to the liability arising under section 195 (2) of the Income-tax Act. 1961 (hereinafter referred to as 'the Act') which required them to deducl the tax payable under the Act at source on payments made to a non-resident. The appellants sent a reply to that Jetter on February 24, I 970 stating that Mr. Blanco White had been engaged by the London Solicitors of the German Corporation to appear before the Calcutta High Courr on behalf of the German Corporation and that they had netither briefed him nor had they incurred any liability to pay him any fees. They, therefore, denied their liability under section 195(2) of the Act. Incidentally it may be stated here that the appellants referred to one other suit i.e. Suit No. 422 of 1963 on the file of the Calcutta High Court filed by the German Corporation against Albert David Ltd. in which also Mr. Blanco White had been engag~d for the German Corporation. Thereupon by a letter dated February 27,1970 the Income-Jax Officer informed the appellants that he proposed to proceed against t!-:em under section 163 (l) of the Act treating them as the agents of Mr. Blanco White on the ground that the income in question had arisen on account of the business connection that existed between the appellants and Mr. Blanco White. To this, the appellants sent a long reply dated March JO/ I I, 1970 denying their liability to be proceeded against under section 163 (I) of the Act. In the course of the said reply, the appellants contended inter alia that they had not either engaged or briefed Mr. Blanco White in the three suits on the file of the Calcutta High Court; that they had not paid or promised to pay any fees to him and that, therefore, no income had accrued to Mr. Blanco White on account of any business connection that existed between them and Mr. Blanco White.
