By this application, the applicant seeks to substitute respondent “ M/s. Shriram Builders” by M/s. “Shriram Builcons Ltd” on the ground that the liability of M/s. Shriram Builders, a partnership firm has been taken over by M/s. Shriram Builcons Ltd a company incorporated and registered under Companies Act. This position has not been disputed by Mr. Thakur, learned counsel for the respondent. Hence,t he application is allowed. The appellant is permitted to substitute M/s.
Shriram Builders by M/s. Shriram Builcons Ltd..
Mr. Thakur, learned counsel waives notice on
behalf of the respondent.
