Mr.P.R.Toprani for the respondents. ---- Coram : F.I.Rebello & R.S.Mohite,JJ Date : 13.3.2009. PC 1. This is a motion for condoning 503 days delay in filing of the appeal. A perusal of the affidavit-in-support indicates that the matter was sent to Counsel for preparing appeal memo on 21.2.2007 but the draft memo was received back 11 months later on 24.1.2008. Even thereater the appeal was filed after delay of further period of five months on 26.6.2008. In our opinion, the delay between the period 21.2.2007 and 24.1.2008 as well as between 25.2.2008 and 26.6.2008 has not been properly explained. The cause shown therefore, does not amount to sufficient cause. Hence, motion dismissed. Consequently, appeal papers to be filed. (R.S.Mohite,J) (F.I.Rebello,J)
