1)This interlocutory application under Section 5 of the Limitation Act has been filed by the petitioner for condonation of delay of 1738 days in preferring the instant application.
2) Having heard learned counsel and looking to the reasons stated in paragraphs 4, 5 and 6 of the interlocutory application, there are reasonable reasons for condonation of delay in preferring the instant application.
3) Accordingly, I.A. No. 2521 of 2012 is allowed and delay in filing the instant application is condoned.

1)Having heard both sides and looking to the facts and circumstances of the case, especially the reasons stated in paragraphs 3, 4 and 5, there are reasonable reasons for restoration of T.A. No.42 of 2007 which was dismissed for default on 11.10.2007.
2)Hence, this C.M.P. application allowed and T.A. No.42 of 2007 is restored to its original file and number.
3)Registry is directed to enlist T.A. No.42 of 2007 on 9th March,2015under the heading 'For Admission'.
