During the assessment years 1956-57 and 1957-58 the company also held shares in the Premier Sugar Mills and Distillery Co. Ltd., Mardan, West Pakistan. The Pakistan company also carried on the business of manufacturing and selling sugar. The assessee company earned dividend income of E Rs.2,30,832 and Rs.3,30,868 from the holdings in the respective previ-ous years relevant to the assessment years aforesaid, while it incnrred a business loss of Rs.20,30,006 and Rs.9, 11, 728 respectively from its busi· ness in India. The assessee claimed that the entire loss sustained by it in India in each year should be carried forward and set off against its business profits in India in future years in as much as the dividend F income derived by if from the Pakistan company was not liable to tax in , India by virtue of the Agreement for the Avoidance of Double Taxation between India and Pakistan. The Income Tax Officer rejected the said contention and determined the total loss in the relevant assessment years by making certain adjustments. The appeals before the Appellate As-sistant Commissioner and the Income Tax Appellate Tribunal failed.' G However, in the reference made at the instance of the assessee the Delhi High Court answered the questions relating to the Pakistan dividend in favour of the assessee and against the revenue. Allowing the appeals, the Court, " _> ~ • " ol I ' ' ~ HELD: 1.1 The dividend income received from the Pakistan com-pany is deductible in arriving at the total world loss of the assessee under sub-section (1) of section 24 of the Indian Income Tax Act, 1922. [160F-G I 1.2 Under sub-section (1) of section 24 of the Indian Income Tax Act, 1922 an assessee who has sustained a loss of profits or gains in any year under any of the heads mentioned in section 6 is entitled to have ·the amount of the loss set off against his income, profits or gains under any other head in that year. The income, profits or gains against which the loss is set off must he such income, profits or gains as is assessable under the Indian Income Tax Act. The statute does not contemplate a setting off of loss against income which is not assessable at all under the Act. [157A-C] 1.3 For the purposes of the assessment under the Indian Income Tax Act, the income of the assessee must he determined in the ordinary way under the Indian law. Having regard to the relevant entry 8 of the Schedule to the Agreement for the Avoidance of Double Taxation bet-ween the two Dominions of India and Pakistan, the Dominion of India is not entitled to charge the dividend income at all. Article IV of the Agreement makes it clear that each Dominion Is entitled to make assess-ments In the ordinary way under its own laws. Commissioner of Income Tax, Bombay City I, [1965] 55ITR699referred to. 1.4 The agreement for the Avoidance. of Double Taxation func-tions in a different plane altogether. It enjoys no role in the application of the Indian law for the purpose of determining the total income of an assessee and the tax liability consequent upon such assessment. On the contrary, the provisions of the Agreement clearly envisage that full effect must he given to the operation of the tax law of each Dominion. All that the Agreement does is to permit a Dominion to retain the tax recovered by it pursuant to an assessment under its law to the extent that an abatement is not allowed under the provisions of the Agreement. Article IV specifically provides that each Dominion shall make assess-ment in the ordinary way under its own laws. Such assessment includes the determination of the consequential tax liability. Thereafter, the Agreement takes over and the Dominion must allow an abatement in the degree mentioned in Article IV. Clause (b) of Article VI permits the A B c E G H [1986] 3 S.C.R. SUPREME COURT REPORTS A Dominion to make a demand without allowing the abatement if the tax payable on the total income in the other Dominion is not known, hut the collection of the tax has to be held in abeyance for a period of one year at least to the extent of the estimated abatement. If the assessee pro· duces the certificate of assessment in the other Dominion within the period of one year or any longer period allowed by the Income Tax Officer, the uncollected portion of the demand has to be adjusted against the abatement allowable under the Agreement. But if no such certificate is produced, the ubatement ceases to be operative and the outstanding demand can he collected forthwith. Clause (a) of Article VII makes absolutely clear that nothing in the Agreement can be con-sidered as modifying or incorporating in any manner the provisions of the relevant tax laws in force in either Dominion. Therefore, the Agree-ment cannot be construed as modifying or superseding in any manner the provisions of the Indian law in that regard. These appeals by certificate granted by the Delhi High Court are directed against a common judgment of that High Court disposmg of two income-tax references relating to the assessment years 1956-57 and 1957-58 on the question whether the assessee's di-vidend income from a Pakistan company was deductible against its business loss in India. I l The assessee is a public limited company carrying on the business of manufacturing and selling sugar. During the relevant period.jt also held some shares in the Premier Sugar Mills & Distillery Co. Ltd .. Mardan, West Pakistan. The Pakistan company also carried on the business of manufacturing and selling sugar. In the.previous year re-levant to the assessment year 1956-57 the assessee earned a dividend income of Rs.2,30,832 from its holdings in the Pakistan company. It sustained a loss of Rs.20,30,006 from the business in India. Likewise, in the previous year relevant to the assessment year 1957·58 the asses-see received a dividend income of Rs.3,30~81\X frnm the holdings in the Pakistan company, but sustained a loss of Rs.9,11,728 from the busi-ness in India. The assessee claimed that the entire loss sustained by it in India in each year should be carried forward and set off against its business profits in India in future years. It contended that the dividend income derived by it from the Pakistan company was not liable to tax in India as it was wholly taxed in Pakistan, and therefore, it could not be set off against the business loss in India. The Income-tax Officer rejected the contention and deducted the diyidend income received from the Pakistan company from the business loss in India disclosed by the assessee and after making certain other adjustments he determined the total loss of the assessee for the assessment year 1956-57 at Rs.16,51,129 and for the assessment year 1957-58 at Rs.3,78,661. ~· The assessee appealed to the Appellate Assistant Commissioner of Income-tax in respect of each assessment year, but the appeals failed, except that in the case for the assessment year 1957-58 the Appellate Assistant Commissioner determined the dividend income from the Pakistan company at Rs.2,27 ,472 and reduced the net loss accordingly. In second appeal the Income-tax Appellate Tribunal con-firmed the orders of the Appellate Assistant Commissioner. There-after, at the instance of the assessee the Appellate Tribunal referred the following questions in the two cases to the Delhi High Court for its opinion: A c D F "' G H A B c [1986] 3 S.C.R. 154 SUPREME COURT REPORTS "1. Whether on the facts and in the circumstances of the 1 case, the Tribunal was right in law in holding that the net dividend income of Rs.2,30,832 received from a Pakistan Company and the capital gains of Rs.5,120 were not de-ductible in arriving at the total world loss under section 24(1)? \ 2. Whether on the facts and in the circumstances of the case, the Tribunal was right in law in holding that the net dividend income of Rs.2,27,472 received from a Pakistan compaay and the capital gains of Rs.50,829 were not deductible in arriving at the total world loss under section 24(1)?" The High Court answered the questions relating to the Pakistan dividend in favour of the assessee and against the revenue. _.)., " D So far as the question in each case refers to the deduction of capital gains against the total world loss for the year, learned counsel for the parties jointly state that it is not subject matter of these appeals. [[1986] 3 S.C.R. 150] (1986) ਡਾ. ਵੀ. ਗੌਰੀ ਸ਼ੰਕਰ ਅਤੇ ਮਿਸ ਏ. ਸੁਭਾਸ਼ਿਨੀ ਅਪੀਲਕਰਤਾ ਲਈ। ਬਿਸ਼ੰਬਰ ਲਾਲ, ਆਰ.ਪੀ. ਗੁਪਤਾ, ਐਸ.ਕੇ. ਗੁਪਤਾ ਅਤੇ ਵੀ.ਕੇ. ਜੈਨ ਜਵਾਬਦੇਹ ਲਈ। ਅਦਾਲਤ ਦਾ ਫੈਸਲਾ ਦਿੱਤਾ ਗਿਆ ਸੀ ਪਾਠਕ, ਨਾਇਬ ਨਿਆਂਕਾ ਇਹ ਅਪੀਲਾਂ ਦਿੱਲੀ ਹਾਈ ਕੋਰਟ ਦੁਆਰਾ ਦਿੱਤੀ ਗਈ ਪ੍ਰਮਾਣ ਪੱਤਰ ਦੁਆਰਾ ਨਿਰਦੇਸ਼ਤ ਕੀਤੀਆਂ ਗਈਆਂ ਹਨ ਜੋ ਕਿ ਮੁਲਾਂਕਣ ਸਾਲ 1956-57 ਅਤੇ 1957-58 ਲਈ ਦੋ ਆਮਦਨ-ਕਰ ਹਵਾਲੇ ਨਾਲ ਸਬੰਧਤ ਇੱਕ ਸਾਂਝੀ ਫੈਸਲੇ ਦੇ ਖਿਲਾਫ ਹਨ, ਜਿਸ ਵਿੱਚ ਇਹ ਸਵਾਲ ਹੈ ਕਿ ਕਿ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਪਾਕਿਸਤਾਨ ਕੰਪਨੀ ਤੋਂ ਲਾਭਾਂਸ਼ ਦੀ ਆਮਦਨ ਭਾਰਤ ਵਿੱਚ ਕਾਰੋਬਾਰ ਦੇ ਨੁਕਸਾਨ ਦੇ ਵਿਰੁੱਧ ਕੱਟ ਦਿੱਤੀ ਜਾ ਸਕਦੀ ਹੈ ਜਾਂ ਨਹੀਂ। ਮੁਲਾਂਕਣਕਰਤਾ ਇੱਕ ਜਨਤਕ ਲਿਮਟਿਡ ਕੰਪਨੀ ਹੈ ਜੋ ਖੰਡ ਅਤੇ ਖੰਡ ਦੀ ਵਿਕਰੀ ਦਾ ਕਾਰੋਬਾਰ ਕਰਦੀ ਹੈ। ਸਬੰਧਤ ਮਿਆਦ ਦੌਰਾਨ ਇਸਨੇ ਪ੍ਰੀਮੀਅਰ ਸ਼ੂਗਰ ਮਿੱਲਾਂ ਅਤੇ ਡਿਸਟਿਲਰੀ ਕੰਪਨੀ ਲਿਮਟਿਡ, ਮਾਰਦਾਨ, ਪੱਛਮੀ ਪਾਕਿਸਤਾਨ ਵਿੱਚ ਕੁਝ ਸ਼ੇਅਰ ਵੀ ਰੱਖੇ। ਪਾਕਿਸਤਾਨ ਦੀ ਕੰਪਨੀ ਨੇ ਵੀ ਖੰਡ ਅਤੇ ਖੰਡ ਦੀ ਵਿਕਰੀ ਦਾ ਕਾਰੋਬਾਰ ਕੀਤਾ। ਮੁਲਾਂਕਣ ਸਾਲ 1956-57 ਲਈ ਸਬੰਧਤ ਪਿਛਲੇ ਸਾਲ ਵਿੱਚ ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਪਾਕਿਸਤਾਨ ਕੰਪਨੀ ਵਿੱਚ ਆਪਣੀਆਂ ਹੋਲਡਿੰਗਾਂ ਤੋਂ ਲਾਭਾਂਸ਼ ਦੀ ਆਮਦਨ ਦੀ ਰਾਸ਼ੀ ਰੁਪਏ 2,30,832 ਪ੍ਰਾਪਤ ਕੀਤੀ। ਇਸਨੇ ਭਾਰਤ ਵਿੱਚ ਕਾਰੋਬਾਰ ਤੋਂ ਰੁਪਏ 20,30,006 ਦਾ ਨੁਕਸਾਨ ਝੱਲਿਆ। ਇਸੇ ਤਰ੍ਹਾਂ, ਮੁਲਾਂਕਣ ਸਾਲ 1957-58 ਲਈ ਸਬੰਧਤ ਪਿਛਲੇ ਸਾਲ ਵਿੱਚ ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਪਾਕਿਸਤਾਨ ਕੰਪਨੀ ਵਿੱਚ ਆਪਣੀਆਂ ਹੋਲਡਿੰਗਾਂ ਤੋਂ ਲਾਭਾਂਸ਼ ਦੀ ਆਮਦਨ ਦੀ ਰਾਸ਼ੀ ਰੁਪਏ 3,30,868 ਪ੍ਰਾਪਤ ਕੀਤੀ, ਪਰ ਭਾਰਤ ਵਿੱਚ ਕਾਰੋਬਾਰ ਤੋਂ ਰੁਪਏ 9,11,728 ਦਾ ਨੁਕਸਾਨ ਝੱਲਿਆ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਦਾਅਵਾ ਕੀਤਾ ਕਿ ਹਰ ਸਾਲ ਵਿੱਚ ਭਾਰਤ ਵਿੱਚ ਉਸਦੇ ਦੁਆਰਾ ਝੱਲਿਆ ਗਿਆ ਪੂਰਾ ਨੁਕਸਾਨ ਅਗਲੇ ਸਾਲਾਂ ਵਿੱਚ ਭਾਰਤ ਵਿੱਚ ਕਾਰੋਬਾਰ ਦੇ ਲਾਭਾਂ ਦੇ ਵਿਰੁੱਧ ਅੱਗੇ ਵਧਾਇਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਉਸਦੇ ਵਿਰੁੱਧ ਸੈਟ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ। ਇਸਨੇ ਦਲੀਲ ਦਿੱਤੀ ਕਿ ਪਾਕਿਸਤਾਨ ਦੀ ਕੰਪਨੀ ਤੋਂ ਭਾਰਤ ਵਿੱਚ ਪ੍ਰਾਪਤ ਲਾਭਾਂਸ਼ ਦੀ ਆਮਦਨ ਭਾਰਤ ਵਿੱਚ ਟੈਕਸ ਲਈ ਜ਼ਿੰਮੇਵਾਰ ਨਹੀਂ ਹੈ ਕਿਉਂਕਿ ਇਹ ਪੂਰੀ ਤਰ੍ਹਾਂ ਪਾਕਿਸਤਾਨ ਵਿੱਚ ਟੈਕਸਡ ਹੈ, ਇਸਲਈ, ਇਸਨੂੰ ਭਾਰਤ ਵਿੱਚ ਕਾਰੋਬਾਰ ਦੇ ਨੁਕਸਾਨ ਦੇ ਵਿਰੁੱਧ ਸੈਟ ਨਹੀਂ ਕੀਤਾ ਜਾ ਸਕਦਾ। ਆਮਦਨ-ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਦਲੀਲ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ ਅਤੇ ਪਾਕਿਸਤਾਨ ਦੀ ਕੰਪਨੀ ਤੋਂ ਪ੍ਰਾਪਤ ਲਾਭਾਂਸ਼ ਦੀ ਆਮਦਨ ਨੂੰ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਦਰਸਾਏ ਗਏ ਕਾਰੋਬਾਰ ਦੇ ਨੁਕਸਾਨ ਤੋਂ ਕੱਟ ਦਿੱਤਾ ਅਤੇ ਕੁਝ ਹੋਰ ਸੋਧਾਂ ਕਰਨ ਤੋਂ ਬਾਅਦ ਮੁਲਾਂਕਣ ਸਾਲ 1956-57 ਲਈ ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਕੁੱਲ ਨੁਕਸਾਨ ਨੂੰ ਰੁਪਏ 16,51,129 ਅਤੇ ਮੁਲਾਂਕਣ ਸਾਲ 1957-58 ਲਈ ਰੁਪਏ 3,78,661 ਵਜੋਂ ਨਿਰਧਾਰਤ ਕੀਤਾ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਹਰੇਕ ਮੁਲਾਂਕਣ ਸਾਲ ਲਈ ਆਮਦਨ-ਕਰ ਦੇ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਕੋਲ ਅਪੀਲ ਕੀਤੀ, ਪਰ ਅਪੀਲਾਂ ਅਸਫਲ ਰਹੀਆਂ, ਸਿਰਫ ਇਹ ਕਿ ਮੁਲਾਂਕਣ ਸਾਲ 1957-58 ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੇ ਪਾਕਿਸਤਾਨ ਦੀ ਕੰਪਨੀ ਤੋਂ ਲਾਭਾਂਸ਼ ਦੀ ਆਮਦਨ ਨੂੰ ਰੁਪਏ 2,27,472 ਵਜੋਂ ਨਿਰਧਾਰਤ ਕੀਤਾ ਅਤੇ ਸ਼ੁੱਧ ਨੁਕਸਾਨ ਨੂੰ ਘਟਾ ਦਿੱਤਾ। ਦੂਜੀ ਅਪੀਲ ਵਿੱਚ ਆਮਦਨ-ਕਰ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਦੇ ਹੁਕਮਾਂ ਨੂੰ ਪੁਸ਼ਟੀ ਕੀਤੀ। ਇਸ ਤੋਂ ਬਾਅਦ, ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਕਹਿਣ 'ਤੇ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਦੋਵੇਂ ਕੇਸਾਂ ਵਿੱਚ ਹੇਠ ਲਿਖੇ ਸਵਾਲਾਂ ਨੂੰ ਦਿੱਲੀ ਹਾਈ ਕੋਰਟ ਨੂੰ ਆਪਣੀ ਰਾਇ ਲਈ ਭੇਜਿਆ 1. ਕੀ ਮਾਮਲੇ ਦੇ ਤੱਥਾਂ ਅਤੇ ਹਾਲਾਤਾਂ ਵਿੱਚ, ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਕਾਨੂੰਨ ਵਿੱਚ ਇਹ ਫੈਸਲਾ ਕਰਨ ਵਿੱਚ ਸਹੀ ਸੀ ਕਿ ਪਾਕਿਸਤਾਨ ਦੀ ਇੱਕ ਕੰਪਨੀ ਤੋਂ ਪ੍ਰਾਪਤ ਸ਼ੁੱਧ ਡਿਵੀਡੈਂਡ ਆਮਦਨ ਰੁ: 2,30,822 ਅਤੇ ਪੂੰਜੀ ਲਾਭ ਰੁ: 5,120 ਸੈਕਸ਼ਨ 24(2) ਤਹਿਤ ਕੁੱਲ ਵਿਸ਼ਵ ਨੁਕਸਾਨ ਨੂੰ ਪ੍ਰਾਪਤ ਕਰਨ ਵਿੱਚ ਕੱਟਣਯੋਗ ਨਹੀਂ ਸਨ? 2. ਕੀ ਮਾਮਲੇ ਦੇ ਤੱਥਾਂ ਅਤੇ ਹਾਲਾਤਾਂ ਵਿੱਚ, ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਕਾਨੂੰਨ ਵਿੱਚ ਇਹ ਫੈਸਲਾ ਕਰਨ ਵਿੱਚ ਸਹੀ ਸੀ ਕਿ ਪਾਕਿਸਤਾਨ ਦੀ ਇੱਕ ਕੰਪਨੀ ਤੋਂ ਪ੍ਰਾਪਤ ਸ਼ੁੱਧ ਡਿਵੀਡੈਂਡ ਆਮਦਨ ਰੁ: 2,27,472 ਅਤੇ ਪੂੰਜੀ ਲਾਭ ਰੁ: 5,829 ਸੈਕਸ਼ਨ 24(2) ਤਹਿਤ ਕੁੱਲ ਵਿਸ਼ਵ ਨੁਕਸਾਨ ਨੂੰ ਪ੍ਰਾਪਤ ਕਰਨ ਵਿੱਚ ਕੱਟਣਯੋਗ ਨਹੀਂ ਸਨ? ਉੱਚ ਅਦਾਲਤ ਨੇ ਪਾਕਿਸਤਾਨ ਦੇ ਡਿਵੀਡੈਂਡ ਨਾਲ ਸਬੰਧਤ ਸਵਾਲਾਂ ਨੂੰ ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਹੱਕ ਵਿੱਚ ਅਤੇ ਆਮਦਨ ਦੇ ਵਿਰੁੱਧ ਵਿੱਚ ਜਵਾਬ ਦਿੱਤਾ। ਹਰੇਕ ਮਾਮਲੇ ਵਿੱਚ ਸਵਾਲ ਜਿੰਨਾ ਚਿਰੇ ਕੁੱਲ ਵਿਸ਼ਵ ਨੁਕਸਾਨ ਦੇ ਵਿਰੁੱਧ ਪੂੰਜੀ ਲਾਭਾਂ ਦੀ ਕੱਟ ਦਾ ਹਵਾਲਾ ਦਿੰਦਾ ਹੈ, ਪਾਰਟੀਆਂ ਦੇ ਵਕੀਲਾਂ ਨੇ ਸਾਂਝੇ ਤੌਰ 'ਤੇ ਬਿਆਨ ਕੀਤਾ ਕਿ ਇਹ ਇਨ੍ਹਾਂ ਅਪੀਲਾਂ ਦਾ ਵਿਸ਼ਾ ਨਹੀਂ ਹੈ। "ਲੇਖ IV—ਹਰੇਕ ਡੋਮੀਨੀਅਨ ਆਪਣੇ ਆਪਣੇ ਕਾਨੂੰਨਾਂ ਤਹਿਤ ਆਮ ਤਰੀਕੇ ਨਾਲ ਮੁਲਾਂਕਣ ਕਰੇਗਾ; ਅਤੇ, ਜੇਕਰ ਕੋਈ ਵੀ ਡੋਮੀਨੀਅਨ ਆਪਣੇ ਕਾਨੂੰਨਾਂ ਦੀ ਕਾਰਵਾਈ ਨੂੰ ਇਸ ਸਮਝੌਤੇ ਦੀ ਸੂਚੀ (ਹੇਠਾਂ ਸੂਚੀ ਵਜੋਂ ਹਵਾਲਾ ਦਿੱਤਾ ਗਿਆ ਹੈ) ਦੇ ਕਾਲਮ 1 ਵਿੱਚ ਸਪੈਸਿਫਾਈ ਕੀਤੇ ਗਏ ਸਰੋਤਾਂ ਜਾਂ ਲੈਣ-ਦੇਣ ਦੀਆਂ ਸ਼੍ਰੇਣੀਆਂ ਤੋਂ ਆਈ ਆਮਦਨ ਨੂੰ ਕਾਲਮ 2 ਅਤੇ 3 ਵਿੱਚ ਨਿਰਧਾਰਤ ਪ੍ਰਤੀਸ਼ਤ ਅਨੁਸਾਰ ਗਿਣੇ ਗਏ ਰਕਮ ਤੋਂ ਵੱਧ ਚਾਰਜ ਕਰਦਾ ਹੈ, ਉਹ ਡੋਮੀਨੀਅਨ ਉਸ ਅਧਿਕ ਰਕਮ 'ਤੇ ਟੈਕਸ ਦੀ ਰਕਮ ਦੇ ਬਰਾਬਰ ਘਟਾਉ ਦੀ ਆਗਿਆ ਦੇਵੇਗਾ ਜਿਵੇਂ ਕਿ ਲੇਖ VI ਵਿੱਚ ਪ੍ਰਦਾਨ ਕੀਤਾ ਗਿਆ ਹੈ। ਲੇਖ V—ਜਿੱਥੇ ਕਿਸੇ ਵੀ ਆਮਦਨ ਦਾ ਉਦਭਵ ਜਾਂ ਉਤਪੰਨ ਹੋਣਾ ਦੋਵਾਂ ਦੇਸ਼ਾਂ ਦੇ ਸੀਮਾਵਾਂ ਤੋਂ ਬਾਹਰ ਹੈ, ਹਰੇਕ ਦੇਸ਼ ਇਸ ਤਰ੍ਹਾਂ ਦੀ ਦੋਹਰੀ ਟੈਕਸਡ ਆਮਦਨ 'ਤੇ ਟੈਕਸ ਦੀ ਘੱਟ ਰਕਮ ਦੇ ਅੱਧੇ ਬਰਾਬਰ ਦੀ ਛੋਟ ਦਿਵਾਏਗਾ। Case: COMMISSIONER OF INCOME-TAX, DELHI versus MAHALAXMI SUGAR MILLS CO. As the scope and effect of the Agreement is intimately involved in the resolu-tion of the controversy between the parties, the material provisions may be set forth immediately: ( -· r G "Article IV-Each Dominion shall make assessment in the ordinary way under its own laws; and, where either Domi-nion under the operation of its laws charges any income from the sources or categories of transaction specified in column I of the Schedule of this Agreement (hereinafter referred to as the Schedule) in excess of the amount cal-culated according to the percentage specified in columns 2 and 3 thereof, that Dominion shall allow an abatement equal to the lower amount of tax payable on such excess in their Dominion as provided for in Article VI. A Article V-Where any income accruing or arising without the territories of the Dominions is chargeable to tax in both the Dominions, each Dominion shall allow an abatement equal to one-half of the lower amount of tax payable in either Dominion on such doubly taxed income. Article VI-(a) For the purposes of .the abatement to be allowed under Article IV or V, the tax payable in each Dominion on the excess or the doubly taxed income, as the c case may be, shall be such proportion of the tax payable in each Dominion as the excess or the doubly taxed income bears to the total income of the assessee in each Dominion. (b) Where at the time of assessment in one Dominion, the tax payable on the total income in the other Dominion i& not known, the first Dominion shall make a demand with~ out allowing the abatement, but shall hold in abeyance for a period of one year (or such longer period as may be allowed by the Income-tax Officer in his descretion) the collection of a portion of the demand equal to the esti-mated abatement. If the assessee produces a certificate of assessment in the other Dominion within the period of one year or any longer period allowed by the Income-tax Officer, the uncollected portion of the demand will be ad-justed against the abatement allowable under this Agree-ment; if no such certificate is produced the abatement shall cease to be operative and the outstanding demand shall be collected forthwith. n E F Article VII-(a) Nothing in this Agreement shall be con-strued as modifying or interpreting in any manner the provisions of relevant taxation laws in force in either Dominion.
