By an order dated August 20, 1943, the Appellate Tribunal directed that certain deductions claimed by the assesses should be allowed. The matter came back to the Income-tax Officer and he made an order on September 26, 1945, but did nop issue any fresh notice of demand. The assesses appealed to the Appellate Assist-ant Commissioner complaining that in his order of September 26, tbe Income-tax Officer had wron~ly includeil a sum of Rs. 13,000 QQ 1952 as nnassessed foreign income of earlier years. The Trihunal referred certain questions and the High Court directed the Tribunal to - refer certain other qUestions also but when the references came on for hearing the High Court held that the references were incompetent. The Commissioner of Income-tax appealed to the Supreme Court with the leave of the High Court: Held, (i) that in carrying out the directions of the Tribunal and in passing the order of September 26, 1945, the Income-tax Officer cannot be regarded as having acted under s. 23 or s. 27 of the Act and no appeal lay from his order under s. 30 (1). The Judgment of the Court was delivered by 1962 Commissioner of Inoome-tax, _Madras DAS J.-These two consolidated appeals are diteci-Inoome-tax, ed against the judgment and order made on January _Madras 11, 1950, by the High Court of Judicature at Madras v. in References No. 80 of 1946 and No. 38 of 1948 Mtt. Ar. s. Ar. Arunaohalam under section 66 of the Indian Income-tax Act where-Ohettiar. by the High Court relying on its earlier decision in Commissioner of Income-tax, Madras v. R. Rm. M. Das J. Sm. Sevitgan alias Manickavasagam Chettiar(1) .held that the references were incompetent and accordingly refused to answer the questions raised therein. 'l'he facts are shortly as follows. • The respondent who is a Nattukotai Chettiar had his headquarters at Karaikudi in India and also carried on his money-lending business at branches at Maubin, Kualalumpur and Singapore. He also. had income from properties at Maubin and Singapore. For the assessment year ~941-42 the Income-tax Officer calculated the assessee's accrued foreign income as Rs. 29,403 at Maubin, Rs. 27,731 at Kuala-lumpur and Rs. 34,584 at Singapore, in all Hs. 91,718. After deducting out of this amount Rs. 4,500 allowed under the 3rd proviso to section 4 (1) of the Act, the Income-tax Officer computed the total assessable foreign income at Rs. 87,218. Out of the total remit-tances of Rs. 84,352 the Income-tax Officer allocated Rs. 7,900 to the accrued income of Maubin and· Rs. 62,.315 to those of Kualalumpur and Singapore and the balance of Rs. 14,137 to the taxed income of earlier years. 'rhe Income-tax Officer disallowed the claim of the assessee to deductions under several heads. On the basis of the total foreign income of Rs. 67 ,218 and income from other sources the Income-tax Officer calculated Rs. 23,266-8-0 to be due by the assessee on account of income-tax, super-tax and surcharges thereon and by his assessment order dated January 31, 1942, made this amount payable on or before February 25, 1942. ARUNACHALAM CHETTIAR [[1953] 1 S.C.R. 463] (1953) रुपये शामिल होने से व्यथित होना। 13,541, खाते के वर्ष के दौरान पिछले वर्षों की कथित अमूल्यांकित विदेशीआय भारत में प्रेषित होने के कारण निर्धारिती ने अपीलीय सहायक आयुक्त के समक्ष अपील दायर की। अपीलीयसहायक आयुक्त इस बात से संतुष्ट नहीं थे कि निर्धारिती के पास अपील का कोई अधिकार थाधारा30 अधिनियम के तहत कोई मूल्यांकन नहीं किया गया थाधारा 23 और इसके तहत निर्धारिती को मांग का कोईनोटिस नहीं दिया गया थाधारा 29 अधिनियम का. तदनुसार, अपीलीय सहायक आयुक्त ने 19 नवंबर, 1945 केअपने आदेश द्वारा अपील को स्वीकार करने से इनकार कर दिया। हालाँकि, उन्होंने विचार व्यक्त किया किनिर्धारिती का उपाय ट्रिब्यूनल में एक विविध आवेदन में निहित हो सकता है जिसमें शिकायत की गई हो किआयकर अधिकारी ने या तो गलत व्याख्या की थी या अपीलीय ट्रिब्यूनल के आदेश को प्रभावी नहीं किया था। इसके बाद निर्धारिती ने अपीलीय न्यायाधिकरण में एक विविध आवेदन लाया। अपीलीय न्यायाधिकरण ने मानाकि. आयकर अधिकारी का निष्कर्ष कि रुपये की राशि. 13,541 का मूल्यांकन किया जाना था क्योंकि लेखांकनवर्ष में भारत को भेजे गए पिछले वर्षों के कर रहित लाभ अपीलीय न्यायाधिकरण के आदेश को प्रभावी करने के दौरान उत्पन्न नहीं हुए थे और 20 फरवरी, 1946 के अपने आदेश द्वारा, उस निष्कर्ष को रद्द कर दिया औरआय का निर्देश दिया- कर अधिकारी तदनुसार गणना को संशोधित करें। अंतिम उल्लिखित आदेश 8 मार्च, 1946 को आयकर आयुक्त, मद्रास को दिया गया था, बाद में 1 मई, 1946को, अपीलीय न्यायाधिकरण के समक्ष एक आवेदन किया गया था।धारा 66(1)अधिनियम के -और प्रार्थना कीकि उनकी याचिका में उनके द्वारा तैयार किए गए तीन प्रश्नों को उच्च न्यायालय को भेजा जाना चाहिए। तर्क यहथा कि अपीलीय न्यायाधिकरण के पास कानून में उस पर विचार करने, विचार करने और आदेश पारित करने काकोई अधिकार क्षेत्र नहीं था, जो उसने विविध आवेदन पर यह देखते हुए किया कि यह न तो कोई अपील थी।धारा 33 इसे आयकर अधिनियम के तहत सुधार नहीं माना जा सकताधारा 35 बेंच द्वारा की गई किसी भी गलतीके लिए. अपीलीय न्यायाधिकरण ने यह विचार किया कि यद्यपि अधिनियम में कोई विशिष्ट प्रावधान नहीं कियागया था जिसके द्वारा वह अपने आदेश को प्रभावी कर सके या किसी भी पक्ष द्वारा दायर किसी भी विविध ',आवेदन में बाद के आदेश द्वारा ऐसे आदेश में किसी भी अस्पष्टता को स्पष्ट कर सके, फिर भी ऐसी शक्तिट्रिब्यूनल में अंतर्निहित था। ट्रिब्यूनल ने तदनुसार सोचा कि कानून का एक मुद्दा उठता है और 23 अगस्त,1946 को, निम्नलिखित प्रश्न को उच्च न्यायालय में भेजा गया, अर्थात्: - "क्या इस मामले के तथ्यों और परिस्थितियों में, विविध आवेदन में पीठ का 20 फरवरी, 1946 काआदेश एक उचित आदेश है और कानूनी रूप से वैध है और अधिकार क्षेत्र के भीतर पारित किया गया हैऔर आयकर अधिकारी पर बाध्यकारी है।"ट्रिब्यूनल ने आयुक्त द्वारा तैयार किए गए अन्य प्रश्नों को संदर्भित करने से इनकार कर दिया। इस संदर्भको 1946 के केस संदर्भित संख्या 80 के रूप में क्रमांकित किया गया। ऐसा प्रतीत होता है कि आयकरआयुक्त के आवेदन पर 30 मार्च 1948 को उच्च न्यायालय द्वारा दिए गए एक आदेश के अनुसारधारा66 अधिनियम के (2) ट्रिब्यूनल ने निम्नलिखित प्रश्न को उच्च न्यायालय को संदर्भित किया: - "यदिअपीलीय न्यायाधिकरण के दिनांक 23 अगस्त, 1946 के आदेश द्वारा पहले से ही उच्च न्यायालय कोसंदर्भित प्रश्न का उत्तर सकारात्मक है,, क्या, परिस्थितियों में और मामले के तथ्यों पर, 1942-43 केआरएए संख्या 53 (मद्रास) में अपीलीय न्यायाधिकरण के निर्णय के अनुसार आयकर अधिकारी द्वाराकी गई पुनर्गणना वैध और सही थी।" अपीलीय न्यायाधिकरण ने 19 जुलाई, 1948 को यह आगे संदर्भ दिया, जिसे 1948 के केस संदर्भित संख्या38 के रूप में गिना गया। दो संदर्भित मामले मद्रास उच्च न्यायालय की एक खंडपीठ के समक्ष विचार के लिए आए और यह माना गया किसंदर्भ के तहतधारा 66(1)ऊपर उल्लिखित उस न्यायालय के पहले के फैसले के मद्देनजर अक्षम था, जिसेउन्होंने उन पर बाध्यकारी महसूस किया और तदनुसार बेंच ने सवालों का जवाब देने से इनकार कर दिया। इसकेबाद आयकर आयुक्त ने दोनों संदर्भों में निर्णयों के खिलाफ इस न्यायालय में अपील करने के लिए आवेदन कियाऔर अनुमति प्राप्त की और किसी भी स्थिति में निर्धारिती की लागत का भुगतान करने के अपने वचन पर ऐसीछुट्टी प्राप्त की। इसके बाद दोनों अपीलें समेकित हो गईं और अंतिम निपटान के लिए हमारे सामने आईं। Case: COMMISSIONER OF INCOME-TAX; MADRAS versus MTT. Assistant Commissioner by his order dated May 25, Arunachalam 1942, allowed some of the several objections. but dis-QheUiar. allowed the items of replautation expenses and bad DasJ. debt .and reduced the assessment to Rs. 22,548. The assessee took a further appeal before the Appellate Tri-bunat against the disallowance of the several claims by the Appellate Assistant Commissioner including the two items mentioned above. 'fhe Appellabe Tribunal by its order dated August 20, 1943, held that the re-plantation expenses "will be allowed to th.e appellant as expenses." As regards the bad debt the Tribunal held that it was permissible and that "the deduction claimed will, therefore, be allowed." The result was that the appeal was partly allowed. The matter came back before the Income-tax Officer on September 26, 1945. Deducting Rs. 778 on account of replantatiim expenses the Kualalumpur income was reduced to Rs. 26,953 and after deducting Rs. 24,17 5 on account of the bad debt the Singapore income came down to Rs. 10,409. These two reduced amounts together with Rs. 29,403 being the income from Maubiu made up the total accrued income of Rs. 66,765. Out of this amount Rs. 4,500 was.deduct-ed on account of uuremitted profits of Maubin under the 3rd proviso to section 4(1) of the Act, leaving a balance of Rs. 62,265. Out of the remittances the Income-tax Officer allocated Rs. 7 ,000 towards the accrued income of Rs. 29,403 from Maubin and Rs. 37,362 against the total accrued income of Kuala-lumpur and Singapore. He also allocated Rs. 24,549 as remittances out of assessed.profits of previous years, leaving a balance of Rs. 13,541. This amount the Income-tax Officer considered as· remittances out of earlier years' unassessed income and held it to be assesEable to tax. He, however, did not issue any notice of demand urtder section 29 of the Act. . ommission,.,r .-. • . • . 01 Income-tax, Madi·a• Being aggrieved by the inclusion of Rs. 13,541 as the alleged unassessed foreign income of earlier years remitted to India during the year of account the asses-see preferred an appeal before the Appellate Assistant Commissioner. The Appellate Assistant Commis-sioner was not satisfied that the assessee had any right of appeal under section 30 of the Act for there ha.d been no assessment under section '23 and no notice of demand had been served on the assessee under section 29 of the Act. Accordingly the Appellate Assistant Commissioner by his order dated November 19, 1945, declined to admit the appeal. He, however, express-ed the view that the assessee's remedy might lie in a miscellaneous application to the Tribunal complain-ing that the Income-tax Officer had either miscon-strued or had not given effect to the order of the Appellate Tribunal. ARUNACHALAM CHETTIAR [[1953] 1 S.C.R. 463] (1953) लाफ इसधारा 66-ए(2) पीड़ित पक्ष को किसी संदर्भ पर दिए गए उच्च न्यायालय के किसी भी फैसले के खिन्यायालय में अपील करने का अधिकार देता हैधारा 66 किसी भी मामले में जिसे उच्च न्यायालय इस न्यायालय मेंअपील के लिए उपयुक्त प्रमाणित करता है।धारा 66, (5) यह प्रावधान करता है कि उच्च न्यायालय इसके तहतसंदर्भित किसी भी ऐसे मामले की सुनवाई परधारा 66(1)और (2) इसके द्वारा उठाए गए कानून के प्रश्नों कानिर्णय करेगा और उन आधारों पर अपना निर्णय देगा जिन पर ऐसा निर्णय आधारित है। विद्वान अटार्नी-जनरलद्वारा मामले की शुरुआत के दौरान यह प्रश्न उठा कि क्या उच्च न्यायालय द्वारा इस आधार पर मामले को स्वीकारकरने से इनकार करना कि संदर्भ अक्षम था, एक निर्णय और निर्णय था जैसा कि विचार किया गया हैधारा66(5)उस अधिनियम का जिससे अकेले ही इस न्यायालय में अपील करने का अधिकार दिया जाता है। यहसुनिश्चित करते हुए कि मद्रास उच्च न्यायालय का निर्णय और निर्णय के अर्थ के अंतर्गत आता हैधारा66(5)अधिक सुरक्षा के लिए विद्वान अटॉर्नी-जनरल ने अनुरोध किया कि अपील को इस न्यायालय द्वारा दी गईविशेष अनुमति के रूप में माना जाएअनुच्छेद 136 संविधान का. निर्धारिती प्रतिवादी की ओर से उपस्थित विद्वानअधिवक्ता ने इस प्रार्थना पर कोई आपत्ति नहीं जताई और तदनुसार हमने अपीलकर्ता को छुट्टी दे दीअनुच्छेद136 और इस अपील को ऐसी छुट्टी के अनुसरण में दायर की गई अपील के रूप में माना। इन परिस्थितियों मेंहमारे लिए उच्च न्यायालय के आदेश की अपीलीयता पर कोई राय व्यक्त करना आवश्यक नहीं हैधारा 66-एअधिनियम का. विद्वान अटॉर्नी-जनरल का तर्क है कि उच्च न्यायालय द्वारा जिस निर्णय पर भरोसा किया गया है उसका वर्तमानमामले के तथ्यों पर कोई अनुप्रयोग नहीं है। उस मामले में ट्रिब्यूनल ने अपने आदेश दिनांक 11 जुलाई, 1944द्वारा, अपीलीय सहायक आयुक्त की अपील की अनुमति दी और मूल्यांकन को रद्द कर दिया, जिसे उसने अवैधमाना था। इसके तुरंत बाद यह आदेश आयुक्त को तामील करा दिया गया। 5 अक्टूबर, 1944 को आयकरअधिकारी द्वारा ट्रिब्यूनल में एक आवेदन किया गया थाधारा 35 आदेश में तथ्यों के विवरण में निहित एक बयानको सही करने के लिए। 11 जुलाई, 1944 के आदेश की सेवा की तारीख से 60 दिन से अधिक बाद, 7अक्टूबर, 1944 को आयुक्त ने एक आवेदन कियाधारा 66 अधिनियम के (1) ट्रिब्यूनल को 11 जुलाई 1944के आदेश में सन्निहित अपने निर्णय की सत्यता के प्रश्न को उच्च न्यायालय को संदर्भित करने की आवश्यकता है।दोनों आवेदनों का निपटारा एक ही दिन, अर्थात् 17 जनवरी को किया गया। 1945, जब सुधार के लिए आवेदनस्वीकार कर लिया गया था और प्रार्थना के अनुसार न्यायालय की राय के लिए एक मामला बताया गया था।धारा66(1) आवेदन को उस तारीख से 60 दिनों के भीतर किया जाना आवश्यक है जिस दिन आवेदक को उप-धारा (4) के तहत आदेश की सूचना दी जाती है।धारा 33. यह माना गया कि सुधार के लिए एक आवेदन कोमंजूरी दी जानी चाहिएधारा 35 और आदेश में त्रुटि को सुधारना किसी आदेश के अंतर्गत नहीं थाधारा 33(4)और, इसलिए, जिसके संबंध में एक नहीं थाधारा 66(1) किसी मामले को बयान करने की अनुमति दी गई। आगेयह माना गया कि यदि अपीलीय न्यायाधिकरण ने क़ानून के प्रावधानों के उल्लंघन में अनुचित या गलत तरीके सेएक संदर्भ दिया है, तो उच्च न्यायालय मामले के बयान पर आपत्ति पर विचार करने में सक्षम है और यदि वह इसनिष्कर्ष पर पहुंचता है कि मामले का उल्लेख नहीं किया जाना चाहिए था, उच्च न्यायालय को संदर्भित प्रश्न पर रायव्यक्त करने के लिए बाध्य नहीं किया गया था। हमारे सामने मौजूद मामले में इसमें कोई सवाल नहीं है कि वर्तमानआवेदन समय के भीतर नहीं किया गया था, लेकिन विवाद यह हैधारा 66(1) केवल "ऐसे आदेश" से उत्पन्न होनेवाले कानून के प्रश्न के संदर्भ के लिए एक आवेदन पर विचार करता है जिसका स्पष्ट अर्थ है इसके तहत कियागया आदेशधारा 33(4), _और, इसलिए, यदि उस धारा के तहत कोई वैध आदेश नहीं है, तो "ऐसे आदेश" सेकानून का कोई प्रश्न उत्पन्न नहीं हो सकता है और परिणामस्वरूप अपीलीय न्यायाधिकरण को इसके तहत उच्चन्यायालय को कोई भी संदर्भ देने का अधिकार क्षेत्र हो सकता है।धारा 66(1).धारा 66(2) प्रावधान करता हैकि यदि उप-धारा (1) के तहत किए गए किसी भी आवेदन पर अपीलीय न्यायाधिकरण इस आधार पर मामले Case: COMMISSIONER OF INCOME-TAX; MADRAS versus MTT. The Appellate Tribunal held that the finding of the Income-tax Officer that the sum of Rs. 13,541 was to be assessed as u.ntaxed profits of earlier years remitted to India in the accounting year did not arise in the course of giving effect to the Appellate Tribunal's order and by its order dated February 20, 1946, cancelled that finding and directed the Income-tax Officer to revise tbe computation accordingly. The last mentioned order having been served on t·he Commissioner of Income-tax, Madras, on March· 8, 468 19.;2 1946, the latter on May 1, 1946, made an application C omm,,,sstoner .-. oJ ,before·the Appellate 'rribunal under section 66(1) · of Incom•·tax thii Act and prayed that three quest10us formulated Madras • by him in his petition should be referred to the High •. Court. The contention was that the Appellate 'rd-Mtt. Ar. s. Ar. bunal had no jurisdiction in law to entertain, consider Ar~~=:i::;~m and pass the order which it did on the miscellaneous application seeing that it was neither an appeal Das J. under section 33 of the Income-tax Act nor could it be regarded as a rectification under section 35 of ·any mistake committed by the Bench. 'l'he Appellate Tribunal took the view that although no specific provision was made in the Act by which it could give effect to its order or explain any ambiguity in such an order by a later order in any miscellaneous application filed by any party, such power, neverthe-less, was inherent in the Tribunal. 'rhe Tribunal accordingly thought that a point of law did arise and on August 23, 1946, referred the following question to the High Court, namely:- "Whether in the facts and circumstances of this case the order of the Bench dated 20th February, 1946, in the miscellaneous application is an appro-priate order and is legally valid and passed within the jurisdiction and binding on the Income-tax Officer." The Tribunal declined to refer the other questions formulated by the Commissioµer. This reference came to be numbered as Case Referred No. 80 of 1946. It appears that pursuant to an order made by the High Court on March 30, 1948, on the appli-cation of the Commissioner of Income-tax under sec-tion 66 (2) of the Act the Tribunal referred the following question to the High Court:- "If the answer to the question already referred to the High Court by the order of the Appellate Tribu-nal dated \)3rd August, 194.6, is in the affirmative, whether, in the circumstances and on the facts of the case, the recomputation made by the Income-tax Officer pursuant to the decision of the Appellate • S.C.R. SUPREME COURT REPORTS 469 1962 Tribunal in R.A.A. No. 53 (Madras) of 1942-43 was valid and correct." 'd The two referred cases came up f or cons1 eration before a Bench of the Madras High Court and it was held that the reference under section 66(1) was incompetent in view of the earlier decision of that Court mentioned above which they felt to be binding on them and accordingly the Bench declined to answer the questions. The Commissioner of Income-tax thereafter applied for and obtained leave to appeal· to this Court from the decisions in both the references and obtained such leave on his undertaking to pay the costs of the assessee in any event. In that case the Tribunal by its order dated Jnly 11, 1944, allowed an appeal from the Appellate Assistant Commissioner and cancelled the assessment which it held to be illegal. This order was served on the Commissioner shortly thereafter. On October 5, 1944, an applica-tion was made to the Tribunal by the Income-tax Officer under section 35 to correct a statement con-tained in the statement of facts in the order. More than 60 days after the date of the service on him of the order of July 11, 1944, to wit on October 7, 1944, the Commissioner made an application under section 66 (1) of the Act requiring the Tribunal to refer to the High Court the question as to the correct-ness of its decision embodied in the order of July 11, 1944. Both the applications were disposed of on the same day, namely, January 17, 1945, when the application for rectification was granted and a case was stated for the opinion of the Court as prayed. Section 66 (1) requires the application to be made within 60 days of the date on which the applicant is served with notice of an order under sub-section ( 4) of section 33. It was held that the granting of an application for rectification under section 35 and. correcting the error in the order was not an order under section 33 ( 4) and, therefore, was not one in respect of which section 66 (1) permitted a case to be stated. Section 66 (2) provides that if on any application being made under sub-section ( 1) the Appellate Tri-bunal refuses to state the case on the ground that no question of law arises, t.he assessee or the Commis-sioner may, within the time specified therein, apply to the High Court and th-a High Court may, if it is not satisfied of the correctness of the decision of the Appellate Tribunal, require the Appellate Tribunal to state the case and to refer it. The jurisdiction given to the High Court under this sub-section· is condi-. tional on an application under sub-section (1) being refused by the Appellate Tribunal.
