PATHAK, JJ.] Losses in business-Deduction under section 10(1) of the Income Tax Act, . 1922.....:./s a smuggler who is taxed on his income from smuggling under the Income Tax Act, 1922 entitled to a deduction under section 10(1) of the Act on account of the confiscation of currency notes e1nployetl in the smuggling activity. The respondent Piara Singh was apprehended in September 1958 by the Indian Police while crossing the Inda-Pakistan border into Pakistan. A sum o~ Rs. 65,500/r in currency notes was recovered from his person. On interro-gation he stated that he was taking the currency notes to Pakistan to enilble him to purchase gold in that country with a view to smuggling it into India. The Collector of Central Excise and Land Customs ordered the confiscation of the currency notes. In the proceedings initiated by the Income Tax -Officer, ho found that Rs. 60,500/- constituted the income of tlle assesscc from undisclosed sources. An appeal by the assessee was dismissed by the Appellate Assistant Commis-sioner. In second appeal before the Income Tax Appellate Tribunal, the. assessee represented that if he was regarded as engaged in the business of smuggli!lll gold he was entitled to il deduction under section 10( 1) of the Income Tsx Act, 1922 of the entire sum of Rs. 65,500/, as a loss incurred in tho business on the confiscation of the currency notes. The Tribunal upheld the claim to dedliction. It proceeded- on the basis that the assessee was carrying on a regular smuggling activity which consisted of taking currency notes out of India and exchanging them with gold in Pakistan which was later smuggled into India. The High Court on a reference at the instance of the Revenue answered the· reference against the Revenue. Hence the appca:J. Allowing the appeal, the Court. HEID : I. 1122] (1980) ਪ੍ਰਤੀਵਾਦੀ, ਪਿਆਰਾ ਸਿੰਘ, ਸਤੰਬਰ 1958 ਵਿੱਚ ਭਾਰਤੀ ਪੁਲਿਸ ਦੁਆਰਾ ਭਾਰਤ-ਪਾਕਿਸਤਾਨੀ ਸਰਹੱਦ ਨੂੰ ਪਾਰ ਕਰਦਿਆਂ ਪਾਕਿਸਤਾਨ ਵਿੱਚ ਦਾਖਲ ਹੋਣ ਸਮੇਂ ਕਾਬੂ ਕੀਤਾ ਗਿਆ ਸੀ। ਉਸਦੇ ਕੋਲੋਂ ਰੁਪਏ 65,500/- ਦੇ ਕਰੰਸੀ ਨੋਟ ਬਰਾਮਦ ਹੋਏ। ਪੁੱਛਗਿੱਛ ਦੌਰਾਨ ਉਸ ਨੇ ਦੱਸਿਆ ਕਿ ਉਹ ਇਹ ਕਰੰਸੀ ਨੋਟ ਪਾਕਿਸਤਾਨ ਲੈ ਜਾ ਰਿਹਾ ਸੀ ਤਾਂ ਜੋ ਉਹ ਉਸ ਦੇਸ਼ ਵਿੱਚ ਸੋਨਾ ਖਰੀਦ ਸਕੇ ਅਤੇ ਉਸ ਨੂੰ ਭਾਰਤ ਵਿੱਚ ਤਸਕਰੀ ਕਰ ਸਕੇ। ਕੇਂਦਰੀ ਐਕਸਾਈਜ਼ ਅਤੇ ਲੈਂਡ ਕਸਟਮਜ਼ ਦੇ ਕਲੈਕਟਰ ਨੇ ਉਸ ਕਰੰਸੀ ਨੋਟਾਂ ਦੀ ਜ਼ਬਤੀ ਦਾ ਹੁਕਮ ਦਿੱਤਾ। ਹੁਣ ਆਮਦਨ ਟੈਕਸ ਅਫਸਰ ਨੇ ਭਾਰਤੀ ਆਮਦਨ ਟੈਕਸ ਐਕਟ, 1922 ਅਧੀਨ ਮੁਲਜ਼ਮ ਦੀ ਆਮਦਨ ਨੂੰ ਮੁਲਾਂਕਣ ਅਤੇ ਉਸਦੀ ਟੈਕਸ ਦੇਣਦਾਰੀ ਨਿਰਧਾਰਿਤ ਕਰਨ ਲਈ ਕਾਰਵਾਈ ਕੀਤੀ। ਉਸ ਨੇ ਪਾਇਆ ਕਿ ਰੁਪਏ 65,500 ਵਿੱਚੋਂ ਰੁਪਏ 60,500/- ਮੁਲਜ਼ਮ ਦੀ ਅਣਘੋਸ਼ਿਤ ਸ੍ਰੋਤਾਂ ਤੋਂ ਆਮਦਨ ਸੀ। ਮੁਲਜ਼ਮ ਦੀ ਅਪੀਲ ਨੂੰ ਅਪੀਲੇਟ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੇ ਰੱਦ ਕਰ ਦਿੱਤਾ। ਦੂਜੀ ਅਪੀਲ ਵਿੱਚ ਆਮਦਨ ਟੈਕਸ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਅੱਗੇ ਮੁਲਜ਼ਮ ਨੇ ਅਫਸੋਸ ਜਤਾਇਆ ਕਿ ਜੇਕਰ ਉਸ ਨੂੰ ਸੋਨੇ ਦੀ ਤਸਕਰੀ ਦੇ ਕਾਰੋਬਾਰ ਵਿੱਚ ਲੱਗਿਆ ਮੰਨਿਆ ਜਾਵੇ ਤਾਂ ਉਸ ਨੂੰ ਕਰੰਸੀ ਨੋਟਾਂ ਦੀ ਜ਼ਬਤੀ ਦੇ ਕਾਰੋਬਾਰ ਵਿੱਚ ਹੋਈ ਘਾਟੇ ਦੇ ਰੂਪ ਵਿੱਚ ਰੁਪਏ 65,500/- ਦੀ ਕਟੌਤੀ ਦਾ ਹੱਕਦਾਰ ਹੈ। ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਆਮਦਨ ਟੈਕਸ ਐਕਟ ਦੀ ਧਾਰਾ 10(1) ਅਧੀਨ ਕਰੰਸੀ ਨੋਟਾਂ ਦੀ ਜ਼ਬਤੀ ਦੀ ਪੂਰੀ ਰਕਮ ਨੂੰ ਮਨਜ਼ੂਰ ਕੀਤਾ। ਕਟੌਤੀ ਦੇ ਦਾਅਵੇ ਨੂੰ ਅਗਾਉਂ ਲਿਆਂਦਾ ਗਿਆ, ਇਹ ਮੰਨਿਆ ਗਿਆ ਕਿ ਅਸੈਸੀ ਭਾਰਤ ਤੋਂ ਕਰੰਸੀ ਨੋਟਾਂ ਨੂੰ ਬਾਹਰ ਲੈ ਜਾਣ ਅਤੇ ਪਾਕਿਸਤਾਨ ਵਿੱਚ ਉਨ੍ਹਾਂ ਨੂੰ ਸੋਨੇ ਨਾਲ ਬਦਲਣ ਦੀ ਨਿਯਮਤ ਤਸਕਰੀ ਦੀ ਗਤੀਵਿਧੀ ਕਰ ਰਿਹਾ ਸੀ, ਜੋ ਬਾਅਦ ਵਿੱਚ ਭਾਰਤ ਵਿੱਚ ਤਸਕਰੀ ਕਰ ਕੇ ਲਿਆਂਦਾ ਗਿਆ ਸੀ। ਰੈਵੇਨਿਊ ਦੀ ਬੇਨਤੀ 'ਤੇ, ਇਕ ਸਵਾਲ ਨੂੰ ਪੰਜਾਬ ਅਤੇ ਹਰਿਆਣਾ ਦੀ ਉੱਚ ਅਦਾਲਤ ਨੂੰ ਭੇਜਿਆ ਗਿਆ ਸੀ: "ਕੀ ਰੁਪਏ 65,500/- ਜੋ ਕਰੰਸੀ ਨੋਟਾਂ ਦੀ ਜ਼ਬਤੀ ਤੋਂ ਉੱਠੇ ਹਨ, ਆਮਦਨ ਟੈਕਸ ਐਕਟ, 1922 ਦੀ ਧਾਰਾ 10(1) ਅਧੀਨ ਇੱਕ ਮਨਜ਼ੂਰ ਕਟੌਤੀ ਹਨ?" ਉੱਚ ਅਦਾਲਤ ਨੇ ਸਵਾਲ ਦਾ ਜਵਾਬ ਹਾਂ ਵਿੱਚ ਦਿੱਤਾ। ਅਤੇ ਹੁਣ ਇਸ ਅਪੀਲ ਨੂੰ ਰੈਵੇਨਿਊ ਵੱਲੋਂ ਪੇਸ਼ ਕੀਤਾ ਗਿਆ ਹੈ। ਸਾਡੀ ਰਾਏ ਵਿੱਚ, ਉੱਚ ਅਦਾਲਤ ਸਹੀ ਹੈ। ਆਮਦਨ ਟੈਕਸ ਅਥਾਰਟੀਆਂ ਨੇ ਪਾਇਆ ਕਿ ਅਸੈਸੀ ਤਸਕਰੀ ਦਾ ਕਾਰੋਬਾਰ ਕਰ ਰਿਹਾ ਸੀ। ਉਨ੍ਹਾਂ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਉਹ, ਇਸ ਲਈ, ਉਸ ਕਾਰੋਬਾਰ ਤੋਂ ਆਮਦਨ 'ਤੇ ਆਮਦਨ ਟੈਕਸ ਦੇਣ ਯੋਗ ਹੈ। ਇਸ ਆਧਾਰ 'ਤੇ ਕਿ ਅਜਿਹੀ ਆਮਦਨ ਟੈਕਸਯੋਗ ਹੈ, ਸਵਾਲ ਇਹ ਹੈ ਕਿ ਕੀ ਕਰੰਸੀ ਨੋਟਾਂ ਦੀ ਜ਼ਬਤੀ ਅਸੈਸੀ ਨੂੰ ਦਾਅਵੇ ਵਾਲੀ ਕਟੌਤੀ ਦਾ ਹੱਕਦਾਰ ਬਣਾਉਂਦੀ ਹੈ। ਕਰੰਸੀ ਨੋਟ ਜੋ ਅਸੈਸੀ ਨੇ ਸਰਹੱਦ ਪਾਰ ਕੀਤੇ ਸਨ, ਪਾਕਿਸਤਾਨ ਵਿੱਚ ਸੋਨਾ ਖਰੀਦਣ ਦਾ ਸਾਧਨ ਬਣਾਉਂਦੇ ਸਨ, ਜਿਸ ਸੋਨੇ ਨੂੰ ਉਸ ਨੇ ਬਾਅਦ ਵਿੱਚ ਭਾਰਤ ਵਿੱਚ ਮੁਨਾਫੇ 'ਤੇ ਵੇਚਿਆ। ਕਰੰਸੀ ਨੋਟ ਸੋਨਾ ਖਰੀਦਣ ਲਈ ਜ਼ਰੂਰੀ ਸਨ। ਕਰੰਸੀ ਨੋਟਾਂ ਨੂੰ ਸਰਹੱਦ ਪਾਰ ਲਿਜਾਣਾ ਤਸਕਰੀ ਦੇ ਕੰਮ ਦਾ ਇੱਕ ਜ਼ਰੂਰੀ ਹਿੱਸਾ ਸੀ। ਜੇ ਤਸਕਰੀ ਦੀ ਗਤੀਵਿਧੀ ਨੂੰ ਕਾਰੋਬਾਰ ਵਜੋਂ ਮੰਨਿਆ ਜਾ ਸਕਦਾ ਹੈ, ਤਾਂ ਜੋ ਲੋਕ ਉਸ ਕਾਰੋਬਾਰ ਨੂੰ ਚਲਾ ਰਹੇ ਹਨ ਉਹਨਾਂ ਨੂੰ ਇਹ ਮੰਨਣਾ ਪਵੇਗਾ ਕਿ ਕਾਰੋਬਾਰ ਵਿੱਚ ਸ਼ਾਮਲ ਇੱਕ ਜ਼ਰੂਰੀ ਘਟਨਾ ਕਸਟਮ ਅਥਾਰਟੀਆਂ ਦੁਆਰਾ ਹਿਰਾਸਤ ਅਤੇ ਕਰੰਸੀ ਨੋਟਾਂ ਦੀ ਅਗਲੀ ਜ਼ਬਤੀ ਹੈ। ਇਹ ਇੱਕ ਘਟਨਾ ਹੈ ਜਿਵੇਂ ਕਿ ਕਾਰੋਬਾਰ ਦੇ ਚਲਾਉਣ ਦੌਰਾਨ ਕੋਈ ਹੋਰ ਫੀਚਰ ਹੋਵੇ। ਗਤੀਵਿਧੀ ਦੀ ਕਿਸਮ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਰੱਖਦਿਆਂ, ਕਸਟਮ ਅਥਾਰਟੀਆਂ ਦੁਆਰਾ ਕੋਈ ਵੀ ਸੰਭਵ ਹਿਰਾਸਤ ਇੱਕ ਸਧਾਰਣ ਫੀਚਰ ਹੈ ਜੋ ਇਸ ਵਿੱਚ ਸ਼ਾਮਲ ਅਤੇ ਸਮੁੱਚੀ ਹੈ। ਕਰੰਸੀ ਨੋਟਾਂ ਦੀ ਜ਼ਬਤੀ ਕਾਰੋਬਾਰ ਦਾ ਪਿੱਛਾ ਕਰਦਿਆਂ ਹੋਈ ਇੱਕ ਨੁਕਸਾਨ ਹੈ, ਇਹ ਉਸੇ ਤਰ੍ਹਾਂ ਦਾ ਨੁਕਸਾਨ ਹੈ ਜਿਵੇਂ ਕਿ ਕਰੰਸੀ ਨੋਟ ਚੋਰੀ ਹੋ ਗਏ ਹੋਣ ਜਾਂ ਰਸਤੇ ਵਿੱਚ ਗਿਰ ਗਏ ਹੋਣ ਜਦੋਂ ਕਾਰੋਬਾਰ ਕੀਤਾ ਜਾ ਰਿਹਾ ਸੀ। ਇਹ ਇੱਕ ਨੁਕਸਾਨ ਹੈ ਜੋ ਸਿੱਧਾ ਕਾਰੋਬਾਰ ਦੇ ਚਲਾਉਣ ਤੋਂ ਉੱਠਦਾ ਹੈ ਅਤੇ ਇਸ ਨਾਲ ਸਬੰਧਤ ਹੈ। ਇਸ ਅਦਾਲਤ ਦੁਆਰਾ ਬਦਰੀਦਾਸ ਦਾਗਾ ਬਨਾਮ ਆਮਦਨ ਟੈਕਸ ਕਮਿਸ਼ਨਰ ਵਿੱਚ ਰੱਖੇ ਗਏ ਸਿਧਾਂਤ ਦੀ ਲਾਗੂ ਕਰਦਿਆਂ ਕਟੌਤੀ ਨੂੰ ਮਨਜ਼ੂਰ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ। ਇਨਕਮ ਟੈਕਸ ਕਮਿਸ਼ਨਰ, ਗੁਜਰਾਤ ਬਨਾਮ ਐਸ.ਸੀ. ਕੋਠਾਰੀ (') ਵਿੱਚ ਇਸ ਸਹਿਯੋਗ,1ਨੇ ਕਿਹਾ ਕਿ ਇਨਕਮ ਟੈਕਸ ਦੀ ਧਾਰਾ 1 ਪ੍ਰਸ਼ਨ 1 ਦੇ ਉਦੇਸ਼ ਲਈ ਧਾਰਾ, 1922 ਇੱਕ ਗੈਰ-ਕਾਨੂੰਨੀ ਕਾਰੋਬਾਰ ਕਰਨ ਵਿੱਚ ਹੋਏ ਨੁਕਸਾਨ ਨੂੰ ਟੈਕਸ ਵਿੱਚ ਲਿਆਂਦੇ ਗਏ ਮੁਨਾਫ਼ੇ ਦੇ ਅਸਲ ਅੰਕੜੇ ਤੋਂ ਪਹਿਲਾਂ ਕੱਟਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਉਚਿਤ ਤੌਰ 'ਤੇ। ਗਰੋਵਰ, ਜੇ., ਅਦਾਲਤ ਵੱਲੋਂ ਬੋਲਦੇ ਹੋਏ, ਨੇ ਦੇਖਿਆ ਜੇਕਰ ਕਾਰੋਬਾਰ ਗੈਰ-ਕਾਨੂੰਨੀ ਹੈ, ਤਾਂ ਨਾ ਤਾਂ ਕਮਾਏ ਗਏ ਮੁਨਾਫੇ ਅਤੇ ਨਾ ਹੀ ਉੱਠਾਏ ਗਏ ਨੁਕਸਾਨ ਕਾਨੂੰਨ ਵਿੱਚ ਲਾਗੂ ਹੋਣਗੇ। ਪਰ, ਇਹ ਮੁਨਾਫੇ ਨੂੰ ਟੈਕਸ ਲਗਾਉਣ ਵਾਲੇ ਕਾਨੂੰਨ ਤੋਂ ਬਾਹਰ ਨਹੀਂ ਕਰਦਾ। ਇਸੇ ਤਰ੍ਹਾਂ, ਕਾਰੋਬਾਰੀ ਸੰਵਿਧਾਨ ਦੀ ਕਾਨੂੰਨੀਅਤਾ ਦੇ ਜਾਰੀ ਕਰਨ ਨੂੰ ਧਾਰਾ 10(1) ਅਧੀਨ 1922 ਦੇ ਐਕਟ ਦੇ "ਮੁਨਾਫੇ" ਦੇ ਤੌਰ ਤੇ ਟੈਕਸ ਲਾਗੂ ਕਰਨ ਲਈ ਰਕਮ ਦੀ ਗਣਨਾ ਲਈ ਕਾਨੂੰਨਾਂ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਲਿਆਂਦਾ ਜਾਂਦਾ ਹੈ। ਟੈਕਸ ਇਕੱਠਾ ਕਰਨ ਵਾਲਾ ਇਹ ਨਹੀਂ ਸੁਣਾਈ ਦੇ ਸਕਦਾ ਕਿ ਉਹ ਕੁੱਲ ਰਸੀਦਾਂ ਨੂੰ ਟੈਕਸ ਲਾਏਗਾ। ਉਹ ਕੇਵਲ ਵਪਾਰ ਜਾਂ ਕਾਰੋਬਾਰ ਤੋਂ ਮੁਨਾਫੇ 'ਤੇ ਹੀ ਟੈਕਸ ਲਗਾ ਸਕਦਾ ਹੈ। ਇਹ ਬਿਨਾਂ ਨੁਕਸਾਨ ਅਤੇ ਕਾਰੋਬਾਰ ਦੇ ਜਾਇਜ਼ ਖਰਚੇ ਘਟਾਏ ਬਿਨਾਂ ਨਹੀਂ ਕੀਤਾ ਜਾ ਸਕਦਾ। Is a smuggler, who is taxed on his income from smuggling under the Income Tax Act, 1922, entitled to a deduction under Section 10(1) of the Act on account of the confiscation of cur-rency notes employed in the smuggling activity ? E The respondent, Piara Singh, was apprehendei:J in September, 1958 by the Indian Police while crossing the Inda-Pakistan border into Pakistan. A sum of Rs. 65,500/- in currency notes was recovered from his person. On interrogation he stated that he was taking the currency notes to Pakistan to enable him to purchase gold in that country with a view to smuggling it into India. The Collector of Central Excise and Land Customs ordered the confiscation of 'thtj. cur-rency notes. F The Income Tax Officer now took proceedings under the Indian Income Tax Act, 1922 for assessing t11e assessee's income and deter-mining his tax liability. He came to'the finding that out of Rs. 65,500/-an amount of Rs~ 60,500/- constituted the income of the assessee from undisclosed sources. An appeal by the assessee was dismissed by the Appellate Assistant Commissioner. The Income Tax autho-rities found that the assessee was carrying on the business of smuggling They held that he' was, therefore, liable to income-tax on income from that business. On the basis that such income was mxable, the question is whether the confiscation of the currency notes entitles the assessee to the deduction claimed. The currency notes clirried by the assessee across the border constit.uted the means for acquiring gold in Pakistan, which gold he subsequently sold in India at a profit. The currency notes were necessary for acquiring the gold. The carriage of currency notes across the border was an essential part of the smuggling operation. If the activity of smuggling can be regard-ed as a business, those who are carrying on that business must be deemed to be aware that a necessary incident involved in the business is detection. by the Custom authorities and the consequent confisca-tion of the currency notes. It is an incident as predictable in t41) COl;lrSe of cmrying on the activity as any other feature of it. Having · regard to the nature of the activity possi\)le detection by the Custo,111s authorities constitutes a normal feature integrated into all that is implied and involved in it. The confiscation of the currency notes is a loss occasioned in pursuing the business, it is a loss in much the sMD.e way as if the currency notes had been stolen or dropped on the way while carrying on the business. It is a loss which springs directly from the carrying on of the business and is incidental to it. Applying the principle laid down by this Court in Badridas Daga v. Similarly, the taint of illegality of the business cannot detract from the losses being taken into account for computation of the ·llilJ.ount Which <.-.ill be subjected to tax as ''t>rofits" under sec-tion 10(1) of the Act of 1922. The tax cOllector cannot ·be heard to say that he will bring the gross receipts to tax. He can only tax profits of a trade or business. That cannot be done without deducting the losses and the legitimate .. e11penses of the business." Reliance was placed by the Revenue on Haji Aziz and Abdul Shakoor Bros. v. Commissioner of Income-tax, Bombay City fl(') In that case, however, the assessee carried on the lawful business of importing dates from abroad and selling them in India. Thei import of dates by steamer was prohibited. Nonetheless he im-ported dates from Iraq by steamer, and the eonsignments were confis-cated by the customs authorities. But the dates were released subse-quently on payment of fine. The assessee's claim to deduction under s. 10(2) (xv) of the Ineome Tax Act was rejected on the ground that the amount was Nid by way of penalty for a breach of the law. An infraction of the law was not a normal incident of business carried on by the assessee, and the penalty was rightly held to fall on the assessee in some character other than that of a trader. Reference w,as made by the Revenue to Soni Hinduji Kushalji & Co. v. Commissioner of Income-tax, A.P([2]). The assessee's claim to the deduction of the value of gold confiscated by the. customs authorities was ~ound unsustainable by the court. The decision in that case can b~ explained on the ground that the assessee was carrying on a lawful business in gold, silver and jewellery and committed an infraction of the law h1 smuggling gold into the country. Our attention has also been invited to J. S. Parkar v. V. B.
