This is an application for condonation of delay in filing
the present appeal by the appellant-Commissioner of Income Tax
Nagpur. Delay is of one day only, therefore, we are of the view
that to avoid further delay there is no point in issuing notice to
respondent for condonation of delay of one day.
In the interest of justice therefore application is
allowed. Delay is condoned.
