2.It is brought to our notice by the learned Counsel appearing on behalf of the respondent that the appeal bearing ITXA(L) No.2392 of 2007 involving identical issue for the A.Y.2001-02 having tax effect of Rs.53,62,000/- has been withdrawn by the Revenue. The learned Counsel for the Respondent, has raised the very same issues, which were the subject matter of the appeal withdrawn by the Revenue. In this view of the matter, appeal is liable to be dismissed for want of substantial question of law. Order accordingly. No order as to costs.
