This court is satisfied with the explanation furnished forthe delay caused in filing the application duly supported byan affidavit.
Accordingly, the application seeking condonation ofdelay u/S.5 of Limitation Act and the restoration applicationboth stand allowed subject to deposition of Rs.1,000/- by theapplicant with the Secretary, State Legal Services Authority,receipt whereof be filed in the registry, on doing so the ordershall stand recalled and the ITR(ITAP) be restored to itsoriginal number.
