Learned advocate Mr. D.V. Pathy candidly admits that against the impugned order, an Appeal shall lie before the High Court under Section 260A of the Income-tax Act, 1961. Mr. Pathy, therefore, seeks leave to withdraw this petition with the liberty to prefer Appeal against the impugned order. Leave is granted. Petition is disposed of as withdrawn.
