The learned counsel for the petitioner states that despite the efforts to contact the petitioner for taking instructions in respect of the developments in the matter during the pendency of the petition, the instructions could not be secured. It is stated that the petitioner could not be contacted and the notice sought to be served on the petitioner was received back as the office of the petitioner is presently not located on the said address. It is stated that by an order dated 16/08/2017, the appearance of the counsel for the petitioner stands discharged.
It is apparent from the aforesaid that the petitioner is not interested in prosecuting the writ petition. During the pendency of the petition, the petitioner could have contacted his counsel, had be been diligent in prosecuting the writ petition.
In the circumstances of the case, we dispose of the writ petition with no order as to costs.
