Heard learned counsel for the parties. This appeal is directed against the order passed by the ITAT deleting the quantum addition made by the Assessing Officer. It is brought to our notice that, quantum appeal filed by the Revenue against the decision of the Tribunal bearing No.5289/Mum/05 was subject matter in appeal before this Court being Income Tax Appeal No.461 of 2008 (Commissioner of Income Tax – II Vs. Shri Shashi Aggarwal) and the same was rejected vide order dated 4[th] September, 2008. In this view of matter, we find no substantial question of law involved in this appeal. Appeal stands dismissed in limini for want of substantial question of law for the reasons recorded in the order dated 4[th] September, 2008 with no order as to costs.
