Matter has come up on misc. application for recalling theorder dt.8-2-2016. The contention advanced by the counsel forapplicant is that the tax effect involved is more than Rs.20 Lakhs &in fact is not covered by circular of CBDT dt.10-12-2015 and due tosome inadvertence when the batch of appeals came to be listedbefore the Court on the said date this fact could not be pointedout.
After hearing counsel for applicant & going through order ofthe Tribunal, we do find justification in what is being contendedbefore us.
Accordingly, the application stands allowed. The order dt.8-2-2016 is recalled. Office to proceed & list the main appeal.
