It is noticed that the other appeals arising out of the samecommon order have been dismissed as withdrawn with libertyas prayed by a separate common order passed today thatreads as under:-
“The learned counsel for the appellant submitsthat in view of the subsequent events, i.e., passing ofthe order on the rectification application, the appellantdoes not want to proceed with these appeals anyfurther against the common order dated 30.08.2011as passed by the Income Appellate Tribunal, JodhpurBench, Jodhpur in ITA Nos. 336/JODH/1999 and342/JODH/1996; and seeks permission to withdrawwith liberty for the appellant to take recourse to theappropriate remedies in accordance with law, in case,any grievance remains or arises later.
Having regard to the circumstances of thecase, permission granted.
Accordingly, these appeals stand dismissed aswithdrawn with liberty as prayed.”
