Heard the learned counsel for the parties.
Taking into consideration the facts and circumstances of thecase as well as the conviction and sentence awarded to theaccused appellant and the fact that the accused appellant was onbail during trial and sentence of the accused appellant has beensuspended by the trial court for one month, I deem it just andproper to suspend the sentence awarded to the appellant duringthe pendency of the appeal.
Accordingly, the application for suspension of sentence isallowed and it is ordered that the sentence awarded to accused-appellant Dr. Shyam Bihari Sharma S/o Shri Ram SahaiSharma in Criminal Regular Case No.89/2016 (20/2011) shallremain suspended; provided he furnishes a personal bond of Rs.50,000/- and two sureties bond of Rs. 25,000/- each to thesatisfaction of the learned trial court to the effect that he shallappear before this Court on 17.05.2021 and, as and when calledupon to do so.
