SANKLECHA, J.DATE : 06 September 2013 P.C.: Since the appeal is directed against the judgment of the Income Tax Appellate Tribunal for 4 assessment years i.e. 2004-05 to 2007-08, we permit the appellant to withdraw this appeal with a view to filing 4 separate appeals for the respective assessment years. It is, however, clarified that the office shall permit the appellant to place all the Exhibits filed in this appeal as Exhibits in the first of the 4 appeals to be filed as aforesaid. Filing Exhibits in the other 3 appeals is dispensed with. 2.The learned counsel for the appellants states that the 4 appeals as aforesaid will be filed within 3 weeks from today, but in the meantime the respondents may not be allowed to take any coercive action. It is stated that as against a tax demand of Rs.72 lakhs approximately, the appellant has already paid about Rs.67 lakhs. itxa-825-12.sxw 3.In view of the above, the respondents shall not take any coercive steps for the recovery of the balance tax amount and the interest for a period of 4 weeks from today. However, the appellant shall continue to pay the monthly installments as the appellant has been paying so far. CHIEF JUSTICE M.S. SANKLECHA, J.
