1]This is a review application under Order 47 Rule 1 againstthe order dated 6.5.2010 whereby the bunch of appeals were disposed ofby adopting the same course as was adopted by the Madras High Court inthe case ofCommissioner ofIncome Tax v. Nevveli Lignite Corporation
[td., (2007) 293 ITR 362.
?DAgegrieved against the aforesaid order the Department fileSLP before the Supreme Court. The Supreme Court vide order dated4.7.2016 overruled the decision of this Court and permitted theDepartment to move an application before this Court for revival of theirappeals.
3By this present application, the applicant-department praysfor restoration of the case to the original number,
