The petitioner has filed the present writ petition for payment of refund of Rs.69,31,610/-, due and payable pursuant to the order of the Income Tax Appellate Tribunal dated 30[th] June, 2017 in respect of Assessment Year 2010-11.
2. The refund, it is stated, was approved on 26[th] December, 2017, and even thereafter was not paid compelling the petitioner to file the present writ petition on which notice was issued vide order dated 7[th] February, 2018. 3. Respondents state that the refund was credited to the account of the petitioner on 9[th] March, 2018, after a delay of more than eight months from the date of the order of the Tribunal and more than two months after the refund was approved/sanctioned on 26[th] December, 2017.
4. On being questioned, counsel for the respondent/Revenue states that
interest has been paid upto 26[th] December, 2017 and not till 9[th] March, 2018.
5. The respondents would pay interest till 9[th] March, 2018, the date on which the refund was credited to the account of the petitioner.
6. The petitioner would be also entitled to costs of Rs.5,000/-, which would be paid alongwith interest within a period of four weeks from the date a copy of this order is received by the respondents.
With the aforesaid direction, the writ petition is disposed of.
