Sr. No.2 Regular List IN THE HIGH C0URT 0F JAMMU & KASHMIR AND LADAKHAT JAMMU(THROUGH VIRTUAL MODE) ITA No.11/2008 H.K.GANDOTRA Through: Mr. Subhash Dutt, Advocate Vs. COMMISSIONER OF INCOME TAX Through: Ms. Aruna Thakur, Advocate …Appellant(s)/Petitioner(s) ...Respondent(s) CORAM: HON’BLE THE CHIEF JUSTICE (through virtual mode) HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE O R D E R 16-11-2023 Heard Mr. Subash Dutt, learned counsel appearing for the appellant, who submits that the appellant H.K. Gandotra has expired during the pendency of this appeal and he has been apprised by his legal heirs that they are not keen to pursue the matter. Under the circumstances, there is no aggrieved person before this Court as far as the present appeal is concerned. Though Ms. Aruna Thakur, learned counsel appearing for the respondent-Revenue Department submits that because of change of counsel for the revenue the matter may be deferred. However, considering the fact that there is no aggrieved person before us as mentioned by Mr. Subash Dutt, we do not find any reason to continue with this appeal and accordingly, this appeal is closed on the basis of statement made by Mr. Subash Dutt, learned counsel earlier appearing for the appellant now expired. Disposed of as closed. (MOKSHA KHAJURIA KAZMI) (N. KOTISWAR SINGH) JUDGE CHIEF JUSTICE
