09.06.2023 Item No.13 gd/ssd MAT/844/2023 IA NO: CAN/1/2023 DIA GOLD JEWELS PRIVATE LIMITED VS PRINCIPAL COMMISSIONER OF INCOME TAX KOLKATA-2 AND ORS. Mr. Ranjeet Kumar Murarka, Mr. Vivek Murarka, Mr. Dibanath Dey ..for the Appellant. Mr. Aryak Dutt ..for the Union of India. 1. This intra court appeal by the writ petitioner is directed against the order passed by the learned Single Bench dated 25[th] April, 2023 in WPA 7637 of 2023. 2. On reading of the impugned order we find that the Court has directed the matter to be listed before the regular Bench. The Court has also noted the submission of the learned senior counsel for the appellant who prayed for leave to file a supplementary affidavit. 3. Therefore, we find that the matter concerned is not a final order and appeal against the order is not maintainable. Hence, the appeal is dismissed by giving liberty to the appellant to mention before the concerned Court for early listing of the writ petition. 4. We make it clear that the merits of the matter have not been gone into. (T. S. SIVAGNANAM) CHIEF JUSTICE (HIRANMAY BHATTACHARYYA, J.)
