In view of the judgment of our Court in the case of Chem Amit V/s.ACIT - (2005) 272 ITR 397, Chem Amit V/s.ACIT - (2005) 272 ITR 397, the present Appeal which is filed against the aforesaid order of the ITAT passed in the Misc.Application, is not maintainable at all. In view thereof, the learned Counsel for the Appellant seeks leave to withdraw this Appeal with liberty to adopt an appropriate proceedings.
