ਫੈਸਲਾ : ਟ੍ਰਿਬਿਊਨਲ ਕੋਲ ਜੁਰਮਾਨੇ ਦੀ ਵਸੂਲੀ ਦੀ ਰੋਕ ਲਗਾਉਣ ਦੀ ਸ਼ਕਤੀ ਹੈ ਜੋ ਕਿ ਇਸਦੇ ਅਪੀਲੀ ਅਧਿਕਾਰ ਨਾਲ ਸੰਬੰਧਿਤ ਅਤੇ ਸਹਾਇਕ ਸ਼ਕਤੀ ਹੈ। (ਪੈਰਾ 2.206)
ਮੁਲਾਂਕਣ ਅਧਿਕਾਰੀ ਕੋਲ ਇੱਕ ਵੱਖਰੀ ਧਾਰਾ ਅਧੀਨ ਅਪੀਲੀ ਅਧਿਕਾਰ ਹੈ ਜਿਸ ਅਧੀਨ ਉਹ ਕਰਦਾਤਾ ਨੂੰ ਚੇਤਾਵਨੀ ਜਾਰੀ ਕਰਨ ਤੋਂ ਬਾਅਦ ਕਰ ਰੋਕ ਸਕਦਾ ਹੈ, ਜਦੋਂ ਧਾਰਾ 246 ਅਧੀਨ ਆਮਦਨ ਕਰ ਅਪੀਲੀ ਕਮਿਸ਼ਨਰ ਕੋਲ ਅਪੀਲ ਲੰਬਿਤ ਹੈ। ਪਰ ਟ੍ਰਿਬਿਊਨਲ ਜਾਂ ਕਿਸੇ ਹੋਰ ਟ੍ਰਿਬਿਊਨਲ ਦੀ ਸੁਣਵਾਈ ਦੌਰਾਨ ਜਾਂ ਟ੍ਰਿਬਿਊਨਲ ਅਪੀਲ ਦੀ ਸੁਣਵਾਈ ਦੌਰਾਨ ਰੋਕ ਲਗਾਉਣ ਦੀ ਸ਼ਕਤੀ, ਜਿੱਥੇ ਅਪੀਲੀ ਕਮਿਸ਼ਨਰ ਨੂੰ ਅਜਿਹੀ ਸ਼ਕਤੀ ਦੇਣ ਦੀ ਸ਼ਕਤੀ ਹੈ ਜੋ ਪਹਿਲਾਂ ਵਿਸ਼ੇਸ਼ ਹਾਲਾਤਾਂ ਵਿੱਚ ਵਰਤੀ ਗਈ ਹੈ। ਇਹ ਅਨੁਚਿੱਤ 254 ਅਧੀਨ ਉਚਿਤ ਹੈ, ਜੇਕਰ ਟ੍ਰਿਬਿਊਨਲ ਵਿੱਚ ਅਪੀਲ ਲੰਬਿਤ ਹੈ ਤਾਂ ਅਜਿਹੀ ਸ਼ਕਤੀ ਹੈ। ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਅਜਿਹੀ ਸ਼ਕਤੀ ਦੀ ਕਾਰਵਾਈ ਨਹੀਂ ਕਰਨੀ ਚਾਹੀਦੀ, ਜੇਕਰ ਅਜਿਹੀ ਸ਼ਕਤੀ ਦਾ ਫੈਸਲਾ ਅਜਿਹੇ ਨਿਆਂਕਾਂ ਵਿੱਚੋਂ ਹੋਵੇ ਜੋ ਉਚਿਤ ਵਰਤੇ ਗਏ ਅਤੇ ਅਨੁਦਾਨਾਂ ਦੇ ਹੋਰ ਸਾਧਨਾਂ ਦੀ ਲੋੜ ਹੈ ਜੋ ਅਜਿਹੇ ਅਧਿਕਾਰ ਦੇ ਨਿਰਵਾਹ ਲਈ ਜ਼ਰੂਰੀ ਹਨ ਅਤੇ ਇਸ ਨਾਲ ਅਜਿਹੀ ਸ਼ਕਤੀ ਦੀ ਕਾਰਵਾਈ ਵਿੱਚ ਰੁਕਾਵਟ ਪਾਉਣ ਦੀ ਸ਼ਕਤੀ ਸ਼ਾਮਲ ਹੈ। ਵੱਖਰੇ ਕਰ ਅਤੇ ਆਮਦਨ ਕਾਨੂੰਨਾਂ ਦੇ ਮੱਦੇਨਜ਼ਰ, ਅਜਿਹੀ ਸ਼ਕਤੀ ਨੂੰ ਸ਼ਰਤਾਂ ਲਾਗੂ ਕਰਨ ਤੋਂ ਬਾਅਦ ਵਰਤਿਆ ਜਾ ਸਕਦਾ ਹੈ ਜਿੱਥੇ ਆਮਦਨ ਨੂੰ ਸਿਰਫ ਉਚਿਤ ਅਤੇ ਉਪਯੁਕਤ ਮਾਮਲਿਆਂ ਵਿੱਚ ਟਾਲਣਾ ਹੈ ਜੋ ਵਿਸ਼ਵਾਸੀ ਦੇ ਵਿਵਹਾਰ ਨਾਲ ਸੁਰੱਖਿਅਤ ਹੈ, ਆਮ ਸਿਧਾਂਤ ਜੋ ਕਿ ਕਰ ਰਾਜ ਵਿੱਚ ਇਕੁਇਟੇਬਲ ਨਿਰਮਾਣ ਨੂੰ ਕਹਿ ਸਕਦਾ ਹੈ ਸਿਰਫ ਕਾਨੂੰਨ ਦੇ ਹਿੱਸੇ ਨੂੰ ਲਾਗੂ ਕਰਦਾ ਹੈ ਨਾ ਕਿ ਇਸਦੇ ਪ੍ਰਕਿਰਿਆਤਮਕ ਹਿੱਸੇ ਨੂੰ।

ਅਦਾਲਤ ਦਾ ਫੈਸਲਾ ਗਰੋਵਰ, ਨਾਇਬ ਨਿਆਂਕਾ ਵੱਲੋਂ ਸੁਣਾਇਆ ਗਿਆ। ਇਸ ਅਪੀਲ ਵਿੱਚ ਜੋ ਛੋਟਾ ਪਰ ਮਹੱਤਵਪੂਰਣ ਸਵਾਲ ਸ਼ਾਮਲ ਹੈ ਉਹ ਇਹ ਹੈ ਕਿ ਕੀ ਅਪੀਲਾਤੀ ਆਮਦਨ ਕਰ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਆਮਦਨ ਕਰ ਐਕਟ, 1961 (ਇਸਨੂੰ ਐਕਟ ਕਿਹਾ ਜਾਵੇਗਾ) ਦੇ ਸੰਬੰਧਿਤ ਪ੍ਰਾਵਧਾਨਾਂ ਅਧੀਨ ਇਸ ਦੌਰਾਨ ਕਿਸੇ ਅਸੈਸੀ ਉੱਤੇ ਵਿਭਾਗੀ ਅਧਿਕਾਰੀਆਂ ਦੁਆਰਾ ਲਗਾਏ ਗਏ ਜੁਰਮਾਨੇ ਦੀ ਵਸੂਲੀ ਨੂੰ ਰੋਕਣ ਦੀ ਸ਼ਕਤੀ ਹੈ ਜਾਂ ਨਹੀਂ।
ਅਸੈਸੀ, ਜੋ ਕਿ ਪ੍ਰਤੀਵਾਦੀ ਹੈ, ਨੂੰ ਮੁਲਾਂਕਣ ਸਾਲਾਂ 1954-55, 1960-61 ਅਤੇ 1961-62 ਦੇ ਸਬੰਧ ਵਿੱਚ ਕ੍ਰਮਵਾਰ ਰੁਪਏ 18,000/-, 1,700/- ਅਤੇ 14,000/- ਦੇ ਜੁਰਮਾਨੇ ਲਗਾਏ ਗਏ ਸਨ। ਇਹ ਜੁਰਮਾਨੇ ਐਕਟ ਦੀ ਧਾਰਾ 271(1)(c) ਪੜ੍ਹ ਕੇ ਧਾਰਾ 274(2) ਅਧੀਨ ਲਗਾਏ ਗਏ ਸਨ ਜੋ ਕਿ ਵਿਸ਼ੇਸ਼ ਆਮਦਨ ਨੂੰ ਛੁਪਾਉਣ ਅਤੇ ਗਲਤ ਵੇਰਵੇ ਦੇਣ ਲਈ ਸਨ। ਅਸੈਸੀ ਨੇ ਆਮਦਨ ਕਰ ਅਪੀਲਾਤੀ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਅਪੀਲਾਂ ਦਿੱਤੀਆਂ ਅਤੇ ਲਗਾਏ ਗਏ ਜੁਰਮਾਨੇ ਦੀ ਵਸੂਲੀ ਰੋਕਣ ਦੀ ਅਸਥਾਈ ਅਰਦਾਸ ਕੀਤੀ। ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਕੋਈ ਵੀ ਰੋਕ ਲਗਾਉਣ ਦਾ ਹੁਕਮ ਨਾ ਦਿੱਤਾ ਕਿਉਂਕਿ ਉਸ ਕੋਲ ਅਜਿਹੀ ਅਰਦਾਸ ਮੰਨਣ ਦੀ ਸ਼ਕਤੀ ਨਹੀਂ ਸੀ। ਫਿਰ ਅਸੈਸੀ ਨੇ ਸੰਵਿਧਾਨ ਦੀ ਕਲਾ 226 ਅਧੀਨ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਅਰਜ਼ੀ ਦਿੱਤੀ। ਹਾਈ ਕੋਰਟ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਅਪੀਲ ਦੌਰਾਨ ਕਾਰਵਾਈ ਅਤੇ ਜੁਰਮਾਨੇ ਦੀ ਵਸੂਲੀ ਰੋਕਣ ਦੀ ਸ਼ਕਤੀ ਹੈ ਕਿਉਂਕਿ ਇਹ ਸ਼ਕਤੀ ਉਸ ਦੇ ਅਪੀਲਾਤੀ ਅਧਿਕਾਰ ਕਿਤੇ ਸਹਾਇਕ ਅਤੇ ਸੰਬੰਧਿਤ ਹੈ। ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਫਿਰ ਕਾਨੂੰਨ ਅਨੁਸਾਰ ਰੋਕ ਦੀ ਅਰਜ਼ੀ ਨੂੰ ਨਿਪਟਾਉਣ ਲਈ ਕਿਹਾ ਗਿਆ।

Income-tax Act ( 43 of 1961), ss. 254 and 255-Amount imposed as penalty on assessee-Appeal to Appellate Tribunal-Tribunal's power to grant stay of recovery of penalty pending appeal.
Certain amounts were imposed as penalty upon the assessee (respon· dent) under ss. 27l(l)(c) and 274(2) of the Income-tax Act, 1961, for concealment of particulars of income and for furnishing inaccurate parti .. culars. The assessee preferred appeals before the Appellate Tribunal and prayed for stay of recoV<ry of the penalties pending disposal of the ap-peals, but the Tribunal declined to stay on the ground that it had no power to do so. The assessee. moved the High Court under Art. 226 and the High Court held that the Tribunal had the power to stay and directed the Tribunal to dispose of the stay application in accordance with law.
In appeal to this Court,
HELD : The Tribunal has the power to order the stay of recovery of the penalty as an incidental and ancillary power to its appellate juris-di1tion. [72 CJ
Under s. 220(6) the Income-tax Officer has a power not to treat an assessee as being in default, when an appeal under s. 246 before the Appellate Assistant Commissioner is pending. But neither the Income-tax Officer nor any other departmental officer has the power to stay the recovery of penalty when an appeal is pending before the Tribunal. The Act is silent in that behalf, and there is no provision in the Act or the Income-tax Appellate Tribunal Rules, 1963, granting expressly such a power to the Tribunal. That is because, the Tribunal, though not a court, exercises in its appellate jurisdiction under s. 254 judicial powers of an appellate court of the widest ]l<Jssible amplitude and such a statutory power impliedly grants the power of doing all such acts, or employing such means as are essentially necessary to the execution of such jurisdiction and carries witb it . the power to stay proceedings in proper cases. In view of the special nature of taxation and re.venue laws, such power can be exercised after imposing conditions for safeguarding the revenue only in des'erving and appropriate cases where th·e appeal will be otherwi50 frustrated or rendered nugatory. The general principle that in a taxing statute there is no room for what could be called equitable construction applies only to the taxing part of the statute and not to its procedural part. The short but important question which is invol-ved in this appeal by special leave from a judgment of the Kerala High Court is whether the Appellate Income-tax Tribunal has the power, under the relevant provisions of the Income tax Act, 1961, (hereinafter called the Act) to stay the recovery of the realization of the penalty imposed by the departmental authorities on an assessee during the pendency of an appeal before it.

ਉਪ-ਧਾਰਾ (6) ਪ੍ਰਦਾਨ ਕਰਦੀ ਹੈ ਕਿ ਜਦੋਂ ਕੋਈ ਅਸੈਸੀ ਨੇ ਧਾਰਾ 246 ਅਧੀਨ ਅਪੀਲ ਪੇਸ਼ ਕੀਤੀ ਹੈ ਤਾਂ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਆਪਣੀ ਵਿਵੇਕ ਅਤੇ ਜਿਵੇਂ ਕਿ ਉਹ ਉਚਿਤ ਸਮਝੇ, ਅਸੈਸੀ ਨੂੰ ਚੂਕ ਵਿੱਚ ਨਾ ਮੰਨਣ ਦੀ ਸ਼ਰਤ ਅਧੀਨ ਰੱਖ ਸਕਦਾ ਹੈ ਜਦੋਂ ਤੱਕ ਅਪੀਲ ਲੰਬਿਤ ਹੈ।
ਧਾਰਾ 221 ਜੁਰਮਾਨਾ ਲਗਾਉਣ ਦੀ ਵਿਵਸਥਾ ਕਰਦੀ ਹੈ ਜਦੋਂ ਕਰਦਾਤਾ ਡਿਫਾਲਟ ਵਿੱਚ ਹੁੰਦਾ ਹੈ। ਧਾਰਾਵਾਂ 222 ਤੋਂ 224 ਤੱਕ ਟੈਕਸ ਰਿਕਵਰੀ ਅਫਸਰ ਨੂੰ ਸਰਟੀਫਿਕੇਟ ਜਾਰੀ ਕਰਨ ਸਬੰਧੀ ਹਨ। ਧਾਰਾ 225 ਅਧੀਨ ਇਨਕਮ ਟੈਕਸ ਅਫਸਰ ਕਾਰਵਾਈ ਨੂੰ ਰੋਕਣ ਦਾ ਹੁਕਮ ਦੇ ਸਕਦਾ ਹੈ, ਭਾਵੇਂ ਸਰਟੀਫਿਕੇਟ ਟੈਕਸ ਰਿਕਵਰੀ ਅਫਸਰ ਨੂੰ ਜਾਰੀ ਕੀਤਾ ਜਾ ਚੁੱਕਾ ਹੋਵੇ। ਇਹ ਕਹਿਣਾ ਵੀ ਜ਼ਰੂਰੀ ਹੈ ਕਿ ਆਖਰੀ ਚਾਰ ਧਾਰਾਵਾਂ ਕਰ ਦੀ ਵਸੂਲੀ ਨਾਲ ਸਬੰਧਤ ਹਨ, ਪਰ ਧਾਰਾ 229 ਦੀ ਪਨਾਹਗਾਹ ਵੀ ਧਾਰਾ 227 ਦੇ ਗੁਣ ਦੁਆਰਾ ਆਮਦਨੀ ਦੀ ਵਸੂਲੀ ਯੋਗ ਹੈ। ਪਹਿਲਾਂ ਲਗਾਇਆ ਗਿਆ ਕੋਈ ਵੀ ਜੁਰਮਾਨਾ ਵੀ ਧਾਰਾ 220(6) ਵਿੱਚ ਬਣਾਇਆ ਗਿਆ ਹੈ ਜੋ ਅਪੀਲਯੋਗ ਹੁਕਮਾਂ ਦੇ ਖਿਲਾਫ ਕਰਦਾਤਾ ਨੂੰ ਅਪੀਲ ਕਰਨ ਦੀ ਆਗਿਆ ਦਿੰਦਾ ਹੈ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੂੰ। ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਅਪੀਲਾਂ ਨੂੰ ਧਾਰਾ 252 ਤੋਂ 255 ਦੁਆਰਾ ਨਿਪਟਾਇਆ ਜਾਂਦਾ ਹੈ। ਧਾਰਾ 252 ਸਿਰਫ ਟ੍ਰਿਬਿਊਨਲ ਦੀ ਸੰਵਿਧਾਨ ਲਈ ਪ੍ਰਦਾਨ ਕਰਦੀ ਹੈ, ਧਾਰਾ 253 ਕਹਿੰਦੀ ਹੈ ਕਿ ਕੋਈ ਵੀ ਕਰਦਾਤਾ ਜੋ ਹੁਕਮਾਂ ਨਾਲ ਦੁਖੀ ਹੈ ਜੋ ਉਪ-ਧਾਰਾ (1) ਦੇ ਕਲਾਜ਼ (ਅ), (ਬੀ) ਅਤੇ (ਸੀ) ਵਿੱਚ ਬਿਆਨ ਕੀਤੇ ਗਏ ਹਨ, ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਅਪੀਲ ਕਰ ਸਕਦਾ ਹੈ। ਕਮਿਸ਼ਨਰ ਵੀ ਇਨਕਮ-ਟੈਕਸ ਅਫਸਰ ਨੂੰ ਧਾਰਾ 250 ਅਧੀਨ ਬਣਾਏ ਗਏ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਦੇ ਹੁਕਮ ਖਿਲਾਫ ਅਪੀਲ ਦਾਇਰ ਕਰਨ ਲਈ ਨਿਰਦੇਸ਼ ਦੇਣ ਦਾ ਹੱਕਦਾਰ ਹੈ। ਧਾਰਾ 254 ਉਹ ਹੁਕਮ ਦਰਸਾਉਂਦੀ ਹੈ ਜੋ ਟ੍ਰਿਬਿਊਨਲ ਬਣਾ ਸਕਦਾ ਹੈ। ਉਪ-ਧਾਰਾ (1) ਜੋ ਮਹੱਤਵਪੂਰਨ ਹੈ ਹੇਠ ਦਿੱਤੀ ਜਾ ਸਕਦੀ ਹੈ।

The short but important question which is invol-ved in this appeal by special leave from a judgment of the Kerala High Court is whether the Appellate Income-tax Tribunal has the power, under the relevant provisions of the Income tax Act, 1961, (hereinafter called the Act) to stay the recovery of the realization of the penalty imposed by the departmental authorities on an assessee during the pendency of an appeal before it.
The assessee, who is the respondent, was imposed penalties in the sum of Rs. 18,000/-, 1,700/- and 14,000/- respectively in respect of the assessment years 1954-55, 1960-61 and 1961-62. These penalties were imposed under s. 27l{l)(c) read withs. 274(2) of the Act for concealment of particular income and fur-nishing inaccurate particulars. The assessee preferred appeals to the Income tax Appellate Tribunal and made an interim prayer for stay of collection of the penalties imposed. The Tribunal dec-lined to order any stay holding that it had no power to grant such a prayer. The assessee then moved the High Court under Art. 226 of the Constitution. The High Court held that the Tribunal had the power to stay the proceedings as also the collection of the penalties pending the appeal since that power was incidental and ancillary to its appellate jurisdiction. The Tribunal was consequently directed to dispose of the stay application in accord-ance with law.
The relevant provisions of the Act may be first noticed. Sec-tion 156 provides that when any tax, interest, penalty, fine or any other sum is payable in consequence of any order passed under the Act, the .Income tax Officer shall serve upon the assessee a notice of demand in the prescribed form specifying the sum so payable. Under s. 220( 1) any amount specified in the notice of demand under s. 156 has to be paid within 35 days of the service of the notice or within such lesser period as may be specified under the proviso to sub-s. ( l). If the amount is not paid within the period limited or extended (the assessee can ask for an extension) the assessee shall be deemed to be in default. Sub-section ( 6) of s. 220 provides that where an assessee has presented an appeal under s. 246 the Income-tax Officer may, in his discretion and subject to such conditions as he may think fit, treat the assessee as not being in default so long as the appeal remains pending .

Section 221 provides for the imposition of penalty when the asseesee·is in default. Sections 222 to 224 relate to the issuance of a certificate to the Tax Recovery Officer. Under s. 225 the Income tax Officer can order stay of proceedings, even after the certificate has been issued to the Tax Recovery Officer. It may be mentioned that the last four sections in terms relate to recovery of tax, but by virtue of s. 229 any penalty imposed is also reco-verable in the same manner. Section 246 to which referertce has been made in s. 220 ( 6) gives the appealable orders against which an assessee may appeal to the Appellate Assistant Commissioner. Appeals to the Tribunal are dealt with by ss. 252 to 255. Section 252 provides merely for constitution oi the Tribunal. Section 253 says that any assessee aggrieved by the orders set out in els. (a), (b) and ( c) of sub-s. ( 1) may appeal to the Tribunal. The Commissioner is also entitled to direct the Income-tax Officer to file an appeal against the order of an Appellate Assistant Com-missioner made under s. 250. Section 254 specifies the orders which the Tribunal can make. Sub-section ( 1) which is material may be reproduced below :-
"254. Orders of Appellate Tribunal.-(!) The Appellate Tribunal may, after giving both the parties to the appeal an opportunity of being heard, pass such orders thereon as it thinks fit."
Section 255 gives the procedure of the Appellate Tribunal. sections (5) and (6) of this section need alone be noticed.

ਧਾਰਾ 131 ਨੂੰ ਇਸ ਪੜਾਅ ਤੇ ਹਵਾਲਾ ਦਿੱਤਾ ਜਾ ਸਕਦਾ ਹੈ। ਇਹ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ, ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਅਤੇ ਕਮਿਸ਼ਨਰ ਨੂੰ ਉਹੀ ਸ਼ਕਤੀਆਂ ਦਿੰਦਾ ਹੈ ਜੋ ਅਦਾਲਤ ਨੂੰ ਸਿਵਲ ਪ੍ਰਕਿਰਿਆ ਸੰਹਿਤਾ ਅਧੀਨ ਮੁਕੱਦਮਾ ਚਲਾਉਣ ਸਮੇਂ ਹੁੰਦੀਆਂ ਹਨ, ਜਿਸ ਵਿੱਚ ਧਾਰਾ ਦਾ ਖਾਸ ਉਲੇਖ ਕਰਨਾ ਸ਼ਾਮਲ ਹੈ। ਪਰ ਇਹ ਸ਼ਕਤੀਆਂ ਗਵਾਹਾਂ ਦੀ ਹਾਜ਼ਰੀ ਨੂੰ ਲਾਜ਼ਮੀ ਬਣਾਉਣ, ਖਾਤਾ ਕਿਤਾਬਾਂ ਦੀ ਪੇਸ਼ਕਸ਼ ਨੂੰ ਮਜਬੂਰ ਕਰਨ, ਕਮਿਸ਼ਨ ਜਾਰੀ ਕਰਨ ਅਤੇ ਸਬੰਧਤ ਮਾਮਲਿਆਂ ਨਾਲ ਸਬੰਧਤ ਹਨ।
ਇਸ ਗੱਲ ਵਿੱਚ ਕੋਈ ਸ਼ੱਕ ਨਹੀਂ ਹੈ ਕਿ ਐਕਟ ਜਾਂ ਆਮਦਨ ਕਰ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨਿਯਮ, 1963 ਦੀਆਂ ਪ੍ਰਾਵਧਾਨਾਂ ਦੁਆਰਾ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਜੁਰਮਾਨਾ ਜਾਂ ਕਰ ਦੀ ਵਸੂਲੀ ਨਾਲ ਸਬੰਧਤ ਕਾਰਵਾਈਆਂ ਨੂੰ ਰੋਕਣ ਦੀ ਸ਼ਕਤੀ ਸਪੱਸ਼ਟ ਤੌਰ 'ਤੇ ਨਹੀਂ ਦਿੱਤੀ ਗਈ ਹੈ। ਇਸੇ ਸਮੇਂ ਇਹ ਮਹੱਤਵਪੂਰਣ ਹੈ ਕਿ ਧਾਰਾ 220(6) ਅਧੀਨ ਅਪੀਲ ਦੌਰਾਨ ਕਰਦਾਤਾ ਨੂੰ ਚੂਕ ਵਿੱਚ ਨਾ ਮੰਨਿਆ ਜਾਂਦਾ ਹੈ, ਇਹ ਸ਼ਕਤੀ ਕੇਵਲ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੂੰ ਦਿੱਤੀ ਗਈ ਹੈ ਜਦੋਂ ਧਾਰਾ 246 ਅਧੀਨ ਅਪੀਲ ਪੇਸ਼ ਕੀਤੀ ਗਈ ਹੋਵੇ ਜੋ ਕਿ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨੂੰ ਹੋਵੇਗੀ ਨਾ ਕਿ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ। ਧਾਰਾ 220 ਵਿੱਚ ਕੋਈ ਪ੍ਰਾਵਧਾਨ ਨਹੀਂ ਹੈ ਜਿਸ ਅਧੀਨ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਜਾਂ ਉਸ ਦੇ ਉੱਚ ਵਿਭਾਗੀ ਅਧਿਕਾਰੀ ਨੂੰ ਜੁਰਮਾਨਾ ਜਾਂ ਕਰ ਦੀ ਵਸੂਲੀ ਵਿੱਚ ਰੁਕਾਵਟ ਲਈ ਬੇਨਤੀ ਕੀਤੀ ਜਾ ਸਕੇ। ਇਹ ਹੋ ਸਕਦਾ ਹੈ ਕਿ ਧਾਰਾ 225 ਦੇ ਬਾਵਜੂਦ ਕਰ ਵਸੂਲੀ ਅਧਿਕਾਰੀ ਨੂੰ ਕਿਸੇ ਵੀ ਕਰ (ਜੁਰਮਾਨਾ ਨਾਲ ਸਬੰਧਤ ਸਥਿਤੀ ਵੀ ਇਸੇ ਤਰ੍ਹਾਂ ਦੀ ਹੋਵੇਗੀ) ਦੀ ਵਸੂਲੀ ਲਈ ਸੁਧਾਈ ਜਾਰੀ ਕੀਤੀ ਗਈ ਹੈ, ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਕਰ ਦੀ ਅਦਾਇਗੀ ਲਈ ਸਮਾਂ ਦੇ ਸਕਦਾ ਹੈ। ਇਸ ਤਰ੍ਹਾਂ ਉਹ ਸ਼ਾਇਦ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਅਪੀਲ ਦੇ ਨਿਪਟਾਰੇ ਤੱਕ ਵਾਰ-ਵਾਰ ਵਾਧੇ ਦੇ ਸਕਦਾ ਹੈ। ਇਹ ਵੀ ਹੋ ਸਕਦਾ ਹੈ ਕਿ ਵਿਭਾਗ ਵਿੱਚ ਪ੍ਰਚਲਿਤ ਅਭਿਆਸ ਦੇ ਅਨੁਸਾਰ ਕਮਿਸ਼ਨਰ ਜਾਂ ਨਿਰੀਖਣ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਪ੍ਰਸ਼ਾਸਕੀ ਸ਼ਕਤੀਆਂ ਦੀ ਕਸਰਤ ਕਰਦਿਆਂ ਕਰਦਾਤਾ ਨੂੰ ਵਸੂਲੀ ਰੋਕਣ ਦੀ ਜ਼ਰੂਰੀ ਰਾਹਤ ਦੇ ਸਕਦੇ ਹਨ ਪਰ ਇਹ ਕਾਨੂੰਨੀ ਸ਼ਕਤੀ ਦੇ ਤੌਰ 'ਤੇ ਨਹੀਂ ਰੱਖੀ ਜਾ ਸਕਦੀ ਜਿਵੇਂ ਕਿ ਧਾਰਾ 220(6) ਵਿੱਚ ਸਿਰਫ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਦੇ ਸਾਹਮਣੇ ਅਪੀਲ ਦੇ ਲੰਬਿਤ ਹੋਣ ਦੇ ਪੜਾਅ ਤੱਕ ਹੀ ਸੀਮਿਤ ਹੈ।
ਸਾਡੇ ਸਾਹਮਣੇ ਅਪੀਲਕਰਤਾ ਵੱਲੋਂ ਪੇਸ਼ ਕੀਤੀ ਗਈ ਦਲੀਲ ਕਿ ਐਕਟ ਦੀਆਂ ਧਾਰਾਵਾਂ 254 ਅਤੇ 255 ਵਿੱਚ ਅਪੀਲ ਦੇ ਲੰਬਿਤ ਹੋਣ ਦੌਰਾਨ ਵਸੂਲੀ ਨੂੰ ਰੋਕਣ ਦੇ ਸਪੱਸ਼ਟ ਪ੍ਰਾਵਧਾਨ ਨਾ ਹੋਣ ਕਾਰਨ ਇਹ ਮੰਨਿਆ ਜਾਵੇ ਕਿ ਟ੍ਰਿਬਿਊਨਲ ਵੱਲੋਂ ਅਜਿਹੀ ਸ਼ਕਤੀ ਦੀ ਕਸਰਤ ਨਹੀਂ ਕੀਤੀ ਜਾ ਸਕਦੀ, ਇੱਕ ਮੌਲਿਕ ਖਾਮੀ ਨਾਲ ਪੀੜਤ ਹੈ ਕਿਉਂਕਿ ਇਹ ਮਾਨ ਕੇ ਚੱਲਦੀ ਹੈ ਅਤੇ ਇਸ ਧਾਰਣਾ 'ਤੇ ਆਧਾਰਿਤ ਹੈ ਕਿ ਕਾਨੂੰਨ ਅਜਿਹੀ ਸ਼ਕਤੀ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੂੰ ਦਿੰਦਾ ਹੈ ਜੋ ਜ਼ਰੂਰੀ ਰਾਹਤ ਦੇ ਸਕਦਾ ਹੈ, ਮੈਕਸਵੈਲ ਦੀ ਕਾਨੂੰਨੀ ਵਿਆਖਿਆ ਦੀ ਗਿਆਰਵੀਂ ਐਡੀਸ਼ਨ ਵਿੱਚ ਪੰਨਾ 350 'ਤੇ ਇੱਕ ਬਿਆਨ ਹੈ ਕਿ "ਜਦੋਂ ਕੋਈ ਐਕਟ ਕਿਸੇ ਅਧਿਕਾਰ ਖੇਤਰ ਨੂੰ ਦਿੰਦਾ ਹੈ, ਤਾਂ ਇਹ ਅਨੁਮਾਨਤ ਰੂਪ ਵਿੱਚ ਉਹ ਸਾਰੇ ਕੰਮ ਕਰਨ ਦੀ ਸ਼ਕਤੀ ਵੀ ਦਿੰਦਾ ਹੈ, ਜਾਂ ਅਜਿਹੇ ਸਾਧਨਾਂ ਦੀ ਵਰਤੋਂ ਕਰਨ ਦੀ ਸ਼ਕਤੀ ਦਿੰਦਾ ਹੈ ਜੋ ਇਸ ਦੇ ਨਿਰਵਾਹ ਲਈ ਜ਼ਰੂਰੀ ਹਨ। Cujus jurisdictio data est, eoq quoaq counse ann esse vinctur, sine quibus judicium exerceri non potuit." ਕੁਝ ਫੈਸਲਿਆਂ ਵਿੱਚ ਜੋ Ex parte Martini(n) ਦੇ ਆਧਾਰ 'ਤੇ ਦਿੱਤੇ ਗਏ ਹਨ, ਇਹ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ "ਜਦੋਂ ਇੱਕ ਹੇਠਲੀ ਅਦਾਲਤ ਨੂੰ ਰੋਕ ਦੇਣ ਦੀ ਸ਼ਕਤੀ ਦਿੱਤੀ ਜਾਂਦੀ ਹੈ, ਤਾਂ ਇਸ ਨੂੰ

Section 131 may at this stage be referred to. It gives to the Income tax Officer, the Appellate Assistant Commissioner and the Commissioner the same powers as are vested in the court under the Code of ·Civil Procedure when trying a suit in respect of the matters specified in the section. But these powers relate to dis-covery and inspection; enforcing the attendance of witnesses; compelling production of books of account etc.; issuing commis-sions and allied matters.
There can be no manner of doubt that by the provisions of the Act or the Income-tax Appellate Tribunal Rules, 1963 powers have not been eXpressly conferred upon the Appellate Tribunal to stay proceedings relating to the recovery of penalty or tax due from an assessee. At the same time it is significant that under s. 220 ( 6) the power of stay by treating the assessee as not being in default during the pendency of an appeal has been given to the Income-tax Officer only when an appeal has been presented under s. 246 which will be ·to the Appellate Assistant Commissioner and not to the Appellate Tribunal. There is no provision in s. 220 under which the Income-tax Officer or any of his superior depart-mental officers can be moved for granting stay in the recovery of penalty or tax. It may be that under s. 225 notwithstanding that a certificate has been issued to the Tax Recovery Officer for the recovery of any tax (the position will be the same with regard to penalty) the Income tax Officer may grant time for the pay-ment of the tax. In this manner he can probably keep on granting extensions until the disposal of the appeal by the Tribunal. It may also be that as a matter of practice prevailing in the department the Commissioner or the Inspecting Assistant Commissioner in exercise of administrative powers can give the necessary relief of staying recovery to the assessee but that can hardly be put at par with a statutory power as is contained in s. 220(6) which is confined only to the stage of pendency of an appeal before the Appellate Assistant Commissioner . •
The argument advanced on behalf of the appellant before us that in the absence of any express provisions in ss. 254 and 255 of the Act relating to stay of recovery during the pendency of an appeal it must be held that no such power can be exercised by the Tribunal, suffers from a fundamental infinnity inasmuch as it assumes and proceeds on the premise that the statute confers such ~ power on the Income-tax Officer who can give the necessary

"ਮੇਰੇ ਵਿਚਾਰ ਵਿੱਚ ਸਿਦਾਂਤ ਤੌਰ 'ਤੇ ਅਦਾਲਤ ਨੂੰ ਸਾਰੀਆਂ ਅਦਾਲਤੀ ਸ਼ਕਤੀਆਂ ਹੋਣੀਆਂ ਚਾਹੀਦੀਆਂ ਹਨ, ਕਿਉਂਕਿ ਇਸ ਸਿਦਾਂਤ ਦਾ ਆਧਾਰ ਹੈ ਕਿ ਮੁਕੱਦਮੇ ਦੌਰਾਨ ਸੰਪਤੀ ਦੀ ਸੁਰੱਖਿਆ ਲਈ ਆਦੇਸ਼ ਇਹ ਹੈ ਕਿ ਸਫਲ ਪਾਰਟੀ ਨੂੰ ਹੋਣਾ ਚਾਹੀਦਾ ਹੈ।" ਅਪੀਲਕਾਰਤਾ ਚਾਹੁੰਦਾ ਹੈ, ਹਾਲਾਂਕਿ, ਜਿਸ ਮੁਸ਼ਕਿਲ ਵਿੱਚ ਮਹਿਸੂਸ ਕੀਤਾ ਗਿਆ ਸੀ ਕਿ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਅਪੀਲ ਦੌਰਾਨ ਵਸੂਲੀ ਨੂੰ ਰੋਕਣ ਦੀ ਸ਼ਕਤੀ ਨਹੀਂ ਸੀ। ਵੇਚਾ ਸ੍ਰੀਰਾਮੂਰਤੀ ਬਨਾਮ ਇਨਕਮ ਅਫਸਰ ਵਿਸ਼ਿਆਨਗਰਮ & ਦੂਜਾ, ਕਰਦਾਤਾ ਨੂੰ ਇੱਕ ਰਿਟ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕਰਨੀ ਪਈ ਕਿਉਂਕਿ ਟ੍ਰਿਬਿਊਨਲ ਦੀ ਅਪੀਲ ਦੌਰਾਨ ਕਰ ਦੀ ਵਸੂਲੀ ਨੂੰ ਰੋਕਿਆ ਨਹੀਂ ਗਿਆ ਸੀ। ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਮੁੱਖ ਤੌਰ 'ਤੇ ਭਾਰਤੀ ਇਨਕਮ-ਟੈਕਸ ਐਕਟ, 1922 ਦੀ ਧਾਰਾ 45 ਦੁਆਰਾ ਦਿੱਤੀ ਗਈ ਵਿਵੇਕਸ਼ੀਲ ਸ਼ਕਤੀ ਦੇ ਦਾਇਰੇ 'ਤੇ ਵਿਵਾਦ ਸੀ। ਇਹ ਫੈਸਲਾ ਕੀਤਾ ਗਿਆ ਸੀ ਕਿ ਇੱਕ ਰਿਟ ਪਟੀਸ਼ਨ ਇਨਕਮ-ਟੈਕਸ ਅਫਸਰ ਨੂੰ ਧਾਰਾ 45 ਅਧੀਨ ਆਪਣੀ ਵਿਵੇਕਸ਼ੀਲਤਾ ਦੀ ਵਰਤੋਂ ਕਰਨ ਲਈ ਜਾਂ ਇਸਨੂੰ ਇਮਾਨਦਾਰੀ ਅਤੇ ਉਦੇਸ਼ਪੂਰਨ ਤਰੀਕੇ ਨਾਲ ਵਰਤਣ ਲਈ ਮਜਬੂਰ ਕਰ ਸਕਦੀ ਹੈ। ਪਰ ਮੈਰਿਟਾਂ 'ਤੇ ਅਦਾਲਤ ਨੇ ਰਿਟ ਜਾਰੀ ਕਰਨ ਤੋਂ ਇਨਕਾਰ ਕਰ ਦਿੱਤਾ। ਵਿਸ਼ਵਨਾਥ ਸਾਸਤ੍ਰੀ ਜੇ., ਆਪਣੇ ਅਲੱਗ ਫੈਸਲੇ ਵਿੱਚ ਪੰਨਾ 271 ਤੇ ਨਿਮਨਲਿਖਿਤ ਟਿੱਪਣੀਆਂ ਕੀਤੀਆਂ:
"ਅੰਤ ਵਿੱਚ ਇਹ ਦੇਖਣਾ ਪਵੇਗਾ ਕਿ ਆਮਦਨ ਕਰ ਐਕਟ ਦੀ ਧਾਰਾ 45 ਆਪਣੇ ਸ਼ਬਦਾਂ ਵਿੱਚ ਕੁਝ ਗੁੰਝਲਦਾਰ ਹੈ ਅਤੇ ਸਿਰਫ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੂੰ ਇੱਕ ਵਿਅਕਤੀ ਨੂੰ ਅਪੀਲ ਦੌਰਾਨ ਡਿਫਾਲਟਰ ਨਾ ਹੋਣ ਦਾ ਐਲਾਨ ਕਰਨ ਦੀ ਸ਼ਕਤੀ ਦਿੰਦੀ ਹੈ। ਸਿਵਲ ਪ੍ਰਕ੍ਰਿਆ ਕੋਡ ਦੇ ਆਰਡਰ ਐਕਸ.ਐਲ.ਆਈ, ਨਿਯਮ 5 ਅਤੇ 6 ਵਾਂਗ ਰੁਕਾਵਟ ਲਈ ਕੋਈ ਪ੍ਰਾਵਧਾਨ ਨਹੀਂ ਹੈ। ਟੈਕਸ ਦੀ ਵਸੂਲੀ ਨੂੰ ਰੋਕਣ ਦੀ ਸਪੱਸ਼ਟ ਸ਼ਕਤੀ ਦੀ ਦਾਤ ਨਹੀਂ ਹੈ, ਹਾਲਾਂਕਿ ਧਾਰਾ 45 ਅਧੀਨ ਅਸੈਸੀ ਦੇ ਹੱਕ ਵਿੱਚ ਹੁਕਮ ਦਾ ਅਸਰ ਰੁਕਾਵਟ ਹੈ। ਨਾ ਹੀ ਟੈਕਸ ਨੂੰ ਕਿਸ਼ਤਾਂ ਵਿੱਚ ਭਰਨ ਦੀ ਆਗਿਆ ਦੇਣ ਜਾਂ ਮੁਲਤਵੀ ਭੁਗਤਾਨ ਲਈ ਸੁਰੱਖਿਆ ਲੈਣ ਦਾ ਕੋਈ ਪ੍ਰਾਵਧਾਨ ਹੈ। ਨਾ ਹੀ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਅਤੇ ਨਾ ਹੀ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਟੈਕਸ ਦੀ ਵਸੂਲੀ ਨੂੰ ਰੋਕਣ ਦੀ ਸ਼ਕਤੀ ਦਿੱਤੀ ਗਈ ਹੈ। ਕਿ ਕਾਨੂੰਨ ਨੂੰ ਹੋਰ ਉਦਾਰ ਬਣਾਇਆ ਜਾਵੇ ਤਾਂ ਜੋ ਕਿ ਇੱਕ ਅਪੀਲ ਕਰਨ ਵਾਲਾ ਅਸੈਸੀ, ਉਚਿਤ ਸੁਰੱਖਿਆ ਦੇਣ ਦੁਆਰਾ, ਟੈਕਸ ਦੀ ਵਸੂਲੀ ਨੂੰ ਪੂਰੀ ਤਰ੍ਹਾਂ ਜਾਂ ਕੁਝ ਹਿੱਸੇ ਵਿੱਚ ਰੋਕਣ ਲਈ ਅਪੀਲੀ ਫੋਰਮ ਤੋਂ ਰੁਕਾਵਟ ਪ੍ਰਾਪਤ ਕਰ ਸਕੇ, ਇਹ ਵਿਚਾਰਣ ਦੀ ਗੱਲ ਹੈ।"
ਇਹ ਦਿਲਚਸਪ ਹੈ ਕਿ ਇੱਕ ਹੋਰ ਕੇਸ ਪੋਲੀਸੈਟੀ ਨਾਰਾਇਣ ਰਾਓ ਬਨਾਮ ਆਮਦਨ ਕਰ ਕਮਿਸ਼ਨਰ, ਹੈਦਰਾਬਾਦ(i) ਵਿੱਚ, ਉਸੇ ਉੱਚ ਅਦਾਲਤ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਕੇਸ ਨੂੰ ਉੱਚ ਅਦਾਲਤ ਵਿੱਚ ਭੇਜਣ ਦੌਰਾਨ ਰੁਕਾਵਟ ਦਿੱਤੀ ਜਾ ਸਕਦੀ ਹੈ। ਇਹ ਸ਼ਕਤੀ ਉੱਚ ਅਦਾਲਤ ਕੋਲ
ਸਿਵਲ ਪ੍ਰਕ੍ਰਿਆ ਕੋਡ ਦੀ ਧਾਰਾ 151 ਅਤੇ ਸੰਵਿਧਾਨ ਦੇ ਅਨੁਚਿੱਤ 227 ਅਧੀਨ ਸੀ।
ਉੱਚ ਅਦਾਲਤ ਨੇ, ਮੌਜੂਦਾ ਮਾਮਲੇ ਵਿੱਚ, ਹਾਲਜ਼ਬਰੀ ਦੇ ਇੰਗਲੈਂਡ ਦੇ ਕਾਨੂੰਨਾਂ, ਤੀਜੇ ਐਡੀਸ਼ਨ, ਖੰਡ 20, ਪੰਨਾ 705 ਤੋਂ ਇੱਕ ਗੁਜ਼ਾਰਸ਼ ਦਾ ਹਵਾਲਾ ਦਿੱਤਾ ਜਿੱਥੇ ਇਹ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ "ਜਦੋਂ ਤੱਕ ਅਪੀਲ ਦਾ ਵਿਸ਼ਾ ਮੁੱਦਾ ਹੈ, ਕੋਈ ਟੈਕਸ ਅਦਾਇਗੀ ਯੋਗ ਨਹੀਂ ਹੈ ਸਿਵਾਏ ਉਸ ਟੈਕਸ ਦੇ ਜੋ ਅਪੀਲ ਦੁਆਰਾ ਸਮਝੌਤੇ ਦੇ ਵਿਸ਼ਾ ਦੇ ਤੌਰ ਤੇ ਵਿਵਾਦ ਵਿੱਚ ਨਹੀਂ ਹੈ।" ਇਹ ਬਿਆਨ ਸਪਸ਼ਟ ਤੌਰ 'ਤੇ ਅੰਗਰੇਜ਼ੀ ਸਟੈਚਿਊਟਾਂ ਦੀਆਂ ਧਾਰਾਵਾਂ 'ਤੇ ਆਧਾਰਿਤ ਹੈ ਅਤੇ ਇਸ ਤੋਂ ਕੋਈ ਮਦਦ ਲੈਣਾ ਸੰਭਵ ਨਹੀਂ ਹੈ।
ਐਕਟ ਦੀ ਧਾਰਾ 255(5) ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਆਪਣੀ ਖੁਦ ਦੀ ਪ੍ਰਕਿਰਿਆ ਨੂੰ ਨਿਯੰਤਰਿਤ ਕਰਨ ਦੀ ਸ਼ਕਤੀ ਦਿੰਦੀ ਹੈ, ਪਰ ਇਹ ਬਹੁਤ ਸ਼ੱਕੀ ਹੈ ਕਿ ਉਸ ਪ੍ਰਾਵਧਾਨ ਤੋਂ ਰੁਕਾਵਟ ਦੀ ਸ਼ਕਤੀ ਨੂੰ ਸਪੱਸ਼ਟ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ। ਸਾਡੀ ਰਾਏ ਵਿੱਚ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਆਪਣੇ ਅਪੀਲੀ ਅਧਿਕਾਰ ਦੇ ਸਹਾਇਕ ਜਾਂ ਸੰਬੰਧਿਤ ਕਿਸੇ ਵੀ ਸ਼ਕਤੀ ਨੂੰ ਦੇਣ ਦੀ ਸ਼ਕਤੀ ਹੋਣੀ ਚਾਹੀਦੀ ਹੈ। ਇਹ ਖਾਸ ਤੌਰ 'ਤੇ ਤਦ ਹੈ ਜਦੋਂ ਐਸ. 220(6) ਸਪੱਸ਼ਟ ਤੌਰ 'ਤੇ ਉਸ ਸਥਿਤੀ ਨਾਲ ਨਿਪਟਦਾ ਹੈ ਜਦੋਂ ਅਪੀਲ ਅਪੀਲੇਟ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਅੱਗੇ ਲੰਬਿਤ ਹੈ, ਪਰ ਐਕਟ ਇਸ ਗੱਲ ਤੋਂ ਚੁੱਪ ਹੈ ਕਿ ਜਦੋਂ ਅਪੀਲ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਅੱਗੇ ਲੰਬਿਤ ਹੈ। ਇਹ ਕਿਹਾ ਜਾ ਸਕਦਾ ਹੈ ਕਿ ਜਦੋਂ ਐਸ. 254 ਅਪੀਲੀ ਅਧਿਕਾਰ ਦਿੰਦਾ ਹੈ, ਤਾਂ ਇਹ ਅਨੁਮਾਨਿਤ ਤੌਰ 'ਤੇ ਉਹ ਸਾਰੇ ਕੰਮ ਕਰਨ ਦੀ ਸ਼ਕਤੀ ਦਿੰਦਾ ਹੈ ਜਾਂ ਉਹਨਾਂ ਸਾਧਨਾਂ ਦੀ ਵਰਤੋਂ ਕਰਨ ਦੀ ਸ਼ਕਤੀ ਦਿੰਦਾ ਹੈ ਜੋ ਇਸ ਦੇ ਕਾਰਜਨ ਲਈ ਜ਼ਰੂਰੀ ਹਨ ਅਤੇ ਕਾਨੂੰਨੀ ਸ਼ਕਤੀ ਨਾਲ ਉਚਿਤ ਮਾਮਲਿਆਂ ਵਿੱਚ ਅਜਿਹੇ ਹੁਕਮ ਦੇਣ ਦੀ ਜ਼ਿੰਮੇਵਾਰੀ ਆਉਂਦੀ ਹੈ ਜੋ ਕਾਰਵਾਈਆਂ ਨੂੰ ਰੋਕਣ ਲਈ ਹਨ ਤਾਂ ਜੋ ਅਪੀਲ ਨੂੰ ਸਫਲ ਹੋਣ ਤੋਂ ਰੋਕਿਆ ਜਾ ਸਕੇ।
ਐਕਟ ਨੂੰ ਲਾਗੂ ਕਰਨ ਵਾਲੇ ਅਧਿਕਾਰੀਆਂ ਦੇ ਮਨਾਂ ਵਿੱਚ ਇੱਕ ਨਿਸ਼ਚਿਤ ਚਿੰਤਾ ਪੈਦਾ ਹੋ ਸਕਦੀ ਹੈ ਕਿ ਜੇਕਰ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਕਰਾਂ ਜਾਂ ਜੁਰਮਾਨਿਆਂ ਦੀ ਵਸੂਲੀ ਨੂੰ ਰੋਕਣ ਦੀ ਸ਼ਕਤੀ ਦਿੱਤੀ ਜਾਵੇ ਤਾਂ ਰਾਜਸਵ ਨੂੰ ਅਪੀਲੇਟ ਟ੍ਰਿਬਿਊਨਲਾਂ ਦੁਆਰਾ ਅਪੀਲਾਂ ਦੇ ਨਿਪਟਾਰੇ ਵਿੱਚ ਹੋਣ ਵਾਲੀ ਅਸਾਧਾਰਣ ਦੇਰੀ ਕਾਰਨ ਵੱਡਾ ਨੁਕਸਾਨ ਹੋ ਸਕਦਾ ਹੈ। ਇਹ ਕਹਿਣਾ ਬੇਕਾਰ ਹੈ ਕਿ ਟ੍ਰਿਬਿਊਨਲ ਦੁਆਰਾ ਰੁਕਾਵਟ ਦੀ ਸ਼ਕਤੀ ਦਾ ਪ੍ਰਯੋਗ ਰੁਟੀਨ ਤਰੀਕੇ ਨਾਲ ਜਾਂ ਆਮ ਤੌਰ 'ਤੇ ਨਹੀਂ ਕੀਤਾ ਜਾਵੇਗਾ, ਕਰ ਅਤੇ ਰਾਜਸਵ ਕਾਨੂੰਨਾਂ ਦੀ ਖਾਸ ਕਿਸਮ ਦੇ ਮੱਦੇਨਜ਼ਰ। ਇਹ ਸਿਰਫ ਉਦੋਂ ਹੀ ਹੋਵੇਗਾ ਜਦੋਂ ਇੱਕ ਮਜ਼ਬੂਤ ਪ੍ਰਾਥਮਿਕ ਪ੍ਰਮਾਣ ਪੇਸ਼ ਕੀਤਾ ਜਾਵੇਗਾ ਕਿ ਟ੍ਰਿਬਿਊਨਲ ਵਿਚਾਰ ਕਰੇਗਾ ਕਿ ਵਸੂਲੀ ਕਾਰਵਾਈਆਂ ਨੂੰ ਰੋਕਣਾ ਹੈ ਜਾਂ ਨਹੀਂ ਅਤੇ ਕਿਹੜੀਆਂ ਸ਼ਰਤਾਂ 'ਤੇ ਅਤੇ ਰੁਕਾਵਟ ਦੀ ਮਨਜ਼ੂਰੀ ਸਭ ਤੋਂ ਯੋਗ ਅਤੇ ਉਚਿਤ ਮਾਮਲਿਆਂ ਵਿੱਚ ਦਿੱਤੀ ਜਾਵੇਗੀ ਜਿੱਥੇ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਸੰਤੁਸ਼ਟ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ ਪੂਰੇ ਉਦੇਸ਼ ਦੀ ਅਪੀਲ ਨੂੰ ਨਿਰਰਥਕ ਜਾਂ ਨਿਰਰਥਕ ਬਣਾਉਣਾ ਹੈ ਜੇ ਵਸੂਲੀ ਕਾਰਵਾਈਆਂ ਨੂੰ ਅਪੀਲ ਦੀ ਲੰਬਿਤਤਾ ਦੌਰਾਨ ਜਾਰੀ ਰੱਖਿਆ ਜਾਵੇ।

A relief to an assessee. The right of appeal is a substantive right and the questions of fact and law are at large and are open to review by the Appellate Tribunal. Indeed the Tribunal has been given very wide powers under s. 254 ( 1) for it may pass such orders as it thinks fit after giving full hearing to both the parties to the appeal. If the Income-tax Officer and the Appellate Assis-B tant Commissioner have made assessments or imposed penalties raising very large demands and if the Appellate Tribunal is entirely helpless in the matter of stay or recovery the entire purpose of the appeal can be defeated if ultimately the orders of the departmental authorities are set aside. It is difficult to conceive that the Legis-lature should have left the entire matter to the administrative c authorities to make such orders as they choose to pass in exercise of unfettered discretion. The assessee, as has been pointed' out before, has no right to even move an application when an appeal is pending before the Appellate Tribunal under s. 220 ( 6) and it is only at the earlier stage of appeal before the Appellate Assistant Commissioner that the statute provides for such a matter being dealt with by the Income-tax Officer. It is a firmly established D rule that an express grant of statutory power carries with it by necessary implication the authority to use all reasonable means to make such grant efl'ectivc (Sutherland Statutory Construction, Third Edition, Arts. 5401 and 5402). The powers which have been conferred by s. 254 on the Appellate Tribunal with widest possible amplitude must carry with them by necessary implication E all powers and duties incidental and necessary to make the exer-cise of those powers fully effective. In Domat's Civil Law Cush-ing's Edition, Vol. 1 at page 88, it has been stated:
"It is the duty of the Judges to apply the laws, not only to what appears to be regulated b~ their express dispositions, but to all the cases where a just applica-F tion of them may be made, and which appear to be comprehended either within the consequences that may be gathered from it."
Maxwell on Interpretation of Statutes, Eleventh Edition, contains a statement at p. 350 that "where an Act confers a jurisdiction, G it impliedly also grants the power of doing all such acts, or em-ploying such means, as are essentially necessary to its execution. Cui jurisdictio data est, ea quoque concessa esse videntur, sine quibus jurisdictio exp/icari non potuit." An instance is given based on Ex. parte Martin(') that "where an inferior court is empowered to grant an injunction, the power of pnnishing dis-obedience to it by commitment is impliedly conveyed by the en-H actment, for the power would be useless if it could not be enforced."
