Lodha, for the applicant. <<>> BY THE COURT: Having regard to the circumstances of the case, the shortdelay in filing the present application seeking restoration of D.B.Income Tax Appeal No. 26/2012 is condoned and theapplication for condonation (CMCC No. 471/2013) is allowed,subject to all just exceptions. After having heard the learned counsel for the applicantand having gone through the grounds stated in the applicationsupported by the affidavit of the counsel, we are satisfied thatthe earlier default in appearance at the time of hearing of D.B.Income Tax Appeal No. 26/2012 had been for bona fide reasonsand had not been intentional. It shall be in the interest of justiceto restore the said appeal to its regular number. Accordingly, this restoration application is allowed. D.B.Income Tax Appeal No. 26/2012 is ordered to be restored to itsnumber. The other connected appeals having been disposed oftoday, the said appeal be also placed on the Board todayitself. (V.K.
