The judgment of the Tribunal is based on an earlier judgment of the Tribunal as referred in Paragraph 5 of the judgment under appeal. This earlier order of the Tribunal was passed in respect of the selfsame assessee for the assessment year 2001-2002. That has been confirmed by a Division Bench of this Court in Commissioner of Income Tax Vs. Clough Engineering Ltd. reported in 2008 (300) ITR 0435-UTT. Same issue has been raised in the present appeal. We decide the same against the appellants by following the said judgment of this Court and, thereby, dispose of the appeal.
