Since appeal filed against same assessee raising the samequestions for other years stands remanded vide our judgment in I.T.ANo.1554/2009, without issuing notice to the assessee, we allow theappeal by setting aside the orders of the Tribunal and that of the firstappellate authority and remand the case to the Assessing Officer forreconsidering the issues raised after giving opportunity to the assesseebased on judgment abovereferred. The Assessing Officer will serve acopy of the judgment on the assessee along with notice proposingrevision of assessment.
