THIS APPEAL COMING ON FOR ORDERS THIS DAY,ARAVIND KUMAR J, DELIVERED THE FOLLOWING : JUDGMENT Though matter is listed for Admission by consent of learned Advocates appearing for parties it is taken up for final disposal. 2. Assessee being aggrieved by the order dated 19.05.2017 passed by the Income Tax Appellate Tribunal (for short ‘ITAT’) in ITA No.171/B/2017, is before this Court whereunder several questions of fact has been raised. As could be seen from the order of ITAT assessee remained absent before the tribunal. Said second appeal was filed by the assessee before tribunal being aggrieved by the order of CIT (A) dated 25.11.2016– Annexure-D. Even before CIT (A) assessee remained absent, as such both the authorities left with no other option have proceeded to pass orders dismissing the appeal. However, taking into consideration the reasons assigned for the absence of assessee before jurisdictional CIT (A), we deem it proper to afford/extend one more opportunity to appellant/assessee to buttress his arguments before the CIT (A). As such order dated 19.05.2017 passed by ITAT as well as order dated 25.11.2016 passed by CIT (A) deserves to be set aside and matter deserves to be remitted to CIT(A) for adjudication afresh on merits.
