Ramachandran Nair,J:
Even though the issue raised by the revenue intheir appeal is covered by a decision of the SupremeCourt in their favour, we are unable to entertain theappeal because of the prohibition against maintainabilityof appeal under instruction No.1979, issued by theCentral Board of Direct Taxes ('the CBDT' for short) videCircular F.No.279/126/98-ITJ, dated March 27, 2000,under which appeal to the High Court is maintainableonly if the tax effect is above Rs.2 lakhs. Since the taxinvolved in this case is below Rs.1 lakh, the appeal isdismissed as not maintainable.
