JUDGMENT This is an appeal filed by the Revenue challenging the order passedby the Income Tax Appellate Tribunal, Cochin Bench confirming the orderof the Commissioner of Income Tax (Appeals) setting aside the levy of thepenalty under Section 271C of the Income Tax Act. 2. The questions raised in this appeal are already decided by thisCourt in the common judgment dated 03.07.2015 in I.T.A. Nos. 139 and177 of 2013, which was also followed in I.T.A. No. 57 of 2007. 3. In the light of the above, the orders passed by theCommissioner of Income Tax (Appeals) and the Tribunal deserve to beset aside. Accordingly, answering the questions of law in favour of theassessee, this appeal is disposed of. The registry will append copies of the judgments in I.T.A.
