08. 04.12.2019 Heard Mr. T.K. Satapathy, learned Sr. Standing Counsel for the Income Tax Department-petitioner (appellant). Income Tax Department has filed this appeal assailing the order dated 14.02.2013, passed by the Income Tax Appellate Tribunal, Cuttack Bench, Cuttack in I.T.A. No.461/CTK/2011. By virtue of the impugned order, the Tribunal allowed the appeal filed by the assessee in respect of assessment year 2008-09 and directed the Assessing Officer to accept the NIL revised return for the said year and further restored the appeals for the assessment year 2006-07 and 2007-08 to file and directed to the Assessing Officer to consider the matter afresh in terms of the decision for the assessment year 2008-09. We have heard the learned counsel for the parties and find no infirmity in the order passed by the ITAT. Thus, it is directed that the Assessing Officer shall consider the matter in view of the order dated 14.02.2013 passed in I.T.A.
