JUDGMENT:(per Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta )
We have heard Sri Ravindra Chenji, learned Counsel for theappellant, and gone through the impugned judgment and order ofthe learned Tribunal.
We do not find any reason to interfere with the judgment andorder of the learned Tribunal, as the learned Tribunal thought it fit,in its own discretion, not to exercise its discretion and, as suchdisallowed the recall application. Moreover, we find from thejudgment and order, which was sought to be recalled, that almostall the issues have been remanded for fresh consideration. We donot find any merit in this appeal.
Accordingly, the appeal is dismissed. No order as to costs.
