We have heard Mr. J.V. Prasad, learned counsel for theappellant-Revenue and gone through the impugned judgment andorder of the learned Tribunal.
It appears that the learned Tribunal has decided the matterwhile following its own earlier decision. It is submitted by thelearned counsel for the appellant-Revenue that the earlier decision,which has been followed by the Tribunal, has been taken to appealbefore this Court. However, there has been no document with thelearned counsel in that regard. Therefore, we cannot admit thisappeal.
Accordingly, the appeal is dismissed. However, it would beopen for the Department to take steps afresh as may be advised.
No order as to costs. Miscellaneous Petitions pending, if any, shallstand closed.
