Narasimha Sarma, learned counsel for theappellant and have gone through the impugned judgment and order of thelearned Tribunal. It appears that the learned Tribunal while passing the impugned orderhas relied on its own judgment in the case of Y. Sivarama Krishna in ITA.Nos. 969 and 970/Hyd/08, dated 07.11.2008. The appeal against the earlierdecision was dismissed by this Court. Hence, the decision rendered in theearlier case has attained its finality.
