ORDER: (per Hon’ble Sri Justice C.V.Nagarjuna Reddy)
This appeal by the Revenue is filed against common order, dated 09.12.2016, to the extent it pertains to ITA.No.177/Vizag/2015 on the file of the Income Tax Appellate Tribunal, Visakhapatnam Bench, Visakhapatnam (for short ‘the Tribunal’).
At the hearing, Mr. K.Raji Reddy, learned Senior Standing Counsel for the Income Tax Department, has fairly conceded that ITTA.No.742 of 2017 filed by the Revenue against the same common order in ITA.No.178/Vizag/2015 was dismissed by this Court by order, dated 29.11.2017. He further admitted that the issues decided by the Tribunal are common in both the appeals.
As ITTA.No.742 of 2017 arising out of common order, dated 09.12.2016, in ITA.No.178/Vizag/2015 was already dismissed, for the same reasons, this appeal is also dismissed with the direction that the reasons contained therein shall form part of this order.
