The order — as passed by the High Court

- 1 - IN THE HIGH COURT OF JUDICATURE AT BOMBAY O.O.C.J. INCOME TAX APPEAL NO.133 OF 2008 ----------------------------------------------------- Office Notes, Office Memoranda of Coram, Court’s or Judge’s appearances, Court’s orders order or directions ----------------------------------------------------- ¦ Mr.B.M.Chaterjee for the ¦ Appellant. ¦ Ms.Priti Shukla i/b Sameer Dalal ¦ for the Respondent. ¦ ¦ CORAM: D.K.DESHMUKH & ¦ J.P.DEVADHAR,JJ. ¦ DATED:24TH JULY, 2008 P.C.: Heard the learned Counsel for the appellant. Perused the order, which is a detailed and well-reasoned order of the tribunal. The tribunal has relied on the view taken by the tribunal in the case of Respondent’s wife. Therefore, we asked the learned Counsel appearing for the Appellant to tell us what has been done in relation to the decision of the tribunal in the case of Respondent’s wife. Last time, the - 2 - learned Counsel sought time to find out the position. But even today he is not in a position to say anything in this regard. As the record stands, it appears that the order passed by the tribunal in the case of the Respondent’s wife has gone unchallenged, in our opinion, therefore, it will not be appropriate to entertain the appeal. Appeal disposed of. (D.K.DESHMUKH, J.) (J.P.DEVADHAR,J.)
