IN THE HIGH COURT OF JUDICATURE AT BOMBAYORDINARY ORIGINAL CIVIL JURISDICTION INCOME TAX APPEAL NO.2119 OF 2013 Director of Income Tax (IT)-I .. Appellant v/s. Deutsche Bank A.G. .. Respondent None for the appellant Mr. B.D. Damodar i/b M/s. Kanga & Co. for the respondent CORAM : M.S. SANKLECHA & A.K. MENON, J.J. DATED : 28[th] MARCH, 2016. P.C. 1.This appeal was listed at Serial No.12 on the today's board (i.e. Serial Nos. 1 to 9 were scheduled to be called out at 3.00 p.m.). When this appeal was first called out in the morning session, none appeared for the appellant nor did any Counsel for the Revenue seek time. Therefore, we kept back the appeal to be called out at 1.30 p.m. 2.At 1.30 p.m. this appeal is again called out. However, even now none appears for the Revenue nor any application for adjournment and / or keeping back the appeal is made on behalf of the Revenue. 3.It appears that the Revenue is not interested in prosecuting the present appeal. 4.Accordingly, the appeal is dismissed for non-prosecution. (A.K. MENON, J.) (M.S. SANKLECHA, J.)
