1.This appeal under Section 260A of the Income Tax Act, 1961 (the
Act) filed against the order dated 13[th] September, 2003 of the Income
Tax Appellate Tribunal (the Tribunal) was admitted on 7[th] February, 2005.
2.Mr. Gurjar, learned Counsel appearing in support of the appeal
states that inspite of his best efforts, he has not been able to obtain any
instructions from the appellant.
3.In the above view, it appears that the appellant is not interested
in prosecuting this appeal.
4.Accordingly, the appeal is dismissed for non-prosecution.
