Court on 20.10.2008. Hence, appeal against the firstquestion cannot be entertained.
2.As regards question (b), (c) and (d) are
concerned, the learned Counsel appearing forappellant fairly states that similar questions raisedin Income Tax appeal no.403 of 2008 has beendismissed by us today i.e. on 21.10.2008.
3.For the aforesaid reasons, the appeal is
dismissed. No order as to costs.
