PRAYER: Writ Petition is filed under Article 226 of theConstitution of India, to issue a Writ of Mandamus directing therespondent to revise the petitioner's income tax assessment inrespect of the assessment year 2007-2008 and to refund the excesstax collected from the petitioner by considering the petitioner'srepresentation dated 17.01.2013 within a stipulated time.

Heard the learned counsel appearing for the petitioner andthe learned counsel appearing for the respondent.

According to the Petitioner, he had submitted arepresentation dated 17.01.2013 addressed to the respondentseeking to revise his assessment for the assessment year 2007-2008 and to refund the excess tax collected from him. Till date,there appears to be an inaction on the part of the respondent.According to the petitioner, his representation has not seen theresult in a positive manner.

In view of the fact that the relief sought for by thepetitioner in his representation dated 17.01.2013 is only limitedin nature, this Court without adverting to the merits anddemerits of the contents of representation made by the petitionerin his representation dated 17.01.2013, in the interest ofhttps://hcservices.ecourts.gov.in/hcservices/justice and fair play, directs the respondent to look into therepresentation of the petitioner dated 17.01.2013 with care,
caution and circumspection and to dispose of the same one way orother on merits within a period of eight weeks from the date ofreceipt of a copy of this order. It is made clear that therespondent shall look into the representation of the petitionerdated 17.01.2013 in a fair, just and dispassionate manner and topass a complete and comprehensive order in this matter withoutbeing influenced by the order made in this writ petition.
4. With the aforesaid directions, the Writ Petition isdisposed of. No costs.
