The assessment of the assessee for the assessment year 1966-67 for which the relevant accounting year was the calendar year 1965 was thereafter completed in the normal course and in this assessment, oo amount was included by way of capital gains in respect of the transfer of the house, since the house was sold by the assessee at the same price at which it was purchased and no capital gains accrued or arose to him as a result of the transfer. On 4th April 1968, however, the Income Tax Officer issued a notice under. section 148 of the Act seeking to reopen the assessment of the assessee for the assessment year 1966-67 and requiring the assessee to submit a return of income within thirty days of the service of the notice, without stating what was the income alleged to have escaped assessment. However, by his subsequent Jetter dated 4th March, 1969, the Income Tax Officer stated that he proposed to fix the fair market value of the house sold by the assessee at Rs, 65,000 as against the consideration of Rs. 16,500 for which the house was sold and assess the difference of Rs. 48,500 as capital gains in the hands of the assessee. The objections raised by the assessee were overruled and an order of re-assessment was passed by the Income Tax Officer including the sum of Rs. 4&,500 as capital gains and bringing it to tax under sub-section (2) of section 52, taking the view that this sub-section did not require as a condition precedent that there should be under statement of consideration in respect of the transfer and it was enough to attract the applicability of the sub-section if the fair market value of the property as on the date of the transfer exceeded the full value of the consideration declared by the assessee by an amount of not less than 15% of the value so declared. The assessee thereupon filed a writ petition in Kerala High Court challenging the validity of the order of re· assessment insofar as it brought a sum of Rs. 48,500 to tax relying on sub-section (2) of section 52 of tho th~ Income Tax Act, 1961. The writ petition was allowed, but in appeal the Full Bench by a majority judgment agreed with the views of the Income Tax Officer and dismissed the writ petition. VARGHESE versus THE INCOME-TAX OFFICER, ERNAKULAM, AND ANOTHER [[1982] 1 S.C.R. 629] (1982) ਪੂੰਜੀ ਲਾਭ—ਕੀ ਸੰਪਤੀ ਦੇ ਹਸਤਾਂਤਰਣ ਵਿੱਚ ਮੁਲਾਂਕਣ ਦੀ ਘਾਟ ਦਾ ਬਿਆਨ ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੀ ਧਾਰਾ 52 ਦੇ ਉਪ-ਧਾਰਾ (2) ਦੀ ਲਾਗੂਪਣ ਲਈ ਇੱਕ ਜ਼ਰੂਰੀ ਹਾਲਤ ਹੈ—ਅਜਿਹੀ ਘਾਟ ਦੇ ਸਬੂਤ ਦਾ ਭਾਰ ਰਾਜਸੀ ਉੱਤੇ—ਕਾਨੂੰਨਾਂ ਦੀ ਵਿਆਖਿਆ, ਸਮਝਾਈ ਗਈ। ਅਪੀਲਕਰਤਾ-ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ 25 ਦਸੰਬਰ, 1965 ਨੂੰ ਆਪਣੇ ਘਰ ਨੂੰ ਏਰਨਾਕੁਲਮ ਵਿੱਚ ਆਪਣੀ ਧੀ ਨੂੰ ਵੇਚ ਦਿੱਤਾ। ਉਸਨੇ ਉਹੀ ਰਿਹਾਇਸ਼ ਉਸੇ ਕੀਮਤ ਰੁਪਏ 16,500 ਇੱਕ ਸਮੇਂ ਤੋਂ ਆਪਣੇ ਬੱਚਿਆਂ ਦੇ ਸਾਲ ਤੋਂ ਖਰੀਦੀ ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਮੁਲਾਂਕਣ ਲਈ ਮੁਲਾਂਕਣ ਸਾਲ 1966-67 ਜਿਸ ਲਈ ਪ੍ਰਸੰਗਿਕ ਲੇਖਾ ਸਾਲ 1965 ਸੀ ਨੂੰ ਸਾਧਾਰਨ ਕੋਰਸ ਵਿੱਚ ਪੂਰਾ ਕੀਤਾ ਗਿਆ ਸੀ ਅਤੇ ਇਸ ਮੁਲਾਂਕਣ ਵਿੱਚ, ਘਰ ਦੇ ਹਸਤਾਂਤਰਣ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਪੂੰਜੀ ਲਾਭ ਦੇ ਤੌਰ 'ਤੇ ਕੋਈ ਮੁੱਦਾ ਨਹੀਂ ਸੀ, ਅਤੇ ਘਰ ਨੂੰ ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਉਸੇ ਕੀਮਤ 'ਤੇ ਵੇਚਿਆ ਸੀ ਜਿਸ' ਤੇ ਇਹ 1961 ਵਿੱਚ ਉਸਦੇ ਬੱਚਿਆਂ ਦੁਆਰਾ ਸਹੀ ਕੀਤਾ ਗਿਆ ਸੀ। 14 ਅਪ੍ਰੈਲ 1965 ਨੂੰ, ਹਾਲਾਂਕਿ, ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਐਕਟ ਦੀ ਧਾਰਾ 148 ਤਹਿਤ ਇੱਕ ਨੋਟਿਸ ਜਾਰੀ ਕੀਤੀ ਸੀ ਜੋ ਮੁਲਾਂਕਣਕਰਤਾ ਦੇ ਮੁਲਾਂਕਣ ਨੂੰ ਮੁੜ ਖੋਲ੍ਹਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਕਰ ਰਹੀ ਸੀ। ਮੁਲਾਂਕਣ ਸਾਲ 1966-67 ਅਤੇ ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਨੋਟਿਸ ਦੀ ਸੇਵਾ ਦੇ 30 ਦਿਨਾਂ ਦੇ ਅੰਦਰ ਆਮਦਨ ਦਾ ਬਿਆਨ ਪੇਸ਼ ਕਰਨ ਦੀ ਲੋੜ ਸੀ, ਪਰ ਇਸ ਵਿੱਚ ਕੋਈ ਵਸਤੂ ਨਹੀਂ ਸੀ ਜੋ ਮੁਲਾਂਕਣ ਤੋਂ ਬਚ ਗਈ ਸੀ। ਹਾਲਾਂਕਿ, ਉਸਦੇ ਬਾਅਦ ਦੇ ਪੱਤਰ ਮਿਤੀ 16 ਮਾਰਚ 1969 ਨੂੰ, ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਨੇ ਕਿਹਾ ਕਿ ਉਹ ਘਰ ਦੇ ਮੁਲਾਂਕਣ ਦੀ ਰਾਸ਼ੀ ਰੁਪਏ 16,500 ਦੇ ਮੁਕਾਬਲੇ ਰੁਪਏ 55,000 ਵਿੱਚ ਵੇਚੇ ਜਾਣ ਦੇ ਅੰਤਰ ਦਾ ਮੁਲਾਂਕਣ ਕਰਨ ਦਾ ਪ੍ਰਸਤਾਵ ਰੱਖਦਾ ਹੈ ਅਤੇ ਇਸ ਤਰ੍ਹਾਂ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਉਠਾਏ ਗਏ ਐਤਰਾਜ਼ਾਂ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ ਗਿਆ ਸੀ ਅਤੇ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਦੁਆਰਾ ਮੁੜ ਮੁਲਾਂਕਣ ਦਾ ਹੁਕਮ ਪਾਸ ਕੀਤਾ ਗਿਆ ਸੀ ਜਿਸ ਵਿੱਚ ਰੁਪਏ 54,500 ਦੀ ਰਾਸ਼ੀ ਨੂੰ ਪੂੰਜੀ ਲਾਭ ਵਜੋਂ ਸ਼ਾਮਲ ਕੀਤਾ ਗਿਆ ਸੀ ਅਤੇ ਧਾਰਾ 62 ਦੇ ਉਪ-ਧਾਰਾ (2) ਦੇ ਤਹਿਤ ਅਗਲੇ ਸਾਲ ਵਿੱਚ ਲਿਆਂਦਾ ਗਿਆ ਸੀ, ਇਹ ਦ੍ਰਿਸ਼ਟੀਕੋਣ ਕਿ ਇਸ ਉਪ-ਧਾਰਾ ਲਈ ਧੋਖਾਧੜੀ ਦੀ ਮੌਜੂਦਗੀ ਦੀ ਲੋੜ ਨਹੀਂ ਸੀ ਅਤੇ ਇਹ ਹਸਤਾਂਤਰਣ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਮੁਲਾਂਕਣ ਦੀ ਕਦਰ ਸੀ ਅਤੇ ਇਹ ਕਹਿਣ ਲਈ ਕਾਫ਼ੀ ਸੀ ਕਿ ਜੇਕਰ ਘਰ ਦੇ ਨਿਰੀਖਣ ਦੀ ਤਾਰੀਖ ਤੋਂ ਸੰਪਤੀ ਦਾ ਬਾਜ਼ਾਰ ਮੁੱਲ ਘੱਟੋ-ਘੱਟ 15% ਦੀ ਰਾਸ਼ੀ ਨਾਲ ਵਧਿਆ ਹੋਇਆ ਸੀ। ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਤਰਕ ਦਿੱਤਾ ਅਤੇ ਇੱਕ ਰਿਟ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਕੇਰਲ ਹਾਈ ਕੋਰਟ ਵਿੱਚ ਮੁੜ ਮੁਲਾਂਕਣ ਦੇ ਹੁਕਮ ਦੀ ਵਧਾਈ ਦੀ ਵਧਾਈ ਨੂੰ ਚੰਗਾ ਕਰਨ ਦੀ ਚੁਣੌਤੀ ਦਿੱਤੀ ਜਿਸ ਵਿੱਚ ਰੁਪਏ 48,500 ਦੀ ਰਾਸ਼ੀ ਨੂੰ ਟੈਕਸ ਤੇ ਲਿਆਂਦਾ ਗਿਆ ਸੀ ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੀ ਧਾਰਾ 52 ਦੇ ਉਪ-ਧਾਰਾ (2) 'ਤੇ ਭਰੋਸਾ ਕਰਦੇ ਹੋਏ। ਰਿਟ ਪਟੀਸ਼ਨ ਦਿੱਤੀ ਗਈ ਸੀ, ਪਰ ਅਪੀਲ ਵਿੱਚ ਪੂਰੇ ਬੈਂਚ ਦੇ ਬਹੁਮਤ ਨੇ ਕੁਝ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀਆਂ ਦੇ ਵਿਚਾਰਾਂ ਨਾਲ ਸਹਿਮਤੀ ਪ੍ਰਗਟ ਨਹੀਂ ਕੀਤੀ ਅਤੇ ਰਿਟ ਪਟੀਸ਼ਨ ਨੂੰ ਰੱਦ ਕਰ ਦਿੱਤਾ। ਇਸ ਲਈ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਅਪੀਲ ਪ੍ਰਮਾਣ ਪੱਤਰ ਦੁਆਰਾ। ਅਪੀਲ ਦੀ ਆਗਿਆ ਦਿੰਦਿਆਂ, ਅਦਾਲਤ ਫੈਸਲਾ : 1.1 ਆਮਦਨ ਕਰ ਐਕਟ, 1961 ਦੀ ਧਾਰਾ 32 ਦੇ ਉਪ-ਧਾਰਾ (2) ਦਾ ਇਸਤੇਮਾਲ ਸਿਰਫ ਉਸ ਸਥਿਤੀ ਵਿੱਚ ਹੀ ਕੀਤਾ ਜਾ ਸਕਦਾ ਹੈ ਜਿੱਥੇ ਤਬਦੀਲੀ ਲਈ ਵਿਚਾਰ ਨੂੰ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਘੱਟ ਮੁੱਲ ਦਿੱਤਾ ਗਿਆ ਹੋਵੇ ਜਾਂ ਦੂਜੇ ਸ਼ਬਦਾਂ ਵਿੱਚ, ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਵਾਸਤਵਿਕ ਵਿਚਾਰ ਘੋਸ਼ਿਤ ਜਾਂ ਪ੍ਰਕਾਸ਼ਿਤ ਤੋਂ ਵੱਧ ਹੈ। ਉਪ-ਧਾਰਾ (2) ਦਾ ਕੋਈ ਉਪਯੋਗ ਨਹੀਂ ਹੈ ਇੱਕ ਇਮਾਨਦਾਰ ਜਾਂ ਬੋਨਾਫਾਈਡ ਲੈਣ-ਦੇਣ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਜਿੱਥੇ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਵਿਚਾਰ ਨੂੰ ਸਹੀ ਤਰ੍ਹਾਂ ਘੋਸ਼ਿਤ ਜਾਂ ਪ੍ਰਕਾਸ਼ਿਤ ਕੀਤਾ ਗਿਆ ਹੈ ਅਤੇ ਕੋਈ ਆਮਦਨ ਦੀ ਲੁਕਵੀਂ ਜਾਂ ਕਰ ਤੋਂ ਬਚਣ ਦੀ ਕੋਈ ਯੋਜਨਾ ਨਹੀਂ ਹੈ। 1.2 ਘੱਟ ਮੁੱਲ ਦੀ ਸਾਬਤ ਕਰਨ ਦਾ ਭਾਰ ਰਾਜਸੀ ਆਮਦਨ ਉੱਤੇ ਹੈ, ਜੋ ਕਿ ਉਸ ਦੁਆਰਾ ਉਹਨਾਂ ਤੱਥਾਂ ਅਤੇ ਹਾਲਾਤਾਂ ਨੂੰ ਸਥਾਪਤ ਕਰਕੇ ਛੱਡਿਆ ਜਾ ਸਕਦਾ ਹੈ ਜਿਸ ਤੋਂ ਇੱਕ ਮਿਆਰੀ ਅਨੁਮਾਨ ਕੱਢਿਆ ਜਾ ਸਕਦਾ ਹੈ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਨੇ ਉਸ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਵਿਚਾਰ ਨੂੰ ਸਹੀ ਤਰ੍ਹਾਂ ਘੋਸ਼ਿਤ ਜਾਂ ਪ੍ਰਕਾਸ਼ਿਤ ਨਹੀਂ ਕੀਤਾ ਹੈ ਅਤੇ ਵਿਚਾਰ ਦੇ ਘੱਟ ਮੁੱਲ ਦੀ ਲੁਕਵੀਂ ਹੈ। 1.3 ਉਪ-ਧਾਰਾ (2ਏ), ਇਸ ਮਾਮਲੇ ਵਿੱਚ, ਦਾ ਕੋਈ ਉਪਯੋਗ ਨਹੀਂ ਸੀ ਅਤੇ ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਕੋਲ ਇਸ ਗੱਲ ਦਾ ਕੋਈ ਕਾਰਨ ਨਹੀਂ ਸੀ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਦੀ ਆਮਦਨ ਦਾ ਕੋਈ ਹਿੱਸਾ ਮੁਲਾਂਕਣ ਤੋਂ ਬਚ ਗਿਆ ਹੈ, ਜਿਸ ਨਾਲ ਧਾਰਾ 148 ਤਹਿਤ ਨੋਟਿਸ ਜਾਰੀ ਕਰਨ ਦੇ ਯੋਗ ਹੋਵੇ। ਇਹ ਦੋਵਾਂ ਪਾਰਟੀਆਂ ਵਿਚਕਾਰ ਇੱਕ ਆਮ ਮੁੱਦਾ ਸੀ ਅਤੇ ਇਹ ਰਾਜਸੀ ਅਧਿਕਾਰੀਆਂ ਦੁਆਰਾ ਪਹੁੰਚਿਆ ਇੱਕ ਤੱਥ ਸੀ ਕਿ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਜਾਇਦਾਦ ਦਾ ਤਬਦੀਲੀ ਇੱਕ ਪੂਰੀ ਤਰ੍ਹਾਂ ਇਮਾਨਦਾਰ ਅਤੇ ਬੋਨਾਫਾਈਡ ਲੈਣ-ਦੇਣ ਸੀ ਜਿੱਥੇ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਵਿਚਾਰ ਦਾ ਪੂਰਾ ਮੁੱਲ ਰੁਪਏ 15,60,000 ਦੇ ਅੰਕੜੇ ਤੇ ਸਹੀ ਤਰ੍ਹਾਂ ਪ੍ਰਕਾਸ਼ਿਤ ਕੀਤਾ ਗਿਆ ਸੀ। ਆਮਦਨ ਕਰ ਅਧਿਕਾਰੀ ਦੁਆਰਾ ਧਾਰਾ 148 ਤਹਿਤ ਜਾਰੀ ਨੋਟਿਸ ਦੇ ਅਨੁਸਾਰ ਕੀਤੀ ਗਈ ਮੁੜ ਮੁਲਾਂਕਣ ਦਾ ਹੁਕਮ ਅਧਿਕਾਰ ਖੇਤਰ ਤੋਂ ਬਾਹਰ ਸੀ। Case: K.P. The burden of proving an understatement or concealment is on the Revenue, which may be discharged by it .by establishing facts and circumstances from which a reasonable inference can be drawn that the assessee has not correctly declared or disclosed the consideration received by him and there is understatement or concealment of the consideration in respect of the transfer. [657 B-C] 1 : 3. Sub-section (~), in the instant case, had no application and the Income Tax Officer could have no reason to believe that any part of the incom.e of the assessee had escaped assessment so as to justify the issue of a notice under section 148. It was a common ground between the parties and that was a finding of fact reached by the Revenue Authorities that the transfer of the pro-perty by the assessee was a perfectly honest and bona:ide transaction where the full value of the cons;deration received by the assessee was correctly disclosed at the figure of Rs. 16,500. The order of re-assessment made by the Income Tax Officer pursuant to the notice issued under section 148 was accordingly without jurisdiction. (657 D-G] 2 : 1. The task of interpretation or the statutory enactment 1s not a mechanical task. It is more than mere reading of mathematical formula because few words possess the precision of mathematical symbols. It is an attempt to discover the intent of the legislature from the language used by it and it must always be remembered that language is at best an in1perfect instru· meat for the expression of human thoughts and it would be idle to expect every statutory provision to be "drafted with divine prescience and perfect clarity". Courts, therefore, must eschew literalness in the interpretation of a statutory provision and construe the language having regard to the object and purpose which the legislature had in view in enacting that provision and in the context and the setting in which it occurs. [640 C-D, F·G, 642 B-C] 2: 2. Where the plain literal interpretation of a statutory provision produ· ces a manifestly absurd and unjust result which could never have been int~nded by the Iegislatu1e, the Court may modify the language used by the legislature or even "do some violence" to it so as to achieve the obvious intention of the legis-lature and produce a rational construction. The Court may also in such a case read into the statutory provision a condition which, though not expressed, is implicit as constituting the basic assumption underlying the statut..:>ry provision. It is true that the consequences of a suggested construction cannot alter the meaning of a statutory provision but they can certainly help to fix its meaning. [64l·A 642 C-E] • Luke v. Again it is undoubtedly true that the marginal note to a section can-not be referred to for the purpose of construing the section but it can certainly be relied upon as indicating the drift of the section or to show what the section dealing with. It cannot control the interpretation of the words of a section particularly when the language of the section is clear and unambiguous but, being part of the statute, it prima facie furnishes some clue as to the meaning and purpose of the section. The rule of construction by reference to contemporanea expositio is a well established rule for interpreting a statute by reference to the exposition it has received from contemporary authority, though it must give way where the language of the statute is plain and unambiguous. Having regard to the well recognised rule of interpretation, a fair and reasonable construction of section 52 sub·section (2) would be to read into it a condition that it would apply only where the consideration for the transfer is understated or in other words, the asses.see has actually received a larger consi· deration for the transfer than what is declared in the instrument of transfer and it would have no application in case of a honafide transaction where the full value of the consideration for the transfer is correctly declared by the assessee. [642 E-FJ 3. Several considerations which lead to this conclusion are : A C D E F G H A H (a) The first consideration is the object and purpose of the enactme~t of section 52(2). The speech made by the Finance Minister while moving the amendment introducing sub·section (2) clearly states what were the circumstances in which such sub.section (2) came to be passed, what was the mischief for which section 52 as it stood then did not provide and which was sought to be remedied by the enactment of sub section (2) and why the enactment of that sub section was found necessary. The object and purpose of sub section (2), as explicated from the speech of the Finance Minister, was not to strike at honest and bonafidc~ transactions where the consideration for the transfei was correctly disclosed by the assessee but to bring within the net of taxation those transactions where the consideration in respect of the transfer was shown at a lesser figure than that actually received by the assessee, so that they do not escape 1he chargeable tax on capital gain by unde1statement of the ccnsideration. This was real object and rurpose c·f the enac1ment of 5.Ub section (2) and the interpretation of this ~ub·!ecticn must fall in line with the advancerr:ent of that object and purpose. [642 F, 646 B·F] (b) Further the marginal note to section 52 as it now stands, was originalJy a marginal note only to what is presently sub-section (1) and significantly enough, this marginal note remained unchanged e\·en after the introduction of sub-section (2)suggesting clearly that it was meant by Parliament to apply to both sub-sections of section 52 and it must therefo1e be taken as indicating that, like sub-section(l), sub-section (2) is also intended to deal with cases where there is under-statement of the consideration in respect of the transfer. VARGHESE versus THE INCOME-TAX OFFICER, ERNAKULAM, AND ANOTHER [[1982] 1 S.C.R. 629] (1982) 3. ਕਈ ਗੱਲਾਂ ਹਨ ਜੋ ਇਸ ਨਤੀਜੇ ਤੱਕ ਪਹੁੰਚਦੀਆਂ ਹਨ: (a) ਪਹਿਲਾ ਵਿਚਾਰ ਧਾਰਾ 52(2) ਦੇ ਕਾਨੂੰਨ ਦਾ ਉਦੇਸ਼ ਅਤੇ ਉਦੇਸ਼ ਹੈ। ਵਿੱਤ ਮੰਤਰੀ ਦੁਆਰਾ ਉਪ-ਧਾਰਾ (2) ਪੇਸ਼ ਕਰਦੇ ਹੋਏ ਸੋਧ ਪੇਸ਼ ਕਰਦੇ ਸਮੇਂ ਦਿੱਤੇ ਗਏ ਭਾਸ਼ਣ ਵਿੱਚ ਸਪੱਸ਼ਟ ਤੌਰ 'ਤੇ ਦੱਸਿਆ ਗਿਆ ਹੈ ਕਿ ਉਹ ਕਿਹੜੀਆਂ ਸਥਿਤੀਆਂ ਸਨ ਜਿਨ੍ਹਾਂ ਵਿੱਚ ਅਜਿਹੀ ਉਪ-ਧਾਰਾ (2) ਪਾਸ ਹੋਈ, ਉਹ ਕਿਹੜੀ ਸ਼ਰਾਰਤ ਸੀ ਜਿਸ ਲਈ ਧਾਰਾ 52 ਜਿਵੇਂ ਕਿ ਇਹ ਉਸ ਸਮੇਂ ਖੜ੍ਹਾ ਸੀ, ਪ੍ਰਦਾਨ ਨਹੀਂ ਕਰਦੀ ਸੀ ਅਤੇ ਜਿਸ ਨੂੰ ਉਪ-ਧਾਰਾ (2) ਦੇ ਕਾਨੂੰਨ ਦੁਆਰਾ ਹੱਲ ਕਰਨ ਦੀ ਕੋਸ਼ਿਸ਼ ਕੀਤੀ ਗਈ ਸੀ ਅਤੇ ਉਸ ਉਪ-ਧਾਰਾ ਨੂੰ ਲਾਗੂ ਕਰਨਾ ਕਿਉਂ ਜ਼ਰੂਰੀ ਪਾਇਆ ਗਿਆ ਸੀ। ਉਪ-ਧਾਰਾ (2) ਦਾ ਉਦੇਸ਼ ਅਤੇ ਉਦੇਸ਼, ਜਿਵੇਂ ਕਿ ਵਿੱਤ ਮੰਤਰੀ ਦੇ ਭਾਸ਼ਣ ਤੋਂ ਸਪੱਸ਼ਟ ਕੀਤਾ ਗਿਆ ਹੈ, ਇਮਾਨਦਾਰ ਅਤੇ ਸੱਚੇ ਲੈਣ-ਦੇਣ 'ਤੇ ਹਮਲਾ ਕਰਨਾ ਨਹੀਂ ਸੀ ਜਿੱਥੇ ਟ੍ਰਾਂਸਫ਼ਾਈ ਲਈ ਵਿਚਾਰ ਅਸੈਸਰੀ ਦੁਆਰਾ ਸਹੀ ਢੰਗ ਨਾਲ ਪ੍ਰਗਟ ਕੀਤਾ ਗਿਆ ਸੀ, ਸਗੋਂ ਉਨ੍ਹਾਂ ਲੈਣ-ਦੇਣਾਂ ਨੂੰ ਟੈਕਸ ਦੇ ਘੇਰੇ ਵਿੱਚ ਲਿਆਉਣਾ ਸੀ ਜਿੱਥੇ ਟ੍ਰਾਂਸਫ਼ਾਈ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਵਿਚਾਰ ਅਸਲ ਵਿੱਚ ਅਸੈਸਰੀ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਕੀਤੇ ਗਏ ਅੰਕੜੇ ਤੋਂ ਘੱਟ ਅੰਕੜੇ 'ਤੇ ਦਿਖਾਇਆ ਗਿਆ ਸੀ, ਤਾਂ ਜੋ ਉਹ ਸੀਕੰਡੇਸ਼ਨ ਦੀ ਅਣ-ਬਣਾਈ ਕਰਕੇ ਪੂੰਜੀ ਲਾਭ 'ਤੇ ਲੱਗਣ ਵਾਲੇ ਟੈਕਸ ਤੋਂ ਬਚ ਨਾ ਸਕਣ। ਇਹ ਅਸਲ ਉਦੇਸ਼ ਸੀ ਅਤੇ 5. ਯੂਬੀ ਸੈਕਸ਼ਨ (2) ਦੇ ਕਾਨੂੰਨ ਦਾ ਆਧਾਰ ਸੀ ਅਤੇ ਇਸ ਵਿਸ਼ੇ ਦੀ ਵਿਆਖਿਆ ਉਸ ਉਦੇਸ਼ ਅਤੇ ਉਦੇਸ਼ ਦੇ ਪੇਸ਼ਗੀ ਦੇ ਅਨੁਸਾਰ ਹੋਣੀ ਚਾਹੀਦੀ ਹੈ। (b) ਇਸ ਤੋਂ ਇਲਾਵਾ, ਸੈਕਸ਼ਨ 52 ਦੇ ਹਾਸ਼ੀਏ ਦਾ ਨੋਟ, ਜਿਵੇਂ ਕਿ ਇਹ ਹੁਣ ਹੈ, ਮੂਲ ਰੂਪ ਵਿੱਚ ਸਿਰਫ ਉਸ ਸੈਕਸ਼ਨ ਦਾ ਹਾਸ਼ੀਏ ਦਾ ਨੋਟ ਸੀ ਜੋ ਵਰਤਮਾਨ ਵਿੱਚ ਉਪ-ਸੈਕਸ਼ਨ (1) ਹੈ, ਅਤੇ ਕਾਫ਼ੀ ਮਹੱਤਵਪੂਰਨ ਗੱਲ ਇਹ ਹੈ ਕਿ ਇਹ ਹਾਸ਼ੀਏ ਦਾ ਨੋਟ ਉਪ-ਸੈਕਸ਼ਨ (2) ਦੀ ਸ਼ੁਰੂਆਤ ਤੋਂ ਬਾਅਦ ਵੀ ਬਦਲਿਆ ਨਹੀਂ ਗਿਆ, ਜੋ ਸਪਸ਼ਟ ਤੌਰ 'ਤੇ ਦਰਸਾਉਂਦਾ ਹੈ ਕਿ ਸੰਸਦ ਦੁਆਰਾ ਉਮੀਦ ਕੀਤੀ ਗਈ ਸੀ ਕਿ ਇਹ ਸੈਕਸ਼ਨ 52 ਦੇ ਦੋਵੇਂ ਉਪ-ਭਾਗਾਂ 'ਤੇ ਲਾਗੂ ਹੋਵੇਗਾ ਅਤੇ ਇਸ ਲਈ ਇਹ ਮੰਨਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿ, ਉਪ-ਸੈਕਸ਼ਨ (1) ਦੀ ਤਰ੍ਹਾਂ, ਉਪ-ਸੈਕਸ਼ਨ (2) ਵੀ ਤਬਦੀਲੀ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਘੱਟ ਦੱਸੇ ਗਏ ਮੁਲਾਂਕਣ ਨਾਲ ਸੰਬੰਧਿਤ ਮਾਮਲਿਆਂ ਨਾਲ ਨਜਿੱਠਣ ਲਈ ਬਣਾਇਆ ਗਿਆ ਹੈ। (c) ਸਬ-ਸੈਕਸ਼ਨ (2) ਦੀ ਸਥਿਤੀ ਸੈਕਸ਼ਨ 52 ਵਿੱਚ ਕੁਝ ਹੱਦ ਤੱਕ ਇਹ ਦਰਸਾਉਂਦੀ ਹੈ ਕਿ ਸੰਸਦ ਨੇ ਉਸ ਸਬ-ਸੈਕਸ਼ਨ ਨੂੰ ਸਿਰਫ ਉਹਨਾਂ ਮਾਮਲਿਆਂ 'ਤੇ ਲਾਗੂ ਕਰਨ ਦਾ ਇਰਾਦਾ ਰੱਖਿਆ ਜਿੱਥੇ ਟ੍ਰਾਂਸਫਰ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਵਿਚਾਰ ਅਸੈਸੀ ਦੁਆਰਾ ਘੱਟ ਦੱਸਿਆ ਗਿਆ ਹੈ। ਜੇ ਸੰਸਦ ਨੇ ਸਬ-ਸੈਕਸ਼ਨ (2) ਨੂੰ 15% ਦੇ ਫਰਕ ਦੀ ਸੰਤੁਸ਼ਟੀ ਵਾਲੇ ਸਾਰੇ ਮਾਮਲਿਆਂ 'ਤੇ ਲਾਗੂ ਕਰਨ ਦਾ ਇਰਾਦਾ ਰੱਖਿਆ, ਚਾਹੇ ਵਿਚਾਰ ਘੱਟ ਦੱਸਿਆ ਗਿਆ ਹੋਵੇ ਜਾਂ ਨਹੀਂ, ਇਹ ਮੰਨਿਆ ਜਾ ਸਕਦਾ ਹੈ ਕਿ ਸੰਸਦ ਨੇ ਉਸ ਪ੍ਰਬੰਧ ਨੂੰ ਇੱਕ ਵੱਖਰਾ ਅਤੇ ਵਿਸ਼ੇਸ਼ ਪ੍ਰਬੰਧ ਵਜੋਂ ਬਣਾਇਆ ਹੋਵੇਗਾ। ਇਸਤੋਂ ਇਹ ਵੀ ਜਾਪਦਾ ਹੈ ਕਿ ਸਬ-ਸੈਕਸ਼ਨ (2) ਦਾ ਮੁੱਖ ਉਦੇਸ਼ ਵਿਚਾਰ ਘੱਟ ਦੱਸਣ ਵਾਲੇ ਮਾਮਲਿਆਂ 'ਤੇ ਹੈ। ਸਬ-ਸੈਕਸ਼ਨ (2) ਵਿੱਚ ਅੰਤਰਨਿਹਿਤ ਸਬੂਤ ਇਹ ਹਨ: "ਅਸੈਸੀ ਦੁਆਰਾ ਘੋਸ਼ਿਤ ਵਿਚਾਰ ਦਾ ਪੂਰਾ ਮੁੱਲ"। "ਘੋਸ਼ਿਤ" ਸ਼ਬਦ ਬਹੁਤ ਜ਼ਿਆਦਾ ਬੋਲਦਾ ਹੈ ਅਤੇ ਰੋਸ਼ਨ ਕਰਦਾ ਹੈ। ਇਹ ਸਪਸ਼ਟ ਤੌਰ 'ਤੇ ਦਰਸਾਉਂਦਾ ਹੈ ਕਿ ਸਬ-ਸੈਕਸ਼ਨ (2) ਦਾ ਫੋਕਸ ਸਿਰਫ ਉਸ ਵਿਚਾਰ 'ਤੇ ਹੈ ਜੋ ਅਸੈਸੀ ਦੁਆਰਾ ਘੋਸ਼ਿਤ ਕੀਤਾ ਗਿਆ ਹੈ ਅਤੇ ਮੁਲਾਂਕਣ ਕਾਰਵਾਈਆਂ ਵਿੱਚ ਇਸ ਤਰ੍ਹਾਂ ਨਾਲ ਨਿਪਟਾਇਆ ਗਿਆ ਹੈ ਅਤੇ ਅਸੈਸੀ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਘੋਸ਼ਣਾ ਅਤੇ ਜੇ ਇਹ ਇੱਕ ਮਾਮਲੇ ਦੀ ਕਲਪਨਾ ਕਰਦਾ ਹੈ ਜਿੱਥੇ ਟ੍ਰਾਂਸਫਰ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਵਾਸਤਵ ਵਿੱਚ ਪ੍ਰਾਪਤ ਵਿਚਾਰ ਨੂੰ ਉਸ ਦੁਆਰਾ ਆਜ਼ਾਦੀ ਨਾਲ ਘੋਸ਼ਿਤ ਨਹੀਂ ਕੀਤਾ ਗਿਆ ਹੈ ਜਿਵੇਂ ਕਿ ਉਸ ਨੇ ਉੱਪਰ ਸਵੀਕਾਰ ਕੀਤਾ ਹੈ। (d) 17ਵੀਂ, 1969, 26ਵੀਂ ਅਤੇ 14ਵੀਂ, 1974 ਨੂੰ ਕੇਂਦਰੀ ਪ੍ਰਤੱਖ ਕਰ ਬੋਰਡ ਦੁਆਰਾ ਜਾਰੀ ਕੀਤੇ ਗਏ ਜੁਲਾਈ ਸਰਕੂਲਰ, ਸਿਰਫ ਵਿਭਾਗ ਦੇ ਅਧਿਕਾਰੀਆਂ 'ਤੇ ਬੰਨ੍ਹਣ ਵਾਲੇ ਨਹੀਂ ਹਨ, ਸਗੋਂ ਸਬ-ਸੈਕਸ਼ਨ (2) ਵਿੱਚ ਦਰਸਾਏ ਗਏ ਪ੍ਰਬੰਧ ਨੂੰ ਲਾਗੂ ਕਰਨ ਵਿੱਚ, ਸਗੋਂ ਇਹ ਵੀ ਸੰਕੇਤ ਕਰਦੇ ਹਨ ਕਿ ਸੈਕਸ਼ਨ 52(2) ਦੀ ਵਿਆਪਕ ਵਰਤੋਂ ਨੂੰ ਯਕੀਨੀ ਬਣਾਉਣ ਲਈ। ਇਸ ਲਈ ਇਹ ਸਪਸ਼ਟ ਹੈ ਕਿ ਕੇਂਦਰੀ ਪ੍ਰਤੱਖ ਕਰ ਬੋਰਡ ਦੇ ਈ-ਮੇਲ, ਜੋ ਕਿ ਐਕਟ ਦੇ ਪ੍ਰਬੰਧਾਂ ਨੂੰ ਲਾਗੂ ਕਰਨ ਲਈ ਅਧਿਕਾਰਤ ਅਧਿਕਾਰੀ ਹਨ, ਨੇ ਸਬ-ਸੈਕਸ਼ਨ (2) ਨੂੰ ਅਸੈਸੀ ਦੁਆਰਾ ਨਿਰਧਾਰਤ ਕੀਮਤ 'ਤੇ ਧਿਆਨ ਕੇਂਦਰਿਤ ਕੀਤਾ ਹੈ। [51 C-H] ਮਾਮਲੇ ਜਿੱਥੇ ਟ੍ਰਾਂਸਫਰ ਲਈ ਵਿਚਾਰ ਅਸੈਸੀ ਦੁਆਰਾ ਘੱਟ ਦੱਸਿਆ ਗਿਆ ਹੈ। ਇਹ ਦੋ ਸ਼ਰਤਾਂ ਰਾਜਸ਼ਾਹੀ ਅਤੇ ਰਾਜਸ਼ਾਹੀ ਦੇ ਅਧਿਕਾਰੀਆਂ 'ਤੇ ਕਾਨੂੰਨੀ ਤੌਰ 'ਤੇ ਬੰਨ੍ਹਣ ਵਾਲੀਆਂ ਹਨ ਅਤੇ ਉਨ੍ਹਾਂ ਦਾ ਕਾਨੂੰਨੀ ਰੂਪ ਵਿਆਖਿਆਤਮਕ ਸਰਕੂਲਰ ਨੂੰ ਆਕਰਸ਼ਿਤ ਕਰਦਾ ਹੈ, ਭਾਵੇਂ ਕਿ ਉਹ ਸਬ-ਸੈਕਸ਼ਨ (2) ਦੇ ਸਹੀ ਵਿਆਖਿਆ ਦੇ ਅਨੁਸਾਰ ਨਾ ਹੋਣ। ਨਵਨੀਤਲਾਲ ਸੀ. ਜਵੇਰੀ ਬਨਾਮ ਕੇ.ਕੇ. ਸੇਨ, 56 ਆਈ.ਟੀ.ਆਰ. ਐਸਸੀ 198; ਐਲੀਮਨਾ ਲਿਮਟਿਡ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ-ਟੈਕਸ, ਵੈਸਟ ਬੰਗਾਲ, 81 ਆਈ.ਟੀ.ਆਰ. 913 ਐਸਸੀ], 4.1 ਇਸ ਗੱਲ ਦੀਆਂ ਸਥਿਤੀਆਂ 'ਤੇ ਸ਼ਰਤਾਂ ਦਾ ਪਾਲਣ ਕਰਦਿਆਂ ਕਿ ਕੋਈ ਜ਼ਰੂਰੀ ਬੋਝ ਨਹੀਂ ਹੈ, ਜਾਂ ਨਕਾਰਾਤਮਕ ਤੌਰ 'ਤੇ, ਭਾਵ ਕਿ ਉਸਨੇ ਉਸਦੇ ਦੁਆਰਾ ਘੋਸ਼ਿਤ ਕੀਤੀ ਗਈ ਰਾਸ਼ੀ ਤੋਂ ਪਰੇ ਕੋਈ ਵਿਚਾਰ ਪ੍ਰਾਪਤ ਨਹੀਂ ਕੀਤਾ। Case: K.P. VARGHESE versus THE INCOME-TAX OFFICER, ERNAKULAM, AND ANOTHER [[1982] 1 S.C.R. 629] (1982) (c) The placement of sub-section (2) in section 52 does indicate in son1e ~mall tteasure 1hat Parliament intended that sub-section to apply only to cases where the consideration in respect of the transfer is under-stated by the asscssee. If Parliament intended sub-section (2) to cover all cases where the condition of 15% difference is satisfied, irrespective of whether there is under-statement of consideration or not, it is reasonable to assume that Parliament would have enacted that provision as a separate section and rot pitch-forked it into section 52 with a total stranger under an inappropriate marginal note. Moreover there is inherent evidence in sub-section (2) which suggests that the thrust of that sub-section is directed against cases of under-statement of consideration. The crucial and important words in sub-section (2) are : "the full value of the consi-deration declared by the assessee". The word 'declared' is very eloquent and revealing. It clearly indicates that the focus of sub-section (2) is on the consi-deration declared or disclosed by the assessee as distinguished from the consi-deration actually received by him and it contemplates a case where the consi-deration received by the assessee in respect of the transfer is not truly declared or disclosed by him but is shown at a different figure. [647 D-G, 648 A-BJ (d) The two circulars issued by the Central Board of Direct Taxes dated 7th July, 1964 and 14th January, 1974 are not only binding on the Tax Department in administering or executing the provision enacted in sub-section (2), but are in tl:e nature of conttmporonta txpo.sitio, furnishing legitimate aid in the construction of sub-section (2). It is clear from these two circulars that tho Central Board of Direct Taxes, which is the highest authority entrusted with the execution of the provisions of the Act understood sub-section (2) as limited to cases where the consideratioa for the transfer has been under-stated by the assessee. These two circulars are legally ·binding on the Revenue and this legally binding character attaches to the two circulars even if they be found not in accordance with the correct interpretation of sub-section (2) and they depart or deviate from such construction. VARGHESE versus THE INCOME-TAX OFFICER, ERNAKULAM, AND ANOTHER [[1982] 1 S.C.R. 629] (1982) ਨਵਨੀਤਲਾਲ ਸੀ. ਜਵੇਰੀ ਬਨਾਮ ਕੇ.ਕੇ. ਸੇਨ, 56 ਆਈ.ਟੀ.ਆਰ. ਐਸਸੀ 198; ਐਲੀਮਨਾ ਲਿਮਟਿਡ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ-ਟੈਕਸ, ਵੈਸਟ ਬੰਗਾਲ, 81 ਆਈ.ਟੀ.ਆਰ. 913 ਐਸਸੀ], 4.1 ਇਸ ਗੱਲ ਦੀਆਂ ਸਥਿਤੀਆਂ 'ਤੇ ਸ਼ਰਤਾਂ ਦਾ ਪਾਲਣ ਕਰਦਿਆਂ ਕਿ ਕੋਈ ਜ਼ਰੂਰੀ ਬੋਝ ਨਹੀਂ ਹੈ, ਜਾਂ ਨਕਾਰਾਤਮਕ ਤੌਰ 'ਤੇ, ਭਾਵ ਕਿ ਉਸਨੇ ਉਸਦੇ ਦੁਆਰਾ ਘੋਸ਼ਿਤ ਕੀਤੀ ਗਈ ਰਾਸ਼ੀ ਤੋਂ ਪਰੇ ਕੋਈ ਵਿਚਾਰ ਪ੍ਰਾਪਤ ਨਹੀਂ ਕੀਤਾ। 4.2. ਜੇ ਰਾਜ ਸਰਕਾਰ ਦੂਜੇ ਉਪ-ਸੈਕਸ਼ਨ ਵਿੱਚ ਇੱਕ ਕੇਸ ਲਿਆਉਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਕਰਦੀ ਹੈ, ਤਾਂ ਇਸਨੂੰ ਸਿਰਫ਼ ਇਹ ਨਹੀਂ ਦਿਖਾਉਣਾ ਪੈਣਾ ਚਾਹੀਦਾ ਕਿ ਟ੍ਰਾਂਸਫਰ ਦੀ ਮਿਤੀ 'ਤੇ ਪੂੰਜੀ ਸੰਪਤੀ ਦਾ ਬਾਜ਼ਾਰ ਮੁੱਲ ਅਸੈਸੀ ਦੁਆਰਾ ਘੋਸ਼ਿਤ ਕੀਤੀ ਗਈ ਰਾਸ਼ੀ ਦੇ ਮੁੱਲ ਤੋਂ 15% ਤੋਂ ਵੱਧ ਹੈ, ਸਗੋਂ ਇਹ ਵੀ ਦਿਖਾਉਣਾ ਚਾਹੀਦਾ ਹੈ ਕਿ ਰਾਸ਼ੀ ਘੱਟ ਦੱਸੀ ਗਈ ਹੈ ਅਤੇ ਦੋ ਵੱਖਰੇ ਸ਼ਰਤਾਂ ਹਨ ਜਿਨ੍ਹਾਂ ਨੂੰ ਪੂਰਾ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈਰਾਜ ਸਰਕਾਰ ਦੁਆਰਾ ਉਪ-ਕਲਾਸ (2) ਨੂੰ ਸੱਦਾ ਦੇਣ ਤੋਂ ਪਹਿਲਾਂ ਅਤੇ ਇਹਨਾਂ ਦੋਹਾਂ ਸ਼ਰਤਾਂ ਨੂੰ ਪੂਰਾ ਕਰਨ ਦਾ ਬੋਝ ਰਾਜ ਸਰਕਾਰ 'ਤੇ ਹੈ। ਇਹ ਰਾਜ ਸਰਕਾਰ ਲਈ ਹੈ ਕਿ ਇਹ ਦਿਖਾਏ ਕਿ ਇਹਨਾਂ ਵਿੱਚੋਂ ਹਰ ਇੱਕ ਸ਼ਰਤ ਪੂਰੀ ਕੀਤੀ ਗਈ ਹੈ ਅਤੇ ਰਾਜ ਸਰਕਾਰ ਇਹ ਦਾਅਵਾ ਨਹੀਂ ਕਰ ਸਕਦੀ ਕਿ ਇਸਨੇ ਆਪਣੇ 'ਤੇ ਪਏ ਬੋਝ ਨੂੰ ਪੂਰਾ ਕਰ ਦਿੱਤਾ ਹੈ, ਸਿਰਫ਼ ਇਹ ਸਥਾਪਤ ਕਰਕੇ ਕਿ ਟ੍ਰਾਂਸਫਰ ਦੀ ਮਿਤੀ 'ਤੇ ਪੂੰਜੀ ਸੰਪਤੀ ਦਾ ਬਾਜ਼ਾਰ ਮੁੱਲ ਅਸੈਸੀ ਦੁਆਰਾ ਘੋਸ਼ਿਤ ਕੀਤੀ ਗਈ ਰਾਸ਼ੀ ਦੇ ਮੁੱਲ ਤੋਂ 15% ਜਾਂ ਇਸ ਤੋਂ ਵੱਧ ਹੈ; ਅਤੇ ਪਹਿਲੀ ਸ਼ਰਤ ਇਸ ਲਈ ਪੂਰੀ ਕੀਤੀ ਗਈ ਹੈ। ਰਾਜ ਸਰਕਾਰ ਨੂੰ ਅੱਗੇ ਵਧਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਸਾਬਤ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ ਕਿ ਦੂਜੀ ਸ਼ਰਤ ਵੀ ਪੂਰੀ ਕੀਤੀ ਗਈ ਹੈ। ਸਿਰਫ਼ ਇਹ ਦਿਖਾ ਕੇ ਕਿ ਦੂਜੀ ਸ਼ਰਤ ਪੂਰੀ ਕੀਤੀ ਗਈ ਹੈ, ਰਾਜ ਸਰਕਾਰ ਅਦਾਲਤ ਨੂੰ ਇਹ ਮੰਨਣ ਲਈ ਕਹਿ ਨਹੀਂ ਸਕਦੀ ਕਿ ਪਹਿਲੀ ਸ਼ਰਤ ਵੀ ਪੂਰੀ ਕੀਤੀ ਗਈ ਹੈ, ਕਿਉਂਕਿ ਜਿੱਥੇ ਵੀ 15% ਦੀ ਅਸਾਮਾਨਤਾ ਦੀ ਪਹਿਲੀ ਸ਼ਰਤ ਹੈ ਉੱਥੇ ਕੋਈ ਘੱਟ ਦੱਸੀ ਗਈ ਰਾਸ਼ੀ ਨਹੀਂ ਹੋ ਸਕਦੀ। ਦੂਜੀ ਸ਼ਰਤ ਨੂੰ ਪਹਿਲੀ ਸ਼ਰਤ ਤੋਂ ਸੁਤੰਤਰ ਰੂਪ ਵਿੱਚ ਸਥਾਪਤ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਸਿਰਫ਼ ਇਸ ਲਈ ਕਿ ਪਹਿਲੀ ਸ਼ਰਤ ਪੂਰੀ ਕੀਤੀ ਗਈ ਹੈ, ਕੋਈ ਫਰਕ ਜ਼ਰੂਰੀ ਨਹੀਂ ਹੈ ਕਿ ਦੂਜੀ ਸ਼ਰਤ ਵੀ ਪੂਰੀ ਕੀਤੀ ਗਈ ਹੈ। ਹਰੇਕ ਸ਼ਰਤ ਨੂੰ ਵੱਖਰੇ ਤੌਰ 'ਤੇ ਦੇਖਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਉਪ-ਸੈਕਸ਼ਨ (2) ਨੂੰ ਸੱਦਾ ਦੇਣ ਤੋਂ ਪਹਿਲਾਂ ਸਥਾਪਤ ਕਰਨਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਇਸ ਨੂੰ ਕਰਨ ਦਾ ਬੋਝ ਸਪਸ਼ਟ ਤੌਰ 'ਤੇ ਰਾਜ ਸਰਕਾਰ 'ਤੇ ਹੈ। 4.3. ਪੂੰਜੀ ਸੰਪਤੀ ਦੇ ਬਾਜ਼ਾਰ ਮੁੱਲ ਅਤੇ ਟ੍ਰਾਂਸਫਰ ਸਬੰਧੀ ਘੋਸ਼ਿਤ ਰਾਸ਼ੀ ਵਿਚਕਾਰ 15% ਜਾਂ ਇਸ ਤੋਂ ਵੱਧ ਦਾ ਫਰਕ ਰੱਖਣ ਦੀ ਸ਼ਰਤ ਦਾ ਉਦੇਸ਼ ਸਪਸ਼ਟ ਤੌਰ 'ਤੇ ਉਪ-ਸੈਕਸ਼ਨ (2) ਦੀ ਸਖ਼ਤੀ ਤੋਂ ਅਸੈਸੀ ਨੂੰ ਬਚਾਉਣਾ ਹੈ, ਮੁੱਖ ਤੌਰ 'ਤੇ ਉਹ ਕੇਸਾਂ ਵਿੱਚ ਜਿੱਥੇ ਬਾਜ਼ਾਰ ਮੁੱਲ ਅਤੇ ਅਪਣਾਈ ਗਈ ਨਿਯਮ ਮੁੱਲ ਵਿਚਕਾਰ ਅੰਤਰ ਘੋਸ਼ਿਤ ਰਾਸ਼ੀ ਦੇ ਸਬੰਧ ਵਿੱਚ ਸਪਸ਼ਟ ਤੌਰ 'ਤੇ ਅਤਿ ਮਹੱਤਵਪੂਰਨ ਹੈ। ਇਹ 15% ਜਾਂ ਇਸ ਤੋਂ ਵੱਧ ਦਾ ਅੰਤਰ ਸਿਰਫ਼ ਇੱਕ ਰਕਸ਼ਣਹੀਣ ਉਪਾਅ ਹੈ ਜੋ ਅਸੈਸੀ ਨੂੰ ਅਨਾਵਸ਼ਕ ਕਠੋਰਤਾ ਤੋਂ ਬਚਾਉਣ ਲਈ ਹੈ ਜੋ ਉੱਥੇ ਹੋ ਸਕਦੀ ਹੈ ਜਿੱਥੇ ਅਸੈਸੀ ਸਵੀਕਾਰ ਕੀਤੀ ਗਈ ਰਕਮ ਦੇ ਪਿੱਛੇ ਸੱਚਾਈ ਪ੍ਰਤੀ ਉਦਾਸੀਨ ਹੈ ਅਤੇ ਇਸ ਨਾਲ ਕੋਈ ਸਬੰਧ ਨਹੀਂ ਹੈ। 4: 4. ਇੱਕ ਵਾਰ ਜਦੋਂ ਮਾਲੀਆ ਦੁਆਰਾ ਇਹ ਸਥਾਪਿਤ ਹੋ ਜਾਂਦਾ ਹੈ ਕਿ ਟ੍ਰਾਂਸਫਰ ਲਈ ਵਿਚਾਰ ਘੱਟ ਦੱਸਿਆ ਗਿਆ ਹੈ, ਤਾਂ ਉਪ-ਧਾਰਾ (2) ਤੁਰੰਤ ਆਕਰਸ਼ਿਤ ਕੀਤੀ ਜਾਂਦੀ ਹੈ, ਬੇਸ਼ੱਕ 15% ਜਾਂ ਇਸ ਤੋਂ ਵੱਧ ਅੰਤਰ ਦੀ ਸ਼ਰਤ ਦੀ ਪੂਰਤੀ ਦੇ ਅਧੀਨ, ਅਤੇ ਮਾਲੀਆ ਨੂੰ ਫਿਰ ਇਹ ਦਰਸਾਉਣ ਦੀ ਲੋੜ ਨਹੀਂ ਹੈ ਕਿ ਘੱਟ ਬਿਆਨ ਦੀ ਸਹੀ ਹੱਦ ਕੀ ਹੈ ਜਾਂ ਦੂਜੇ ਸ਼ਬਦਾਂ ਵਿੱਚ, ਅਸੈਸੀ ਦੁਆਰਾ ਅਸਲ ਵਿੱਚ ਪ੍ਰਾਪਤ ਕੀਤਾ ਵਿਚਾਰ ਕੀ ਹੈ। ਇਹ ਜ਼ਿਆਦਾਤਰ ਮਾਮਲਿਆਂ ਵਿੱਚ ਮੁਸ਼ਕਲ ਹੋਵੇਗਾ, ਜੇ ਅਸੰਭਵ ਨਹੀਂ, ਤਾਂ ਦਿਖਾਉਣਾ ਅਤੇ ਇਸ ਲਈ ਉਪ-ਧਾਰਾ (2) ਮਾਲੀਆ ਨੂੰ ਘੱਟ ਬਿਆਨ ਜਾਂ ਛੁਪਾਉਣ ਦੀ ਹੱਦ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਸਬੂਤ ਦੇ ਸਾਰੇ ਬੋਝ ਤੋਂ ਮੁਕਤ ਕਰਦੀ ਹੈ ਅਤੇ ਟ੍ਰਾਂਸਫਰ ਦੇ ਸੰਬੰਧ ਵਿੱਚ ਪ੍ਰਾਪਤ ਕੀਤੇ ਗਏ ਵਿਚਾਰ ਦਾ ਇੱਕ ਕਾਨੂੰਨੀ ਮਾਪ ਪ੍ਰਦਾਨ ਕਰਦੀ ਹੈ। ਇਹ ਕੋਈ ਕਾਲਪਨਿਕ ਰਸੀਦ ਨਹੀਂ ਬਣਾਉਂਦਾ। ਇਹ ਕਿਸੇ ਅਜਿਹੀ ਚੀਜ਼ ਨੂੰ ਰਸੀਦ ਨਹੀਂ ਮੰਨਦਾ ਜੋ ਅਸਲ ਵਿੱਚ ਪ੍ਰਾਪਤ ਨਹੀਂ ਹੋਈ ਹੈ। ਇਹ ਸਿਰਫ਼ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਅਸਲ ਵਿੱਚ ਪ੍ਰਾਪਤ ਕੀਤੇ ਗਏ ਵਿਚਾਰ ਦਾ ਇੱਕ ਕਾਨੂੰਨੀ ਸਭ ਤੋਂ ਵਧੀਆ ਨਿਰਣਾ ਮੁਲਾਂਕਣ ਪ੍ਰਦਾਨ ਕਰਦਾ ਹੈ ਅਤੇ ਇਸ ਆਧਾਰ 'ਤੇ ਪੂੰਜੀ ਲਾਭਾਂ 'ਤੇ ਟੈਕਸ ਲਗਾਉਂਦਾ ਹੈ ਕਿ ਪੂੰਜੀ ਸੰਪਤੀ ਪ੍ਰਤੀਰੂਪ ਦਾ ਉਚਿਤ ਬਾਜ਼ਾਰ ਮੁੱਲ ਮੁਲਾਂਕਣਕਰਤਾ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਕੀਤੇ ਗਏ ਅਸਲ ਵਿਚਾਰ ਨੂੰ ਉਸ ਦੁਆਰਾ ਗਲਤ ਢੰਗ ਨਾਲ ਘੋਸ਼ਿਤ ਜਾਂ ਪ੍ਰਗਟ ਕੀਤੇ ਗਏ ਵਿਚਾਰ ਦੇ ਵਿਰੁੱਧ ਭੇਜਦਾ ਹੈ। ਉਪ-ਧਾਰਾ (2) ਦੇ ਨਿਰਮਾਣ ਵਿੱਚ ਇਹ ਪਹੁੰਚ ਪੂੰਜੀ ਲਾਭਾਂ 'ਤੇ ਟੈਕਸ ਨਾਲ ਸਬੰਧਤ ਉਪਬੰਧਾਂ ਦੀ ਯੋਜਨਾ ਦੇ ਨਾਲ 1 ਵਿੱਚ ਆਉਂਦਾ ਹੈ। 4: 5. ਧਾਰਾ 52 ਇੱਕ ਚਾਰਜਿੰਗ ਸੈਕਸ਼ਨ ਨਹੀਂ ਹੈ ਸਗੋਂ ਇੱਕ ਗਣਨਾ ਸੈਕਸ਼ਨ ਹੈ। ਇਸਨੂੰ ਧਾਰਾ 48 ਦੇ ਨਾਲ ਪੜ੍ਹਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ ਜੋ ਗਣਨਾ ਦਾ ਢੰਗ ਪ੍ਰਦਾਨ ਕਰਦਾ ਹੈ ਅਤੇ ਜਿਸਦੇ ਤਹਿਤ ਗਣਨਾ ਦਾ ਸ਼ੁਰੂਆਤੀ ਬਿੰਦੂ "ਪ੍ਰਾਪਤ ਜਾਂ ਪ੍ਰਾਪਤ ਕੀਤੇ ਗਏ ਵਿਚਾਰ ਦਾ ਪੂਰਾ ਮੁੱਲ" ਹੈ। ਜੋ ਅਸਲ ਵਿੱਚ ਕਦੇ ਇਕੱਠਾ ਨਹੀਂ ਹੋਇਆ ਜਾਂ ਕਦੇ ਨਹੀਂ ਹੋਇਆ ਪ੍ਰਾਪਤ ਹੋਇਆ, ਉਸਨੂੰ ਧਾਰਾ 41 ਦੇ ਤਹਿਤ ਪੂੰਜੀ ਲਾਭ ਵਜੋਂ ਗਿਣਿਆ ਨਹੀਂ ਜਾ ਸਕਦਾ। ਇਸ ਲਈ ਉਪ-ਧਾਰਾ (2) ਨੂੰ ਪੂੰਜੀ ਲਾਭ ਦੀ ਗਣਨਾ ਦੇ ਅੰਦਰ ਲਿਆਉਣ ਵਜੋਂ ਨਹੀਂ ਸਮਝਿਆ ਜਾ ਸਕਦਾ। ਇਹ ਰਕਮ, ਕਿਸੇ ਵੀ ਕਲਪਨਾ ਦੁਆਰਾ, ਇਹ ਨਹੀਂ ਕਿਹਾ ਜਾ ਸਕਦਾ ਕਿ ਇਹ ਮੁਲਾਂਕਣਕਰਤਾ ਨੂੰ ਇਕੱਠੀ ਹੋਈ ਹੈ ਜਾਂ ਉਸ ਦੁਆਰਾ ਪ੍ਰਾਪਤ ਕੀਤੀ ਗਈ ਹੈ। Case: K.P.
