1. Heard Mr. Mehta the learned counsel for the
appellant-Assessee. Income Tax Appeal Lodging No.
1359 of 2008 has been filed by the Assessee against
the order dated 17/9/2007 passed by the Income Tax
Appellate Tribunal. As the said appeal has been filed
beyond time, this Notice of Motion has been taken out
for condonation of delay.
2. The delay caused is of 92 days and the same
has been explained in the affidavit filed by Shri

Bijal Desai, Secretary of the Appellant - Company and
we are satisfied that good and sufficient reasons have
been made out to condone the delay.
3. Hence the Notice of Motion is allowed in terms
of prayer clause (a).
4. List the appeal for admission before the
