Heard learned counsel for the parties.
On consideration of submissions made on behalf of therespective parties and the material made available for my perusal as well asevidence produced during trial and more particularly looking to the amountof gratification and also the fact that the decision of the appeal is likely totake time, but without expressing any final opinion on the merit and de-merit of the case, I am inclined to suspend the sentence awarded to himduring the pendency of the appeal.
Accordingly, the application for suspension of sentence isallowed. It is ordered that the sentence awarded to accused-applicant
Mahesh Kumar Soni S/o Shri Magan Lal Soni in Sessions Case No.13/2005shall remain suspended on furnishing a personal bond of Rs.50,000/- andtwo sureties bond of Rs.25,000/- each to the satisfaction of the learned trialCourt to the effect that he shall appear before this Court on 9.2.2017 and asand when called upon to do so.
