ਖਾਸ ਇਜਾਜ਼ਤ ਦੀ ਅਪੀਲ ਬੰਬਈ ਹਾਈ ਕੋਰਟ ਦੇ 24 ਫਰਵਰੀ 1965 ਦੇ ਫੈਸਲੇ ਅਤੇ ਹੁਕਮ ਤੋਂ ਜੋ ਕਿ 'ਆਮਦਨ ਟੈਕਸ ਰੈਫਰੈਂਸ ਨੰਬਰ 3 ਦਾ 1962' ਵਿੱਚ ਸੀ.
ਡੀ. ਐਚ. ਦ੍ਵਾਰਕਾਦਾਸ, ਭੁਵਨੇਸ਼ ਕੁਮਾਰੀ ਅਤੇ ਜੇ. ਬੀ. ਦਾਦਾਚਾਂਜੀ ਲਈ, ਨਿਰੇਨ ਦੇ, ਸੌਲਿਸਿਟਰ-ਜਨਰਲ, ਐਸ. ਕੇ. ਅਯਿਆਰ, ਆਰ. ਐਨ. ਸਚਥੇ ਅਤੇ ਬੀ. ਡੀ. ਸ਼ਰਮਾ, ਜਵਾਬਦੇਹ ਲਈ.

Under s. 28( l) (c) of the Inaome-tax Act, 1922, if an assessee conceals particulars of his income, then, in addition to any tax iJayablc by him, he may be directed to pay, by way of penalty, a sum not exceeding one and a half times the amount of the tax which would have been avoided c if the income as returned by him had been accepted as correct.
For the assessment year 194849, the asscssee showed an income of Rs. 45,904 in his return. 'fhe Department disalluwcJ c;.,;rtuia deductions and corrected the figure to Rs. 48.135. It also added two other items; (i) Rs. 90,000 which was not concealed but which should have been in-cluded in the assesscc's return of income, and (ii) R'i. 24,000 v.rhich. After ascertaining the asse~sce's income at Rs. 1,62,135 (Rs. 48.135 +Rs. 90.000 -i- Rs. 24.000\, the Department sought to impose on the assessce a penalty of Rs. 62,00\J under s. 28(l)(c), on the hasis that the maximum penalty tha' eould be imposed is one and a half times the amount of diffe'rencc between the tax on Rs. 1,62,135 (ascertained income) and the tax on Rs. 45,904 !returned income). ਆਈਟਮ ਦੀ ਰਕਮ Rs. 24,000 ਨੂੰ ਛੁਪਾਈ ਗਈ ਆਮਦਨ ਵਜੋਂ ਮੰਨਿਆ ਜਾ ਸਕਦਾ ਹੈ ਅਤੇ ਦੂਜੀ ਰਕਮ Rs. 90,000 ਨੂੰ ਅਜਿਹਾ ਨਹੀਂ ਮੰਨਿਆ ਜਾ ਸਕਦਾ ਸਜ਼ਾ ਲਗਾਉਣ ਦੇ ਉਦੇਸ਼ ਲਈ। ਉਸ ਦੀ ਰਾਏ ਵਿੱਚ, ਅਧਿਕਤਮ ਜੁਰਮਾਨਾ ਜੋ s. 281(1)(c) ਅਧੀਨ ਦੇਣਯੋਗ ਸੀ ਉਹ Rs. 30,000 ਸੀ ਅਤੇ ਸਾਰੀਆਂ ਪਰਿਸਥਿਤੀਆਂ ਨੂੰ ਧਿਆਨ ਵਿੱਚ ਰੱਖਦਿਆਂ ਉਸ ਨੇ ਕਰਦਾਤਾ 'ਤੇ ਕੇਵਲ Rs. 20,000 ਦਾ ਜੁਰਮਾਨਾ ਲਗਾਇਆ। ਅਪੀਲ ਵਿੱਚ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਨਾਲ ਸਹਿਮਤੀ ਜਤਾਈ ਕਿ Rs. 90,000 ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਕੋਈ ਛੁਪਾਈ ਨਹੀਂ ਸੀ ਪਰ Rs. 24,000 ਦੀ ਰਕਮ ਦੀ ਛੁਪਾਈ ਦਾ ਪਤਾ ਲਗਾਇਆ। ਟ੍ਰਿਬਿਊਨਲ ਨੇ ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਜਿਵੇਂ ਕਿ ਮੁਨਾਫ਼ੇ ਦੀ ਛੁਪਾਈ ਹੋਈ ਸੀ, ਇਹ ਬਿਲਕੁਲ ਬੇਅਸਰ ਸੀ ਕਿ ਇੱਕ ਆਈਟਮ ਜਾਂ ਇੱਕ ਤੋਂ ਵੱਧ ਆਈਟਮਾਂ ਨੂੰ ਛੁਪਾਇਆ ਗਿਆ ਸੀ ਅਤੇ s. 28(1)(c) ਅਧੀਨ ਆਈਟਮਾਂ ਦੀ ਗਿਣਤੀ ਉਨ੍ਹਾਂ ਆਈਟਮਾਂ 'ਤੇ ਟੈਕਸ ਦੇ ਆਧਾਰ 'ਤੇ ਨਹੀਂ ਸੀ ਪਰ ਕਰਦਾਤਾ ਦੀ ਅੰਤਿਮ ਤੌਰ 'ਤੇ ਮੁਲਾਂਕਣ ਕੀਤੀ ਗਈ ਆਮਦਨ 'ਤੇ ਟੈਕਸ ਅਤੇ ਉਸ ਟੈਕਸ ਦੇ ਵਿਚਕਾਰ ਦੇ ਫਰਕ 'ਤੇ ਨਹੀਂ ਜੋ ਉਸ ਦੇ ਦੁਆਰਾ ਦਾਖਲ ਕੀਤੀ ਗਈ ਵਾਪਸੀ ਨੂੰ ਸਹੀ ਮੰਨਿਆ ਗਿਆ ਹੁੰਦਾ। ਟ੍ਰਿਬਿਊਨਲ
ਨੇ ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀ ਦੇ ਆਦੇਸ਼ ਨੂੰ ਬਹਾਲ ਕੀਤਾ ਜਿਸ ਨੇ Rs. 62,000 ਦਾ ਜੁਰਮਾਨਾ ਲਗਾਇਆ।
ਹਾਈ ਕੋਰਟ ਅੱਗੇ ਪੇਸ਼ ਕੀਤੀ ਗਈ ਦਲੀਲ ਇਹ ਸੀ ਕਿ s. 28(1)(c) ਦੀ ਸੱਚੀ ਵਿਆਖਿਆ ਅਨੁਸਾਰ ਜੁਰਮਾਨਾ ਕੇਵਲ ਛੁਪਾਈ ਗਈ ਆਮਦਨ 'ਤੇ ਲਗਾਏ ਗਏ ਟੈਕਸ ਦੇ 1½ ਗੁਣਾ ਹੋ ਸਕਦਾ ਹੈ। ਇਹ ਜੋਰ ਦਿੱਤਾ ਗਿਆ ਸੀ ਕਿ ਅਧਿਕਤਮ ਜੁਰਮਾਨਾ ਉਸ ਟੈਕਸ ਦੇ ਆਧਾਰ 'ਤੇ ਗਣਨਾ ਕੀਤੀ ਜਾਣੀ ਚਾਹੀਦੀ ਹੈ ਜੋ ਬਚਾਇਆ ਗਿਆ ਹੈ ਅਰਥਾਤ ਜੋ ਟੈਕਸ ਛੁਪਾਈ ਕਾਰਨ ਬਚਾਇਆ ਗਿਆ ਹੈ ਅਤੇ ਕਿਸੇ ਹੋਰ ਕਾਰਨ ਕਰਕੇ ਨਹੀਂ ਕਿਉਂਕਿ ਇੱਕ ਕਰਦਾਤਾ ਗਲਤੀ ਨਾਲ ਤੱਥ ਜਾਂ ਕਾਨੂੰਨ ਵਿੱਚ ਗਲਤੀ ਕਰ ਸਕਦਾ ਹੈ ਅਤੇ ਬੋਨਾ ਫਾਈਡ ਆਮਦਨ ਦੀਆਂ ਕੁਝ ਆਈਟਮਾਂ ਨੂੰ ਆਪਣੀ ਵਾਪਸੀ ਵਿੱਚ ਸ਼ਾਮਲ ਨਹੀਂ ਕਰ ਸਕਦਾ। ਆਮਦਨ ਟੈਕਸ
ਅਧਿਕਾਰੀ ਵੱਖਰਾ ਨਜ਼ਰੀਆ ਅਪਣਾ ਸਕਦੇ ਹਨ ਅਤੇ ਉਹ ਆਮਦਨ ਨੂੰ ਜੋੜ ਸਕਦੇ ਹਨ ਪਰ ਉਹ ਜੋੜ
ਜੁਰਮਾਨਾ ਨੂੰ ਆਕਰਸ਼ਿਤ ਨਹੀਂ ਕਰੇਗਾ। ਹਾਈ ਕੋਰਟ ਦੇ ਸ਼ਬਦਾਂ ਵਿੱਚ ਉਹਨਾਂ ਦੀ ਦਲੀਲ ਇਸ ਤਰ੍ਹਾਂ ਦੀ ਸੀ:
"ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀਆਂ ਦੁਆਰਾ ਟ੍ਰਿਬਿਊਨਲ ਨੂੰ ਉਸ ਦੁਆਰਾ ਦਿੱਤੀ ਗਈ ਆਮਦਨ ਵਿੱਚ ਕੀਤੇ ਗਏ ਜੋੜ ਕਰਦਾਤਾ ਦੁਆਰਾ 'ਆਮਦਨ ਵਜੋਂ ਦਿੱਤੀ ਗਈ' ਦਾ ਹਿੱਸਾ ਬਣਦੇ ਹਨ। ਇਸ ਮਾਮਲੇ ਵਿੱਚ, ਛੁਪਾਈ ਦੇ ਕਾਰਨ ਜੋੜੀ ਗਈ ਇਕੋ ਰਕਮ Rs. 24,000 ਹੈ। ਬਾਕੀ ਜੋੜ ਕੁਝ ਖਰਚਿਆਂ ਦੇ ਨਾਮਨਜੂਰੀ
ਕੀਤੇ ਗਏ ਜੋੜ ਕਰਦਾਤਾ ਦੁਆਰਾ 'ਆਮਦਨ ਵਜੋਂ ਦਿੱਤੀ ਗਈ' ਦਾ ਹਿੱਸਾ ਬਣਦੇ ਹਨ। ਇਸ ਮਾਮਲੇ ਵਿੱਚ,
ਅਤੇ Rs. 90,000 ਦੇ ਅਣਪਛਾਤੇ ਸਰੋਤ ਤੋਂ ਆਮਦਨ ਦੇ ਜੋੜ ਦੇ ਕਾਰਨ ਹਨ ਜੋ ਕਰਦਾਤਾ ਦੁਆਰਾ ਦਿੱਤੀ ਗਈ ਆਮਦਨ ਦੇ ਹਿੱਸੇ ਹਨ। ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਲਗਾਏ ਜਾ ਸਕਣ ਵਾਲੇ ਅਧਿਕਤਮ ਜੁਰਮਾਨਾ Rs. 162,135 ਅਤੇ Rs. 138,135 ਸੀ ਜੋ ਇਸ ਦੇ (Rs. 48,135 ਜੋ ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀ ਦੁਆਰਾ ਗਣਨਾ ਕੀਤੀ ਗਈ ਅਤੇ Rs. 90,000 ਜੋ ਅਣਪਛਾਤੇ ਸਰੋਤ ਤੋਂ ਆਮਦਨ ਵਜੋਂ ਜੋੜੀ ਗਈ) ਵਿਚਕਾਰ ਅਤੇ ਅੱਧੇ ਗੁਣਾ ਟੈਕਸ ਦੇ ਫਰਕ ਦੇ ਤੌਰ 'ਤੇ ਸੀ।"
ਰੈਵੇਨਿਊ ਵੱਲੋਂ ਲਿਆ ਗਿਆ ਸਥਾਨ ਅਤੇ ਸਾਡੇ ਸਾਹਮਣੇ ਸਮਰਥਨ ਕੀਤਾ ਗਿਆ ਹੈ ਕਿ s. 28(1)(c) ਪ੍ਰਦਾਨ ਕਰਦਾ ਹੈ ਕਿ ਜੇਕਰ ਆਮਦਨ ਦੀ ਛੁਪਾਈ ਦੀ ਇੱਕ ਆਈਟਮ ਦਾ ਪਤਾ ਲਗਾਇਆ ਜਾਂਦਾ ਹੈ ਤਾਂ ਮਨਸੁੱਖਲਾਲ ਬਨਾਮ ਸੀ.ਆਈ.ਟੀ. (ਗਰੋਵਰ, ਨਾਇਬ ਨਿਆਂਕ)
ਅਧਿਕਤਮ ਜੁਰਮਾਨਾ ਜੋ ਲਗਾਇਆ ਜਾ ਸਕਦਾ ਹੈ ਉਹ ਅੰਤਿਮ ਤੌਰ 'ਤੇ ਆਕਲਿਤ ਕੁੱਲ ਆਮਦਨ 'ਤੇ ਟੈਕਸ ਅਤੇ ਕਰਦਾਤਾ ਦੇ ਰਿਟਰਨ ਵਿੱਚ ਦਿਖਾਈ ਗਈ ਆਮਦਨ 'ਤੇ ਟੈਕਸ ਵਿੱਚਕਾਰ ਫਰਕ ਦੇ 1½ ਗੁਣਾ ਹੈ, ਭਾਵੇਂ ਛੁਪਾਈ ਗਈ ਰਕਮ ਦੀ ਮਾਤਰਾ ਕੁਝ ਵੀ ਹੋਵੇ। ਇਸ ਆਧਾਰ 'ਤੇ ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਲਗਾਇਆ ਜਾਣ ਵਾਲਾ ਜੁਰਮਾਨਾ, 85,404 ਰੁਪਏ (ਵਾਪਸੀ ਆਮਦਨ) ਅਤੇ 1,62,135 ਰੁਪਏ (ਆਮਦਨ ਜੋ ਕਿ ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀ ਦੁਆਰਾ ਆਕਲਿਤ ਕੀਤੀ ਗਈ) ਦੇ ਟੈਕਸ 'ਤੇ ਫਰਕ ਦੇ ਟੈਕਸ ਦੇ ਰਕਮ ਦੇ 1½ ਗੁਣਾ ਹੋਵੇਗਾ।
ਉੱਚ ਅਦਾਲਤ ਦਾ ਮੰਨਣਾ ਸੀ ਕਿ ਧਾਰਾ 28 (1) (ਸੀ) ਵਿੱਚ ਆਉਣ ਵਾਲੇ "ਵਾਪਸੀ ਵਿੱਚ ਦਿਖਾਈ ਗਈ ਆਮਦਨ" ਦਾ ਭਾਵ ਕਰਦਾਤਾ ਦੁਆਰਾ ਰਿਟਰਨ ਵਿੱਚ ਦਿਖਾਈ ਗਈ ਆਮਦਨ ਹੈ ਅਤੇ ਨਾ ਕਿ ਛੁਪਾਈ ਗਈ ਆਮਦਨ 'ਤੇ ਆਧਾਰਿਤ ਗਣਨਾ ਹੈ। ਇਸਦਾ ਮਤਲਬ ਹੈ ਕਿ ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀਆਂ ਦੀ ਅਧਾਰਤ ਆਮਦਨ ਵਿੱਚ ਜੋੜੀ ਗਈ ਆਮਦਨ। ਉੱਚ ਅਦਾਲਤ ਨੇ ਧਾਰਾ 28(1)(ਸੀ) ਦੇ ਪ੍ਰਾਵਧਾਨਾਂ ਵਿੱਚ ਕੋਈ ਵਿਧਾਇਕ ਇਰਾਦਾ ਨਹੀਂ ਪਾਇਆ ਜੋ ਕਿ ਟੈਕਸ ਦੀ ਬਚਤ ਨੂੰ ਆਮਦਨ ਦੀ ਛੁਪਾਈ ਨਾਲ ਜੋੜਦਾ ਹੋਵੇ ਜਾਂ ਜੋ ਇਹ ਫੈਸਲਾ ਕਰਨ ਦਾ ਔਚਿਤ ਹੋਵੇ ਕਿ ਅਧਿਕਤਮ ਜੁਰਮਾਨਾ ਜੋ ਨਿਰਧਾਰਿਤ ਕੀਤਾ ਗਿਆ ਹੈ ਉਹ ਛੁਪਾਈ ਗਈ ਰਕਮ ਦੇ ਅਨੁਪਾਤ ਵਿੱਚ ਹੋਣਾ ਚਾਹੀਦਾ ਹੈ। ਕੁਝ ਫੈਸਲਿਆਂ ਨੂੰ ਵਿਚਾਰਨ ਤੋਂ ਬਾਅਦ ਉੱਚ
ਅਦਾਲਤ ਨੇ, ਜਦੋਂ ਕਿ ਇਹ ਮੰਨਣਾ ਸੀ ਕਿ ਲਗਾਇਆ ਗਿਆ ਜੁਰਮਾਨਾ ਛੁਪਾਈ ਗਈ ਰਕਮ ਦੇ ਮੁਕਾਬਲੇ ਵਿੱਚ ਬਹੁਤ ਜ਼ਿਆਦਾ ਭਾਰੀ ਲੱਗਦਾ ਹੈ, ਕਰਦਾਤਾ ਖਿਲਾਫ ਜਵਾਬ ਵਾਪਸ ਕੀਤਾ।
ਧਾਰਾ 28(1) ਜਿੰਨੀ ਮਹੱਤਵਪੂਰਣ ਹੈ ਉਹ ਹੇਠਾਂ ਦੁਬਾਰਾ ਪੇਸ਼ ਕੀਤੀ ਗਈ ਹੈ:

(2) The word 'avoided' in the section does not mean evaded. lt is used in the sense of escapement. The Legislature wanted the incon1e·· tax authorities to determine what would have been the amount of tax that would have esc!aped assessment had the income as shown in the return been accepted as correct and one and a half tin1-es that amount B would be the maximum penalty which can be imposed when it was dis-covered that income had -been concealed. So far as the expression 'income as returned' is concerned, it means inconw as shown in the return filed under s. 2.2. and not the income computed or ascertained by the income-tax authorities minus the income added on the gTound of con-cealment. Therefore, under s. 28 ( 1) ( c), if an item of concealment is discovered, the maximum penalty which can be imposed is one and a half times the difference between the tax on the total income as finally c assessed and the tax on the income as shown in the afisessee' return, irres-pective of the amount of concealment. Grover, J. This is an appeal by special leave from a judge-ment of the Bombay High Court in a reference made under s 66(1) of the Income tax Act, 1922, hereinafter called the Act, answering the following question which had been referred to it F in the negative and against the assessee :
"Whether in· computing for purposes of levy of penalty under s. 28 ( 1) ( c) the amount of income tax and super tax which would have been avoided if the income as returned had been accepted, such 'income as returned' includes item of income too, which though not actually returned had been added in the assessment solely on ground of lack of evidence?"

The assessee is a firm dealing in hessian, twines, gunny bags, etc., on wholesale basis. For the assessment year 1948-49 the assessee had returned income amounting to Rs. 45,904. The Income tax Officer, however, added two items of Rs. 24,000 and Rs. 90,000 H as profits and income from undisclosed sources which had been concealed by the assessee. A penalty of Rs. 62,000 was imposed •within the maximum limits provided bys. 28(l)(c) of the Act.
The Appellate Assistant Commissioner in appeal held that ouly

• the item of Rs. 24,000 could be treated as concealed income and the other amount of Rs. 90,000 could not be treated as such for the purpose of imposing a penalty. In his opinion maximum penalty payable under s. 281.1) (c) came to Rs. 30,000 and tak-ing into consideration all the circumstances he imposed a p~nalty of Rs. 20,000 only on the assessee. In appeal the Appcllat1: Tribunal agreed with the Appellate Assistant Commissioner that there was no concealment in the matter in respect of Rs. 90,000 but affirmed the finding of concealment of the amount of Rs. 24,000. It was held by the tribunal that as ther.e had been concealment of profit it was wholly immaterial whether one item or more than one item had been concealed and the quantum had to he computed under s. 28 ( 1) ( c) not on the basis of tax on the items proved to have been concealed but on the difference bet-ween the tax on the a;sesscc's income as finally assessed and the tax which would haw been avoided if the return tiled by him had been accepted as correct. The tribunal restored the order of the Income tax p!licer imposing a penalty of Rs. 62,000.

ਅਦਾਲਤ ਨੇ, ਜਦੋਂ ਕਿ ਇਹ ਮੰਨਣਾ ਸੀ ਕਿ ਲਗਾਇਆ ਗਿਆ ਜੁਰਮਾਨਾ ਛੁਪਾਈ ਗਈ ਰਕਮ ਦੇ ਮੁਕਾਬਲੇ ਵਿੱਚ ਬਹੁਤ ਜ਼ਿਆਦਾ ਭਾਰੀ ਲੱਗਦਾ ਹੈ, ਕਰਦਾਤਾ ਖਿਲਾਫ ਜਵਾਬ ਵਾਪਸ ਕੀਤਾ।
ਧਾਰਾ 28(1) ਜਿੰਨੀ ਮਹੱਤਵਪੂਰਣ ਹੈ ਉਹ ਹੇਠਾਂ ਦੁਬਾਰਾ ਪੇਸ਼ ਕੀਤੀ ਗਈ ਹੈ:
"(1) ਜੇਕਰ ਆਮਦਨ ਟੈਕਸ ਅਧਿਕਾਰੀ, ਅਪੀਲੀ ਸਹਾਇਕ ਕਮਿਸ਼ਨਰ ਜਾਂ ਅਪੀਲੀ ਟ੍ਰਿਬਿਊਨਲ, ਇਸ ਐਕਟ ਅਧੀਨ ਕਿਸੇ ਵੀ ਕਾਰਵਾਈ ਦੌਰਾਨ, ਇਸ ਗੱਲ ਤੋਂ ਸੰਤੁਸ਼ਟ ਹੁੰਦਾ ਹੈ ਕਿ ਕੋਈ ਵਿਅਕਤੀ— "ਇਹ ਧਾਰਾ ਇੱਕ ਦੰਡਾਤਮਕ ਧਾਰਾ ਹੈ, ਅਤੇ ਇਸ ਦੇ ਨਤੀਜੇ, ਜਿੱਥੇ ਵੀ ਹੋਣ, ਇਹ ਇੱਕ ਅਸਰਦਾਰ ਰੋਕਥਾਮ ਹੈ ਜੋ ਉਹ ਪ੍ਰਥਾਵਾਂ ਨੂੰ ਰੋਕਣ ਲਈ ਹੈ ਜਿਸਨੂੰ ਵਿਧਾਇਕ ਜਨਹਿਤ ਵਿਰੁੱਧ ਮੰਨਦਾ ਹੈ। ਸਾਲਾਂ ਤੋਂ ਵਿਧਾਇਕ ਅਤੇ ਉਹ ਲੋਕ ਜੋ ਕਰ ਦਾ ਬੋਝ ਆਪਣੇ ਕੰਧਾਂ ਤੋਂ ਦੂਜਿਆਂ ਦੇ ਕੰਧਾਂ 'ਤੇ ਸੁੱਟਣ ਦੀ ਸੋਚ ਰੱਖਦੇ ਹਨ, ਵਿਚਕਾਰ ਇੱਕ ਯੁੱਧ ਲੜਿਆ ਗਿਆ ਹੈ। ਉਸ ਯੁੱਧ ਵਿੱਚ ਵਿਧਾਇਕ ਦੇ ਪਾਸ ਆਖਰੀ ਸ਼ਬਦ ਹੈ।" ਅਕਸਰ ਇਸ ਨੂੰ ਵਿਰੋਧੀਆਂ ਦੀ ਮਹਾਰਤ, ਦ੍ਰਿੜਤਾ ਅਤੇ ਸਰੋਤਾਂ ਦੁਆਰਾ ਹਰਾਇਆ ਗਿਆ ਹੈ, ਜਿਨ੍ਹਾਂ ਵਿੱਚੋਂ ਮੌਜੂਦਾ ਅਪੀਲਕਰਤਾ ਘੱਟ ਸਫਲ ਨਹੀਂ ਰਿਹਾ ਹੈ। ਇਹ ਸਾਨੂੰ ਬਿਲਕੁਲ ਵੀ ਹੈਰਾਨ ਨਹੀਂ ਕਰੇਗਾ ਜੇ ਪਾਇਆ ਜਾਵੇ ਕਿ ਵਿਧਾਇਕ ਨੇ ਇਸ ਸੰਘਰਸ਼ ਨੂੰ ਖਤਮ ਕਰਨ ਦਾ ਨਿਰਧਾਰਨ ਕੀਤਾ ਹੈ ਸਖਤ ਤਰੀਨ ਜੁਰਮਾਨੇ ਲਗਾ ਕੇ।"
ਕੁਝ ਉੱਚ ਅਦਾਲਤਾਂ ਦੇ ਫੈਸਲੇ ਹਨ ਜੋ ਅਪੀਲਕਰਤਾ ਲਈ ਸਿੱਖਿਆ ਪ੍ਰਾਪਤ ਵਕੀਲ ਦੁਆਰਾ ਪੇਸ਼ ਕੀਤੇ ਗਏ ਤਰਕ ਦਾ ਸਮਰਥਨ ਨਹੀਂ ਕਰਦੇ ਪਰ ਇਸਨੂੰ ਕਾਫੀ ਸਮਰਥਨ ਦੇਣ ਵਾਲਾ ਇਦਮ ਮੰਨਿਆ ਜਾ ਸਕਦਾ ਹੈ। ਸਾਲ 1933 ਵਿੱਚ ਪੇਜ, ਸੀ.ਜੇ., ਨੇ ਪੂਰੀ ਬੈਂਚ ਦੇ ਫੈਸਲੇ ਨੂੰ ਸੁਣਾਉਂਦਿਆਂ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ ਟੈਕਸ, ਬਰਮਾ ਬਨਾਮ ਏ. ਬੀ. ਆਰ. ਚੇਟੀਆਰ ਫਰਮ(1) ਵਿੱਚ ਦੇਖਿਆ ਕਿ ਧਾਰਾ 28(1) ਅਧੀਨ ਲਗਾਏ ਜਾ ਸਕਣ ਵਾਲੇ ਅਧਿਕਤਮ ਜੁਰਮਾਨੇ ਦੀ ਰਕਮ ਉਸ ਟੈਕਸ ਦੇ ਅੰਤਰ ਨੂੰ ਦਰਸਾਉਂਦੀ ਹੈ ਜੋ ਕਰਦਾਤਾ ਦੁਆਰਾ ਘੋਸ਼ਿਤ ਆਮਦਨ ਉੱਤੇ ਲਗਾਈ ਗਈ ਹੈ ਅਤੇ ਜੋ ਆਮਦਨ ਅਧੀਨ ਅਧਿਨਿਯਮ ਦੇ ਤਹਿਤ ਪਤਾ ਲਗਾਈ ਗਈ ਹੈ, ਜਿਸ ਦਾ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਹੈ। ਇਹ ਵਿਚਾਰ ਰੰਗੂਨ ਉੱਚ ਅਦਾਲਤ ਦੀ ਪੰਜ ਸਿੱਖਿਆ ਪ੍ਰਾਪਤ ਜੱਜਾਂ ਦੀ ਪੂਰੀ ਬੈਂਚ ਦੁਆਰਾ ਸਮਰਥਿਤ ਕੀਤਾ ਗਿਆ ਸੀ ਏ.ਆਰ. ਚੇਟੀਆਰ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ ਟੈਕਸ, ਬਰਮਾ(2)। ਕਲੀਚਿੰਤੀ ਸੁਬਰਾਜੂ ਗੋਪਾਲਰਾਜੂ & ਕੰ. ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ ਟੈਕਸ, ਮਦਰਾਸ(3) ਵਿੱਚ ਆਂਧਰਾ ਪ੍ਰਦੇਸ਼ ਉੱਚ ਅਦਾਲਤ ਦੀ ਵਿਭਾਗੀ ਬੈਂਚ ਜਿਸ ਦੀ ਅਧਿਕਾਰਤਾ ਸੁੱਬਾ ਰਾਓ, ਸੀ.ਜੇ. (ਜਿਵੇਂ ਕਿ ਉਹ ਉਸ ਸਮੇਂ ਸਨ) ਨੇ ਇੱਕ ਮਾਮਲੇ ਨੂੰ ਵਿਚਾਰਨਾ ਸੀ ਜਿਸ ਵਿੱਚ ਕਰਦਾਤਾ ਨੇ ਆਮਦਨ ਦੇ ਤੌਰ ਤੇ ਰੁ. 19,639 ਦੀ ਵਾਪਸੀ ਕੀਤੀ ਸੀ ਪਰ ਉਸਦੇ ਖਾਤੇ ਰੱਦ ਕਰ ਦਿੱਤੇ ਗਏ ਸਨ ਅਤੇ ਉਸਦੀ ਆਮਦਨ ਵਿੱਚ ਰੁ. 35,354 ਜੋੜੇ ਗਏ ਸਨ। ਇਸ ਵਿਚਾਰ ਦੇ ਅਧਾਰ ਉੱਤੇ ਕਿ ਕਰਦਾਤਾ ਨੇ ਸਿਰਫ ਦੋ ਆਈਟਮਾਂ ਦੀ ਰੁ. 1,000 ਦੀ ਜੋ ਉਸ ਨੇ ਵਿਕੀਆਂ ਵਸਤੂਆਂ ਦੀ ਵਿਕਰੀ ਮੁੱਲ ਵਜੋਂ ਪ੍ਰਾਪਤ ਕੀਤੀਆਂ ਸਨ, ਛੁਪਾਈ ਕੀਤੀ ਸੀ, ਰੁ. 4,000 ਦਾ ਜੁਰਮਾਨਾ ਧਾਰਾ 28(1) (ਸੀ) ਅਧੀਨ ਲਗਾਇਆ ਗਿਆ ਸੀ। ਇਹ ਫੈਸਲਾ ਕੀਤਾ ਗਿਆ ਸੀ ਕਿ ਹਾਲਾਂਕਿ ਦੋ ਆਈਟਮਾਂ ਦੀ ਰੁ. 1,000 ਦੀ ਛੁਪਾਈ ਦੇ ਸਬੂਤ ਸਨ, ਉਕਤ ਧਾਰਾ ਅਧੀਨ ਜੁਰਮਾਨਾ ਉਸ ਰਕਮ ਉੱਤੇ ਲਗਾਇਆ ਜਾ ਸਕਦਾ ਹੈ ਜੋ 11 ਗੁਣਾ ਨਹੀਂ ਵਧਦੀ ਜਿਸ ਦੀ ਆਮਦਨ ਕਰ ਅਤੇ ਸੁਪਰ ਕਰ, ਜੇ ਕੋਈ ਹੋਵੇ, ਵਾਸਤਵ ਵਿੱਚ ਲਾਗੂ ਕੀਤੀ ਗਈ ਅਤੇ ਸੰਦਰਭ ਕਰ ਦੀ ਰਕਮ ਜੋ ਮੂਲ ਵਾਪਸੀ ਨੂੰ ਸਹੀ ਮੰਨਿਆ ਗਿਆ ਹੁੰਦਾ ਤਾਂ ਅਦਾ ਕੀਤੀ ਜਾਂਦੀ।
ਇਸ ਅਦਾਲਤ ਦਾ ਇਕੋ ਫੈਸਲਾ ਜਿਸ ਉੱਤੇ ਅਪੀਲਕਰਤਾ ਲਈ ਵਕੀਲ ਨੇ ਭਰੋਸਾ ਕੀਤਾ ਸੀ ਐਨ. ਏ. ਮਹਾਜ ਅਤੇ ਭਰਾ ਬਨਾਮ ਕਮਿਸ਼ਨਰ ਆਫ ਇਨਕਮ ਟੈਕਸ, ਬੰਬਈ ਨੌਰਥ(4). ਇਸ ਮਾਮਲੇ ਵਿੱਚ ਕਰਦਾਤਾ ਉੱਤੇ ਆਮਦਨ ਦੀ ਛੁਪਾਈ ਸਬੰਧੀ ਮੁਲਾਂਕਣ ਸਾਲ 1951-52 ਲਈ ਦੋ ਵਾਰ ਜੁਰਮਾਨਾ ਲਗਾਇਆ ਗਿਆ ਸੀ। ਜਦੋਂ ਕਰਦਾਤਾ ਨੇ ਆਪਣੀ ਮੂਲ ਵਾਪਸੀ ਜਮ੍ਹਾਂ ਕੀਤੀ ਤਾਂ ਪਾਇਆ ਗਿਆ ਕਿ ਉਸ ਨੇ ਆਮਦਨ
ਕਰ ਛੁਪਾਇਆ ਹੈ ਅਤੇ ਰੁ. 20,000 ਦਾ ਜੁਰਮਾਨਾ ਲਗਾਇਆ ਗਿਆ। ਬਾਅਦ ਵਿੱਚ ਮੂਲ ਵਾਪਸੀ ਵਿੱਚ ਲਗਾਏ ਗਏ ਆਮਦਨ ਦੀ ਛੁਪਾਈ ਉੱਤੇ ਰੁ. 58,514 ਦਾ ਦੂਜਾ ਜੁਰਮਾਨਾ ਲਗਾਇਆ ਗਿਆ ਜੋ ਧਾਰਾ 34 ਅਧੀਨ ਨਹੀਂ ਉੱਠ ਸਕਦਾ ਸੀ ਅਤੇ ਦੂਜਾ ਜੁਰਮਾਨਾ ਲਗਾਉਣ ਵਾਲਾ ਹੁਕਮ ਗੈਰ-ਕਾਨੂੰਨੀ ਸੀ। ਕਰਦਾਤਾ ਦਾ ਤਰਕ ਜੋ ਮੂਲ ਵਾਪਸੀ ਵਿੱਚ ਜੁਰਮਾਨਾ ਲਗਾਉਣਾ ਗੈਰ-ਕਾਨੂੰਨੀ ਸੀ, ਰੱਦ ਕਰ ਦਿੱਤਾ ਗਿਆ ਸੀ।

The argument which was addressed before the High Court D was that on a true interpretation of s. 28 (I) ( c) the penalty could be only I± times of the tax payable on the concealed income. It was urged that the maximum penalty had to he calculated en the basis of tax avoided i.e. tax which had been evaded bv reason of concealment and not tax that had escaped for ·any other reason because an assessee might take a mistaken view of fact or Jaw and ho11a fide not include certain items of income in his E return. The Income tax authorities might take a different view and add that income but that addition would not attract r,i:nalty. In the words of the High Court the argument proceeded on these lines:-
"The additions made by the Income tax authorities or the tribunal to the income returned by him consti-tuted part of the· 'income as returned' by the asscssce. In the instant case. the only amount that has been added on account of concealment is Rs. 24.000. The rest of the additions on the ground of disallowance of certain expenditure and the addition of Rs. 90,000 as income from undisclosed source are parts of the income returned by the assessee. The maximum penalty thus, which could have been imposed in the instant case was one and half times the tax on the difference between Rs. 1,62,135 and Rs. 1,38.135 (Rs. 48.135 as com-puted by the Income tax Officer and Rs. 90,000 added as income from undisclosed source)."

On behalf of the Revenue the position that was taken up and has been sought to he supported before us is that s. 28 (I)( c) • provides that if an item of concealment of income is di>covered
A the maximum penalty which can be imposed is 1 I times the diffe-rence between· the tax on the total income as finally assessed and the tax on the income shown in the assessee's return irrespective of the amount of concealment. ·On that basis the penalty, le.vi-able, in the present case, would be 1 t times the amount of tax on the difference between the tax on Rs. 45,904 (returned income) B and Rs. 1,62,135 (income as assessed by the Income tax Officer.) The High Court was of the view that the expression "income as returned" occurring in s. 28 (1) ( c) means income disclosed by an assessee in the return and not income computed or assessed by the Income tax authorities minus the income added on the ground of concealment. The High Court found no legislative intent disclosed in the provisions of s. 28 ( 1 )( c) which would c link the avoidance of tax to the concealment of income or which would jus!ify holding that the maximum penalty prescribed in the section had to be proportionate to the extent of the concealment. After considering certain 1 decisions the High Court, while appre-ciating that the penalty imposed appeared to be disproportionately heavy to the amount concealed, returned the answer against the D assessee.

ਹਾਊਸ ਆਫ਼ ਲਾਰਡਜ਼ ਵਿੱਚ ਇਨਲੈਂਡ ਰੈਵੇਨਿਊ ਕਮਿਸ਼ਨਰਜ਼ ਬਨਾਮ ਹਿੰਚੀ(ਐਫ਼) ਵਿੱਚ ਲਿਆ ਗਿਆ ਭਾਰੀ ਫੈਸਲਾ, ਜਿਸ ਵਿੱਚ ਕੁਝ ਟਿੱਪਣੀਆਂ ਕੀਤੀਆਂ ਗਈਆਂ ਸਨ ਜੋ ਮੌਜੂਦਾ ਕੇਸ ਲਈ ਕਾਫ਼ੀ ਉਪਯੁਕਤ ਹਨ। ਆਮਦਨ ਕਰ ਐਕਟ, 1952 (15 & 16 ਜਿਓ 6 & ਐਲਿਜ਼. 2 ਸੀ.10) ਦੀ ਧਾਰਾ 25(3) ਵਿੱਚ ਇਹ ਪ੍ਰਾਵਧਾਨ ਹੈ ਕਿ ਜੋ ਵਿਅਕਤੀ ਕਿਸੇ ਵੀ ਨੋਟਿਸ ਵਿੱਚ ਨਿਰਧਾਰਿਤ ਸਮੇਂ ਦੇ ਅੰਦਰ ਪੇਸ਼ ਕਰਨ ਤੋਂ ਇਨਕਾਰ ਕਰਦਾ ਹੈ ਜਾਂ ਜਾਣਬੁੱਝ ਕੇ ਦੇਰੀ ਕਰਦਾ ਹੈ ਸੱਚੀ ਅਤੇ ਸਹੀ ਸੂਚੀ, ਐਲਾਨ, ਬਿਆਨ ਜਾਂ ਰਿਟਰਨ ਪੇਸ਼ ਕਰਨ ਵਿੱਚ, ਜੋ ਉਸ ਨੂੰ ਪਿਛਲੀਆਂ ਧਾਰਾਵਾਂ ਅਧੀਨ ਪੇਸ਼ ਕਰਨ ਦੀ ਲੋੜ ਹੈ, ਤਾਂ ਅਦਾਲਤ ਵਿੱਚ ਕਾਰਵਾਈ ਕੀਤੀ ਜਾਵੇਗੀ, ਉਸ ਨੂੰ £20 ਦਾ ਜੁਰਮਾਨਾ ਅਤੇ ਤਿੰਨ ਗੁਣਾ ਕਰ ਜੋ ਉਸ ਨੇ ਉਕਤ ਐਕਟ ਅਧੀਨ ਵਸੂਲ ਕਰਨਾ ਸੀ, ਦਾ ਭੁਗਤਾਨ ਕਰਨਾ ਪਵੇਗਾ। ਉਸ ਕੇਸ ਵਿੱਚ ਪ੍ਰਤੀਵਾਦੀ ਨੇ ਇੱਕ ਵਿਸ਼ੇਸ਼ ਮੁਲਾਂਕਣ ਵਰ੍ਹੇ ਲਈ ਆਮਦਨ ਭੇਜੀ ਸੀ ਜੋ £18.5s ਸੀ। ਇਹ ਖੋਜਿਆ ਗਿਆ ਕਿ ਉਸ ਨੇ ਘਾਟ ਮੁਲਾਂਕਣ ਕੀਤਾ ਸੀ ਅਤੇ ਉਸ ਉੱਤੇ £14 5s ਦਾ ਮੁਲਾਂਕਣ ਕੀਤਾ ਗਿਆ ਸੀ। ਇਨਲੈਂਡ ਰੈਵੇਨਿਊ ਕਮਿਸ਼ਨਰਜ਼ ਨੇ ਬਾਅਦ ਵਿੱਚ ਉਸ ਤੋਂ, ਧਾਰਾ 25(3)(ਏ) ਅਧੀਨ, £20 ਦਾ ਨਿਸ਼ਚਿਤ ਜੁਰਮਾਨਾ ਅਤੇ ਉਸ ਕਰ ਦਾ ਤਿੰਨ ਗੁਣਾ ਜੋ ਉਸ ਨੂੰ ਐਕਟ ਅਧੀਨ ਵਸੂਲ ਕਰਨਾ ਸੀ, ਦਾ ਦਾਅਵਾ ਕੀਤਾ, ਜਿਸ ਨੂੰ ਉਹਨਾਂ ਨੇ £148.15s ਵਿੱਚ ਗਣਨਾ ਕੀਤਾ। ਹਾਊਸ ਆਫ਼ ਲਾਰਡਜ਼ ਨੇ ਇਸ ਫੈਸਲੇ ਨੂੰ ਪਲਟ ਦਿੱਤਾ, ਫੈਸਲਾ ਕੀਤਾ ਕਿ ਕਰੋਨ ਨੂੰ ਪੂਰੀ ਰਕਮ ਦਾ ਹੱਕਦਾਰ ਹੈ, ਭਾਵ £20 ਅਤੇ £418 (14) ਐਡ., ਕਿਉਂਕਿ ਧਾਰਾ 25(3) ਦੇ ਸ਼ਬਦਾਂ ਨੂੰ ਵੱਡੇ ਜਾਂ ਵਧੇਰੇ ਅਰਥ ਵਿੱਚ ਲੈਣਾ, ਵਾਕ "ਜੋ ਕਰ ਉਸ ਨੂੰ ਚਾਰਜ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ" ਦਾ ਮਤਲਬ "ਪੂਰੇ ਕਰ ਦਾ ਤਿੰਨ ਗੁਣਾ ਜੋ ਕਰਦਾਤਾ ਉਤੇ ਸੰਬੰਧਿਤ ਵਰ੍ਹੇ ਲਈ ਚਾਰਜ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ" ਸੀ। ਅਪੀਲੀ ਅਦਾਲਤ ਦੇ ਫੈਸਲੇ ਦੇ ਪਿੱਛੇ ਵਿਚਾਰ ਇਹ ਸੀ ਕਿ ਜੁਰਮਾਨਾ ਪ੍ਰਾਵਧਾਨਾਂ ਨੇ ਅਧਿਕਤਮ ਜੁਰਮਾਨੇ ਪੈਦਾ ਕੀਤੇ ਜੋ ਪੂਰੀ ਤਰ੍ਹਾਂ ਉਸ ਦੀ ਹੱਦ ਨਾਲ ਸਬੰਧਤ ਨਹੀਂ ਸਨ, ਅਤੇ ਘੱਟੋ-ਘੱਟ ਇੱਕ ਵਿਸੰਗਤੀ ਜੋ ਸਾਧਾਰਣ ਨਿਆਂ ਦੇ ਵਿਰੁੱਧ ਚੱਲਣ ਵਾਲੀ ਸੋਚੀ ਜਾ ਸਕਦੀ ਹੈ। ਵਿਸਕਾਊਂਟ ਕਿਲਮੁਇਰ ਲਾਰਡ ਚਾਂਸਲਰ ਨੇ ਕਿਹਾ ਕਿ ਉਹ ਇਸ ਦਲੀਲ ਨੂੰ ਸਵੀਕਾਰ ਨਹੀਂ ਕਰ ਸਕਦੇ ਕਿ ਗਲਤ ਰਿਟਰਨ ਦੇ ਮਾਮਲੇ ਵਿੱਚ ਲਗਾਏ ਜਾਣ ਵਾਲੇ ਜੁਰਮਾਨੇ ਦੀ ਰਕਮ ਸਿਰਫ £20 ਅਤੇ ਉਸ ਰਕਮ ਦਾ ਤਿੰਨ ਗੁਣਾ ਹੀ ਹੋਵੇਗੀ ਜੋ ਕਰ ਦੇ ਟੈਕਸੇਸ਼ਨ ਤੋਂ ਬਚ ਜਾਂਦੀ ਜੇਕਰ ਪ੍ਰਤੀਵਾਦੀ ਦੁਆਰਾ ਬਣਾਈ ਗਈ ਗਲਤ ਰਿਟਰਨ ਮੁਲਾਂਕਣ ਦਾ ਆਧਾਰ ਬਣਦੀ।
ਲਾਰਡ ਚਾਂਸਲਰ; "ਕਰਨਾ ਲਾਰਡ ਚਾਂਸਲਰ ਦੀ ਰਾਏ ਵਿੱਚ, ਟੈਕਸ ਦੀ ਗਣਨਾ ਕੀਤੀ ਗਈ ਰਕਮ ਤੋਂ ਫਾਰਮ ਦੀ ਰਕਮ ਨੂੰ ਘਟਾਉਣਾ ਹੋਵੇਗਾ, ਅਤੇ ਇਸ ਘਟਾਉਣ ਦੇ ਆਧਾਰ 'ਤੇ ਲਾਰਡ ਰੈਜੀਡੈਂਟ ਦੀ ਬਣਤੀ ਹੈ।" ਲਕਸੈਂਬਿਵ ਨੇ ਅੰਕੜਾ ਲਗਾਇਆ ਜਿਸ ਨਾਲ ਜੁਰਮਾਨਾ ਤਾਲਮੇਲ ਰੱਖਣਾ ਪਵੇਗਾ ਜਿਸ ਨੇ ਜੁਰਮ ਨਾਲ ਕੁਝ ਸੰਬੰਧ ਰੱਖਣਾ ਚਾਹੀਦਾ ਹੈ ਅਤੇ ਟੈਕਸ ਜੋ ਕਿ ਸ਼ੁਰੂਆਤੀ ਤੌਰ 'ਤੇ ਵਸੂਲ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਸੀ, ਉਸ ਨੂੰ ਵਧੇਰੇ ਟੈਕਸ ਦੁਆਰਾ ਚਾਰਜ ਕੀਤਾ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ; ਨਹੀਂ ਤਾਂ ਜੁਰਮਾਨਾ ਬਹੁਤ ਜ਼ਿਆਦਾ ਅਤੇ ਬੇਤੁਕਾ ਹੋ ਸਕਦਾ ਹੈ। ਉਸ ਨੇ ਇਸ ਨੂੰ ਪਾਗਲਪਨ ਮੰਨਿਆ, ਜਿੱਥੇ ਇੱਕ ਆਦਮੀ ਨੂੰ ਉਸ ਦੀ ਸਹੀ ਵਾਪਸੀ 'ਤੇ £2,500 ਟੈਕਸ ਦੇਣਾ ਉਚਿਤ ਹੋ ਸਕਦਾ ਹੈ ਅਤੇ £5,1320 ਵਾਪਸੀ 'ਤੇ £5,100 ਟੈਕਸ ਦੇਣਾ ਉਚਿਤ ਹੋ ਸਕਦਾ ਹੈ। ਜੇਕਰ ਕਰੋਨ ਸਹੀ ਹੈ ਤਾਂ ਜੁਰਮਾਨਾ ਸਹੀ ਹੈ; ਜੇਕਰ ਦੂਜਾ ਨਜ਼ਰੀਆ ਸਹੀ ਹੈ ਤਾਂ ਇਹ ਕੇਵਲ £320 ਹੋਵੇਗਾ। ਪਰੰਤੂ ਲਾਰਡ ਰੀਡ ਨੇ ਇਹ ਮੰਨਣਾ ਅਸੰਭਵ ਪਾਇਆ ਕਿ ਸ਼ਬਦ "ਨਾ ਵਧੇਰੇ £20" ਅਤੇ ਇਸ ਐਕਟ ਅਧੀਨ ਉਸ ਨੂੰ ਚਾਰਜ ਕੀਤੇ ਜਾਣ ਵਾਲੇ ਟੈਕਸ ਦੇ ਤਿੰਨ ਗੁਣਾ ਦੇ ਰੂਪ ਵਿੱਚ ਉਹ ਪੁਰਾਣੇ
ਟੈਕਸਿੰਗ ਕਾਨੂੰਨਾਂ ਵਿੱਚ ਦਿਖਾਈ ਦਿੱਤੇ, ਇੱਕ ਸੀਮਿਤ ਅਰਥ ਹੈ ਜਾਂ ਕਿ ਉਹਨਾਂ ਨੂੰ 1952 ਦੇ ਸੰਘਟਨ ਐਕਟ ਵਿੱਚ ਇੱਕ ਸੀਮਿਤ ਅਰਥ ਦੇਣ ਦਾ ਇਰਾਦਾ ਸੀ।
ਹੁਣ ਇਹ ਵਿਚਾਰਨਾ ਬਾਕੀ ਹੈ ਕਿ ਸ਼ਬਦ "ਟਾਲਿਆ" ਅਤੇ "ਵਾਪਸੀ ਵਜੋਂ ਆਮਦਨ" ਦੇ ਸ਼ਬਦਾਂ ਦਾ ਅਸਲੀ ਅਰਥ ਅਤੇ ਮਤਲਬ ਕੀ ਹੈ ਸ. 28(1) ਵਿੱਚ। ਅਪੀਲਕਰਤਾ ਦੇ ਪੇਸ਼ਕਸ਼ ਅਨੁਸਾਰ "ਟਾਲਿਆ" ਨੂੰ ਕਲੋਜ਼ (ਸੀ) ਦੇ ਹਵਾਲੇ ਨਾਲ ਟਾਲਣਾ ਸਮਝਿਆ ਜਾਣਾ ਚਾਹੀਦਾ ਹੈ। ਇਸ ਗੱਲ ਦੀ ਪੁਸ਼ਟੀ ਕਰਨੀ ਚਾਹੀਦੀ ਹੈ ਕਿ ਇਸ ਸ਼ਬਦ ਨੂੰ ਇੱਕ ਵਿਅਕਤੀ ਦੀ ਚੂਕ ਜਾਂ ਚੂਕ ਦੇ ਤੌਰ 'ਤੇ ਸਮਝਿਆ ਜਾਵੇ ਅਤੇ ਇਸ ਨੂੰ ਇਸ ਤਰ੍ਹਾਂ ਨਾ ਸਮਝਿਆ ਜਾਵੇ ਕਿ ਇਸ ਦਾ ਲਾਭਕਾਰੀ ਸਿਰਫ ਆਮਦਨ ਦੇ ਬਚਣ ਨਾਲ ਹੋਵੇ। ਇਸ ਤਰ੍ਹਾਂ ਹਾਈ ਕੋਰਟ ਨਾਲ ਸਹਿਮਤੀ ਜਿਸ ਨੇ ਕੰਸਾਈਸ ਆਕਸਫੋਰਡ ਡਿਕਸ਼ਨਰੀ ਵਿੱਚ ਦਿੱਤੇ ਗਏ ਅਰਥ ਨੂੰ ਸਹੀ ਮੰਨਿਆ ਅਤੇ ਸਹੀ ਢੰਗ ਨਾਲ ਮੰਨਿਆ ਕਿ "ਟਾਲਿਆ" ਸ਼ਬਦ ਦਾ ਪ੍ਰਯੋਗ ਉਸ ਸੰਦਰਭ ਵਿੱਚ ਵੇਖਣਾ ਪਵੇਗਾ ਜਿਸ ਵਿੱਚ ਇਹ ਪ੍ਰਗਟ ਹੁੰਦਾ ਹੈ। "ਵਾਪਸੀ ਵਜੋਂ ਆਮਦਨ" ਦੇ ਸ਼ਬਦਾਂ ਨਾਲ ਪੜ੍ਹਿਆ ਗਿਆ "ਟਾਲਿਆ" ਸ਼ਬਦ ਦੇ ਨਜ਼ਰੀਏ ਵਿੱਚ।

He did not dispute that the transactions were of the kind described in the preamble to s. 18 of the Finance Act I 936, namely, to avoid income tax by transfer of income to persons abroad. The Court of Appeal affinncd the judgment of Macnaghtcn J. that the asscsscc was F liable to be assessed to income tax and sur tax in respect of the whole income of the foreign companies. Dealing with the argu-ment of counsel that the legislature could not have intended to produce a result according to which an entirely disproportionate penalty could he imposed on the tax payer.
