ORDER
For the reasons assigned, I.A.No.19043 of 2023 for condonation of
delay in filing this application is allowed. The delay is condoned.
This application has been filed seeking for restoration of ITA No.146 of2022, which was dismissed for non-compliance of peremptory order dated21.04.2023.
For the reasons assigned in the application and in view of the admitted
negligence and regret expressed by the learned counsel for the applicant, theorder is recalled and ITA No.146 of 2022 is restored to its file subject topayment of cost of Rs.5000/- with the M.P. High Court Bar Association (SBA/c No.519302010000549, IFS CODE: UBIN0551937, Union Bank of India,State Bar Council High Court Branch, Jabalpur) within one week.
The M.C.C. is accordingly allowed and disposed off.
