This application coming on for orders this day, JUSTICE SHEELNAGU passed the following:
ORDER
This MCC has been preferred for restoration of ITA No.32/2017,which was dismissed on 17.08.2022 for want of prosecution.
2. In view of averments made in the petition which is duly supported
b y affidavit of counsel for the appellant, prayer for restoration of ITANo.32/2017 is hereby accepted.
3. In view of reasons mentioned in the MCC, the same is allowed
subject to payment of cost of Rs.2,000/- (Rs. Two Thousand Only) to bedeposited with M.P. State Legal Services Authority, Jabalpur within aperiod of 15 days from today. The MPSLSA shall donate this amount to the
Permanent Artificial Organ Transplantation Centre, Netaji SubhashChandra Bose Medical College, Jabalpur. On furnishing receipt of depositof cost, Registry shall restore ITA No.32/2017 to its original number forbeing adjudicated on its own merits.
4. Accordingly, MCC stands allowed.
5. A copy of this order be placed in the record of ITA No.32/2017.
