21.07.2017 Ms. Veena Mandlik, learned counsel for the applicant. Heard on the question of admission. Learned counsel for the applicant has submitted that due to non-compliance of common conditional order dated 18.05.2017, the appeal was dismissed in default on 10.07.2017. She has further submitted that the applicant will cure the defect within a period of seven days from today. Considering the aforesaid and for the reasons assigned in the application, which is supported by the affidavit of learned counsel for the applicant, we restore ITA No.40/2017 to its original number and direct the applicant to cure the defect, as pointed out on 18.05.2017 within a period of seven days from today failing which, this order shall stand dismissed without any reference to the Court.
