Mohanty, learned Senior Standing Counsel appearing for the opposite party-Income Tax Department. 3. The petitioner has filed this writ petition seeking direction to Commissioner of Income Tax (Appeals) to consider and dispose of the Appeal No.154431110180523, acknowledged vide Annexure-3 dated 18.05.2023, preferred by the deceased son of the petitioner. 4. This Court is not inclined to issue such direction. However, liberty is granted to the petitioner to file an application before the Commissioner of Income Tax (Appeals) for early disposal of Appeal No.154431110180523, which has been acknowledged vide Annexure-3 dated 18.05.2023. In the event the petitioner files such application, the Commissioner of Income Tax (Appeals) shall consider the same and pass appropriate order taking into consideration the order dated 19.05.2022 passed by this Court in W.P.(C) No.11229 of 2022 (M/s. Associates Infra Developers Pvt. Ltd., Sambalpur v. The Assistant Commissioner of Income Tax, Central Circle, Sambalpur) in accordance with law. 5.
