The petitioner has filed this writ petition seeking direction to opposite party no.3 to consider and dispose of the appeal bearing acknowledgement no.4398722300120723 under Annexure-6 within a stipulated time. 4. Mr. J.M. Pattnaik, learned counsel for the petitioner states that the petitioner has already preferred appeal, which is pending before opposite party no.3. Therefore, direction may be given to the authority to consider and dispose of the same within a stipulated time. 5. Mr. S. Mohanty, learned counsel appearing for the Income Tax Department contended that he has no objection for disposal of the appeal, but the said appeal is of the year 2023. Therefore, unless the petitioner shows specific reason to take up the matter out of the turn, the same cannot be considered by the authority. 6. Having heard learned counsel for the parties and after going through the records, but, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of permitting the petitioner to file an appropriate application before the appellate authority to take up the appeal under Annexure-6 on out of turn basis.
